The new building includes approximately 19,000 square feet of space and provides for a banquet hall for 300 people, a catering kitchen, two preschool classrooms, flexible meeting rooms, Staff area, and support spaces. The traditional mission style design of the building incorporates a terra cotta colored tile roof, cream-colored walls, sandstone colored base, dark window mullions and green stone accent tiles. The building interior has similar finishes and colors that mimic the terra cottas and creams in the wall colors, carpets and tiles. As part of the bid package Staff included the following three alternates primarily to achieve some flexibility in meeting the project intent and budget: 1) Restroom Building; 2) Temporary Generator; and 3) LEED Processing. ENVIRONMENTAL REVIEW: The City prepared an Initial Study and draft Mitigated Negative Declaration for the proposed project consistent with CEQA Guidelines section 15162. The City determined that the proposed project would not result in any significant adverse impacts with the mitigation measures incorporated into the project. The project site is located within Shannon Park and is surrounded by urban land uses. The project also proposes replacement of the existing community center building on essentially the same building footprint as the existing facility. The Initial Study determined that with the implementation of mitigation measures contained in the Initial Study any potential impacts of the project would be reduced to a level of insignificance and would not result in significant effects on the environment. The Mitigated Negative Declaration/Initial Study was distributed for public review and comment from January 5,2007 through February 5, 2007, in accordance with CEQA Guidelines. The 30- day review period included a referral to the State Clearinghouse, since a creek extends through the site and the State Department ofFish and Game exercises authority over any work that could affect the creek. Comments Received: The City received four comment letters during the public review period. Copies of the comment letters and responses to agencies are included in this staff report as part of Attachment 2. Commenting City departments and agencies included the State Clearinghouse, acknowledging the City has complied with CEQA requirements for State agency notification, the City of Dublin Police Services Department, Zone 7 and Dublin San Ramon Services District. None of the comments raised significant environmental issues and Staff has forwarded responses to the comments to each respective agency. A Resolution to adopt the Mitigated Negative Declaration for the Shannon Community Center replacement project is included in Attachment 1, with the Mitigated Negative Declaration attached as Exhibit A A Mitigation Monitoring and Reporting Program is required by CEQA and Guidelines to be dVbY adopted with the Mitigated Negative Declaration. The Mitigation Monitoring and Reporting Program facilitates the implementation of the recommended measures and is also attached to the Resolution as Exhibit B for adoption with the Mitigated Negative Declaration. The analysis and assessment contained in the Mitigated Negative Declaration/Initial Study for the proposed project and the associated Mitigation Monitoring and Reporting Program satisfies the requirements of the California Environmental Quality Act and provides the City with the necessary information to review and approve the project. BID RESULTS: After a six -week bid period, on March 5, 2007 the City received bids from Sierra Bay Contractors, Inc., Mid State Construction, McCrary Construction, Sausal Corporation, NBC General Contractors, Zovich and Sons, and John Plane Construction. As discussed above in the financial statement, the low bid exceeds the available budget by $1,086,565 (including all alternates and a 10% contingency). Without alternates, the low bid with a 10% contingency exceeds the available budget by $742,930. A cost impact for each alternate is as follows: Alternate #1 - Add Restroom Building The restroom building is located next to the children's play area and would provide a conveniently accessible restroom for the park. If this element is removed then the new community center would provide the closest restroom facility while the building is open. Additional funds required to include in project $262,526 (includes 10% contingency) Alternate #2 - Emergency Generator Hook Up The intent of this alternate was to provide for a location for a temporary generator hook up in the case of an emergency. The hook up can be installed at a later date as conduit and space was left in the base bid to allow for a properly integrated system to be built in after completion of the building. Additional funds required to include in project $69,758 (includes 10% contingency) Alternate #3 - LEED Processing Per the City's Green Building Ordinance the City Council can determine that this portion of the project is not necessary and direct staff to move forward without applying for the LEED Silver Certification. (The range of bids for this alternate included a low bid of $5,000 and a high bid of $250,000) Additional funds required to include in project $10,318 (includes 10% contingency) Staff is also continuing the pursuit of grant funding from PG&E ($7,300) and Alameda County Waste Management Authority (a potential of range of $65,000 to $85,000) to help off set some of the building costs. Much of this funding is contingent on meeting the goal that the building being certified at a LEED Silver level. The City Council previously approved $104,785 for public art for the project however funds were not appropriated. The intent was to bring a budget change to the Council at the time the contract for the project is awarded. The total additional funds needed to award the base bid and alternates (including a 10% contingency) and the artwork is $1,191,350. For the environmental review, it is recommended that the City Council adopt a Resolution (Attachment 1) adopting the Mitigated Negative Declaration (attached as Exhibit A) and the Mitigation Monitoring and Reporting Program (attached as Exhibit B). For the award of bid, it is recommended that the City Council award the base bid to Sierra Bay Contractors, Inc. and determine whether any or all ofthe alternates should be included. Staff has prepared two resolutions. The first resolution in Attachment 5 is for the base bid without alternates. The second resolution in Attachment 6 is for the base bid in addition to alternates. It will be necessary to determine the amount based on the alternates selected for inclusion. In order to award the bid, a budget change is necessary. L1 Cib f RESOLUTION NO. - 07 \ru~' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ***************** ADOPTING A MITIGATED NEGATIVE DECLARATION AND MITIGATION MONITORING PROGRAM FOR 07-02, SHANNON COMMUNITY CENTER WHEREAS, the project site is located in the central portion ofthe City of Dublin and is occupied by the existing Shannon Community Center which is in need of replacement due to the age of the structure and interior mold conditions; and WHEREAS, the City has prepared preliminary plans for the reconstruction of the Shannon Community center in approximately the same location as the existing facility and of the same approximate size and height of the existing facility; and WHEREAS, the City prepared an Initial Study for P A 07-02 to evaluate the environmental impacts of constructing a replacement Shannon Community Center, consistent with CEQA Guidelines Section 15162, and determined that the proposed proj ect would not result in any significant adverse impacts with the recommended mitigation measures incorporated into the project; and WHEREAS, a Mitigated Negative Declaration, attached as Exhibit A, and Mitigation Monitoring Program, attached as Exhibit B, for P A 07-02 have been prepared for the project with the finding that with the implementation of mitigation measures, and those incorporated into the Project, the potential site- specific impacts of the project would be reduced to a less-than-significant level; and WHEREAS, a properly noticed 30-day public review period was held for the Mitigated Negative Declaration, which began on January 5, 2007 and ended on February 5,2007; and WHEREAS, letters commenting on the Mitigated Negative Declaration were received during the public review period from the California State Clearinghouse, Dublin Police Services Department, Zone 7 and Dublin San Ramon Services District. These are attached to the staff report and do not raise any significant environmental issues; and WHEREAS, the proposed reconstructed Shannon Community Center building would be located in the approximate same footprint as the existing Community Center building and no improvements would extent into Koopman Creek, the regional creek that flows through the project site. However, the City of Dublin may be required to obtain a Streambed Alteration Agreement with the State Department of Fish and Game to remove non-native, invasive plant species within Koopman Creek; and WHEREAS, a Staff report was submitted recommending that the City Council adopt a resolution approving the Mitigated Negative Declaration, as contained in Exhibit A, and the Mitigation Monitoring Program, as contained in Exhibit B, for the reconstruction of Shannon Community Center; and WHEREAS, the City Council did hold a properly noticed public hearing on the project on ~-'2I.)~07 ~,I ATTACHMENT 1 2t> March 20, 2007, at which time in their independent judgment reviewed and considered the Mitigated Negative Declaration and all reports, recommendations and testimony before them. NOW, THEREFORE, BE IT RESOLVED, that the above recitals are incorporated in this resolution. BE IT FURTHER RESOLVED that the Dublin City Council does hereby find that: A. There is no substantial evidence in light ofthe whole record before the City that the proposed Project, as mitigated, will not have a significant effect on the environment. B. The mitigation measures identified in the Initial Study/Mitigated Negative Declaration for P A 07-02 are included in the Proj ect description. C. The Mitigated Negative Declaration has been prepared in accordance with State and local environmental laws and guidelines. D. The Mitigated Negative Declaration is complete and adequate for the proposed project, and reflects the City's independent judgment and analysis as to the environmental effects of the proposed proj ect. BE IT FURTHER RESOLVED THAT the City Council of the City of Dublin does hereby adopt the Mitigated Negative Declaration (Exhibit A) and Mitigation Monitoring Program (Exhibit B) for P A 07 -02, Shannon Center, including the Initial Study incorporated herein by reference.
