HomeMy WebLinkAbout10-12-2010 PC Minutes C`F ~7 Planning Commisszon Minutes Tuesday, October 12, 2010 CALL TO ORDER/ROLL CALL A regular meeting of the City of Dublin Planning Commission was held on Tuesday, October 12, 2010, in the City Council Chambers located at 100 Civic Plaza. Chair King called the meeting to order at 6:59:06 PM Present: Chair King; Vice Chair Brown; Commissioners Schaub and Wehrenberg; Jeff Baker, Planning Manager; Mike Porto, Consulting Planner; and Debra LeClair, Recording Secretary. Absent: Cm. Swalwell ADDITIONS OR REVISIONS TO THE AGENDA - NONE MINUTES OF PREVIOUS MEETINGS - On a motion by Cm. Schaub, seconded by Cm. Brown the minutes of the September 28, 2010 meeting were approved. ORAL COMMUNICATIONS - NONE CONSENT CALENDAR - NONE WRITTEN COMMUNICATIONS - NONE PUBLIC HEARINGS - 8.1 PA 07-006 Grafton Plaza, Development Agreement Amendment No. 2 Mike Porto, Consulting Planner presented the project as outlined in the Staff Report. Chair King opened the public hearing. John Zukoski, resident, asked for an explanation of the changes. Mr. Porto answered there are no changes. He explained this is an administrative action encapsulating the approvals the Applicant received in May 2010 into the Development Agreement. Cm. Schaub mentioned the Development Agreement is still a 5-year agreement and there is no change to the timeframe. 7:04:43 PM Cm. Swalwell joined the meeting. Chair King closed the public hearing. Cm. Wehrenberg asked about the two sites identified as Kaiser Hospital sites. z2'fscrcniny Commrssiott Qctober72, 2010 fKegufar R2eeting 124 Mr. Porto answered there is still a portion of the Kaiser property in Area H closest to the water quality pond, and the area east of the red line is in Area C of the Dublin Ranch. Cm. Wehrenberg acknowledged the map is for identifying areas only. Cm. Swalwell stated even though he joined the meeting late, he was familiar with the project and felt comfortable voting on it. On a motion by Cm. Wehrenberg and seconded by Cm. Schaub, on a vote of 5-0, the Planning Commission approved: RESOLUTION N0.10-48 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN RECOMMENDING THAT THE CITY COUNCIL ADOPT AN ORDINANCE APPROVING AMENDMENT NO. 2 TO THE MASTER DEVELOPMENT AGREEMENT BETWEEN THE CITY OF DUBLIN AND THE LIN FAMILY FOR THE DUBLIN RANCH PROJECT (AREAS A, B, C, D, E, F, G AND H) PA 07-006 8.2 PLPA-2010-00044 Castello at Positano Site Development Review for a portion of the Positano project which includes 101 single-family detached residential units on approximately 25.3 acres within Tracts 7855, 8050 and 8051. Mike Porto, Consulting Planner presented the project as outlined in the Staff Report. Cm. Schaub mentioned that the tandem garage space has been successful in his neighborhood because residents use the space for storage. Cm. Wehrenberg commented that the garage has plenty of space for the trash bins, but the plans only show two bins when Dublin garbage services have three. Cm. Schaub asked if the granny unit complies with the affordable housing requirement. Mr. Porto answered yes. Cm. Brown asked what the definitive criteria is for affordable housing and how does a granny flat meet that criteria. Jeff Baker, Planning Manager responded there is a section of the Zoning Ordinance that establishes affordable housing obligations, sets up standards and requires an agreement between the City and the developer. It also allows for the Council to make an interpretation as Aanning ('ommission Octo6cr 12, 2010 ,ftalrtr Iaeeting 125 to how to achieve the affordable housing requirement. He continued, in regards to this project, instead of going strictly by the Zoning Ordinance the Council elected to do a combined effort which includes some single family homes as well as various granny flats. He also stated that Braddock and Logan provided the City with a Community Benefit Payment to offset some of their affordable housing obligations. He stated the Council reviewed the program and approved an agreement which the Applicant is now implementing. Cm. Brown asked if the granny flat is specifically defined as affordable housing. Mr. Baker answered yes; it is defined in the agreement with Braddock and Logan which establishes size requirements, the number of units that must be provided and what affordability level they must achieve. Chair King asked if there is 4-sided architecture in this project. Mr. Porto answered one of the unique features of the development standards for the Positano project stated the benefits to the developer for stepping back the second floor with revised setbacks. He stated most developers choose to use the stepped back side elevation to create additional light and air between the houses. He stated the plan would introduce a roof element where there was a blank wall. He continued, with all the different projects in Positano, all materials used on the front of the house must carry back to the sideyard fence so that the view shows the architectural feature of the homes. Chair King stated that if Mr. Porto is satisfied the houses are interesting enough from the street then he would be in support of the project. Mr. Porto stated the project is consistent with the other projects within the Positano development. Chair King asked where the children would go to play. Mr. Porto pointed out the 4 acre neighborhood park close by the project. Mr. Baker stated there is also a future school site in the area. Cm. Brown mentioned Condition of Approval #37, which states the Applicant must provide a "Utility Siting Plan." He was concerned about where the gas lines are located in the project. Mr. Porto answered the gas lines are small residential gas lines that feed off of small gas lines in the public utility easement that runs along the front of the property. He stated the gas lines run along the side of the garage where the gas meter is placed with the other meters at the utility connection area of the house. He continued there is a main shut-off valve in the area as well in case of emergencies. Cm. Brown asked if the requirement is to keep the large feeder gas lines out of the neighborhoods. TCanning ('ommissiun Ottobtrl2, 2010 Wggulrtr `bfeeting 126 Mr. Baker answered there are no large gas lines in that area and the Public Works Department has recently surveyed the City to determine where the major gas lines are located within the City and there are none in this vicinity. He continued CEQA guidelines also require the City to review potential hazards when evaluating projects, which includes major gas lines. Cm. Schaub stated Dublin Blvd is being redone and during the project PG&E is installing new small gas line pipes made of plastic to replace the existing gas line pipes. Chair King opened the public hearing. Andy Byde, Braddock & Logan, spoke in favor of the project. He stated this project is part of the previous Salerno project which was started years ago. He felt they have identified what buyers are looking for and the success of the project reflects that. He thanked the Staff and the City for their work on the project. He stated Braddock and Logan are in agreement with the Conditions of Approval. Cm. Schaub felt the project looks good and will hold the values of the property in the area. He liked the large space between the lots. Cm. Brown referred to the fencing diagram on Page L-2 which shows the street side fences which are lattice and the diagram shows both 6 feet and 4.5 feet fence heights and asked if they are options. Mr. Porto stated there is a requirement in the development plan that 25% of the house be covered with a full height fence then steps down and moves forward to open up more of the side elevation to the street side so the view is more of the house instead of the fence. Chair King closed the public hearing. On a motion by Cm. Wehrenberg and seconded by Cm. Swalwell asked for an update on new projects. Mr. Baker answered Maui Waui and Quiznos have closed but Quiznos is being replaced with Mr. Pickles. The Grocery Outlet is going into the Anderseri s TV building. Cm. Brown asked if Whole Foods is still ' planned. Mr. Baker responded the project is not moving forward at this time possibly due to the difficult economic times. 10.3 Cm. Brown asked when the Planning Institute is scheduled. Mr. Baker answered it is usually in March but will get the date and email it to him. 10.4 Chair King asked when the DDSP will be finalized. Mr. Baker answered the document is out for public review until November 4th and Staff hopes to bring it to the Planning Commission in December but it will depend on the number of comments received. Mr. Baker mentioned there is a general informational meeting for property owners and the general public scheduled for Wednesday, October 13, 2010.
