A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
RECOMMENDING THAT THE CITY COUNCIL APPROVE THE MITIGATED NEGATIVE
DECLARATION, ADOPT THE MITIGATION MONITORING PROGRAM AND GENERAL PLAN
AMENDMENT FOR PA 95-029, THE TRUMARK HOMES PROJECT
WHEREAS, Trumark Homes has applied for a General Plan Amendment changing the site's Land Use
Designation from Transportation Corridor to Medium Density Residential (Exhibit A); and
WHEREAS, the California Environmental Quality Act (CEQA), State CEQA Guidelines and the City of
Dublin Environmental Guidelines require that certain projects be reviewed for environmental impacts and that
environmental documents be prepared; and
WHEREAS, an Expanded Initial Study and Mitigated Negative Declaration were prepared for the
Trumark Homes Project and is available and on file in the Planning Department; and
WHEREAS, Public Resources Code Section 21080.6 requires the City to adopt a reporting or monitoring
program for changes in a project or conditions imposed to mitigate or avoid significant environmental effects in
order to ensure compliance during projecX implementation; and
WHEREAS, a Mitigation Monitoring Program has been prepared for the Trumark Homes Project in
accordance with Public Resources Code Section 21080.6 and is available and on file in the Planning Department;
and
WHEREAS, the Planning Commission of the City of Dublin has held one public heating on the documents
entitled Expanded Initial Study, Mitigated Negative Declaration, Mitigation Monitoring Program and the General
Plan Amendment for the proposed Tmmark Homes Project; and
WHEREAS, the Planning Commission received and reviewed the City Planning Department's Staff Report
on the General Plan Amendment, including said Expanded Initial Study, Mitigated Negative Declaration and
Mitigation Monitoring Program on the environmental effects of the project; and
WHEREAS, the Planning Commission considered the documentary and oral evidence submitted at the
public heating.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby find that:
1. The Expanded Initial Study, Mitigated Negative Declaration, and Mitigation Monitoring Program are
adequate and have been prepared in compliance with the California Environmental Quality Act, CEQA Guidelines
and the City of Dublin Environmental Guidelines; and
2. That the Planning Commission has reviewed and considered the information contained in the Expanded
Initial Study, Mitigated Negative Declaration, and Mitigation Monitoring Program; and
3. That based upon a review of the analysis of pertinent environmental issues presented in the Expanded
Initial Study, the Planning Commission has hereby found and determined that, although the proposed project may
have potentially significant effects on the environment as presented in the Expanded Initial Study, the mitigation
measures have reduced any impacts of the project to a level of insignificance and that the project will not have a
significant effect on the environment.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Planning Commission does hereby
recommend that the City Council approve the Mitigated Negative Declaration and adopt the Mitigation Monitoring
Program for the Trumark Homes Project.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Planning Commission does hereby find
1. The existing Transportation Corridor Land Use Designation in the General Plan is no longer appropriate
for this area because the Southern Pacific Railroad no longer has a traction line in this location; and,
2. The Site is suitable for residential development with the incorporation of the mitigation measures included
in the Mitigated Negative Declaration.
NOW, THEREFORE, BE IT FURTHER RESOLVED that the Planning Commission does hereby
recommend that the City Council approve PA 95-029, Trumark Homes General Plan Amendment for one parcel
(APN 941-0205-006-010), from Transportation Corridor to Medium Density Residential as shown on Exhibit A.
PASSED, APPROVED AND ADOPTED this 16th day of April, 1996.
