DATE: TO: September 28, 2010 Planning Commission SUBJECT: WRITTEN COMMUNICATION - Consideration of whether the acquisition of the 67± acres of the Schaefer Ranch Property by the East Bay Regional Park District is consistent with the Dublin General Plan. Report prepared by Jamie Rojo EXECUTIVE SUMMARY: The East Bay Regional Park District has accepted a land donation from Schaefer Ranch Holdings, LLC of 67± acres within the Schaefer Ranch property and is proposing to use this land as an expansion to the Dublin Hills Regional Park. The 67± acres of land are located to the north of Dublin Boulevard (APN's 941-2832-001 through 941-2832-008). In accordance with Government Code Section 65402 the Planning Commission is requested to report whether the acquisition of 67± acres of land by the East Bay Regional Park District, located within the Schaefer Ranch property for park and open spaces uses, is consistent with the Dublin General Plan. RECOMMENDATION: Staff recommends that the Planning Commission: 1) Receive Staff presentation; 2) Adopt the Resolution finding that the acquisition of 67± acres of land by the East Bay Regional Park District located in the Schaefer Ranch development is consistent with the City of Dublin General Plan. Subm ted y sista P rft COPIES TO: Applicant/Property Owner File G:\PAM2010\EBRPD General Plan Consistency STAFF REPORT PLANNING COMMISSION Page 1 of 2 L evi w By Plannin anager ITEM NO.: / • PROJECT DESCRIPTION: On August 3, 2010, the City of Dublin received a letter from the East Bay Regional Park District indicating their acceptance of 67± acres of donated land by Schaefer Ranch Holdings, LLC, located within the Schaefer Ranch property (Attachment 1). California Government Code Excerpt section 65402.a provides, in part, that: "no real property shall be acquired by dedication or otherwise for street, square, park or other public purposes, and no real property shall be disposed of, no street shall be vacated or abandoned, and no public building or structure shall be constructed or authorized, if the adopted general plan or part thereof applies thereto, until the location, purpose and extent of such acquisition or disposition, such street vacation or abandonment, or such public building or structure have been submitted to and reported upon by the planning agency." East Bay Regional Park District has requested that the City of Dublin report whether the 67± acres of land are in conformance with the City of Dublin General Plan. As mentioned above, the 67± acres of land will be used as an expansion to the Dublin Hills Regional Park. The acquisition of land and proposed use is consistent with the existing Dublin Hills Regional Park and surrounding residential development in that it will provide for further recreational opportunities and will be an added benefit for the residents and community. In the Parks and Open Space Element of the General Plan, it is recommended that open space areas should be preserved for provisions of recreational opportunities. The 67± acres of land is designated Open Space in the General Plan and will be added to the existing Dublin Hills Regional Park and will be used for a park, trails and open space. The General Plan includes Guiding and Implementing Policies to acquire and improve parklands. Chapter 3 of the General Plan encourages the creation a local trail network that links large areas of permanent open space, while providing convenient access from nearby residential areas as well as to provide active recreational facilities to serve neighborhood residents. The 67± acres of land that will be used as an expansion to the Dublin Hills Regional Park will include trails linking other large areas of permanent open space. The acquisition of land will also provide convenient access from nearby residential areas and will serve as a recreational benefit to serve neighborhood residents through the open space, trail and park uses proposed. Staff believes that the acquisition of land is consistent with the General Plan in that the proposed use of parks and recreation uses does not conflict with the existing General Plan land use designation of Open Space or with any other requirements in the General Plan. The acquired land by the East Bay Regional Park District will be an added benefit to the community and meets the intentions of the Parks and Open Space Element within the General Plan. Staff recommends that the Planning Commission find the acquisition of 67± acres of land by the East Bay Regional Park District to be consistent with the Dublin General Plan.
