HomeMy WebLinkAboutPCReso 95-01 PA94-001 Rec CC S.RitaCml NegDec/MMPRESOLUTION NO. 95-01 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN RECOMMENDING THAT THE CITY COUNCIL APPROVE THE MITIGATED NEGATIVE DECLARATION AND ADOPT THE MITIGATION MONITORING PROGRAM FOR PA 94-001, THE SANTA RITA COMMERCIAL CENTER PROJECT WHEREAS, the California Environmental Quality Act (CEQA), State CEQA Guidelines and the City of Dublin Environmental Guidelines require that certain projects be reviewed for environmental impacts and that environmental documents be prepared; and WHEREAS, the City of Dublin prepared a program environmental impact report (SCH No. 91103064) for the Eastern Dublin Specific Plan and General Plan Amendment; and WHEREAS, the City of Dublin certified the Final Environmental Impact Report for the Eastern Dublin General Plan Amendment and Specific Plan on May 10, 1993; and WHEREAS, the Santa Rita Commercial Center Project will be located within the boundaries of the Eastern Dublin Specific Plan; and WHEREAS, an Initial Study and Mitigated Negative Declaration was prepared for the Santa Rita Commercial Center Project; and WHEREAS, Public Resources Code Section 21080.6 requires the City to adopt a reporting or monitoring program for changes in a project or conditions imposed to mitigate or avoid significant environmental effects in order to ensure compliance during project implementation; and WHEREAS, a Mitigation Monitoring Program has been prepared for the Santa Rita Commercial Center Project in accordance with Public Resources Code Section 21080.6; and WHEREAS, the Planning Commission of the City of Dublin has held three public hearings on the documents entitled the Initial Study and Mitigated Negative Declaration (SCH No. 94113020) and Mitigation Monitoring Program for the proposed Santa Rita Commercial Center Project on December 19, 1994, January 3, 1995 and January 17, 1995; and WHEREAS, the Planning Commission received and reviewed the City Planning Department's Staff Report, including said Initial Study, Mitigated Negative Declaration and Mitigation Monitoring Program on the environmental effects of the project; and WHEREAS, the Planning Commission considered the documentary and oral evidence submitted at the public hearing. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby find that: 1. The Initial Study, Mitigated Negative Declaration, and Mitigation Monitoring Program are adequate and have been prepared in compliance with the California Environmental Quality Act, CEQA Guidelines and the City of Dublin Environmental Guidelines; and 2. That the Planning Commission has reviewed and considered the information contained in the Initial Study, Mitigated Negative Declaration, and Mitigation Monitoring Program; and 3. That based upon a review of the Planned Development Proposal, consultations with responsible agencies and analysis of pertinent environmental issues presented in the Initial Study, the Planning Commission has hereby found and determined that, although the proposed project may have potentially significant effects on the environment as presented in the Initial Study, the mitigation measures and conditions of approval have reduced any impacts of the project to a level of insignificance and that the project will not have a significant effect on the environment. NOW, THEREFORE, BE IT FURTHER RESOLVED that the Planning Commission does hereby recommend that the City Council approve the Mitigated Negative Declaration and adopt the Mitigation Monitoring Program for the Santa Rita Commercial Center Project.
