A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
REPORT BY THE CITY OF DUBLIN PLANNING COMMISSION AS TO CONFORMITY OF
LOCATION, PURPOSE AND EXTENT OF THE PROPOSED DISPOSAL OF SURPLUS
PROPERTY BY ALAMEDA COUNTY WITH THE INDUSTRIAL PARK AND CAMPUS OFFICE
DESIGNATIONS OF THE DUBLIN GENERAL PLAN.
WHEREAS, the County of Alameda Surplus Property Authority has determined
approximately 25 acres of land, which hereafter shall be referred to in this document as 'the
property", located East of Arnold Way, South of Gleason Drive, West of the northerly
projection of Hacienda Drive and North of lands designated Campus Office on the Dublin
General Plan to be surplus; and
WHEREAS, Government Code Section 65402(b) provides in part that a county shall
not dispose of real property within the corporate limits of a city if such city has adopted a
General Plan and such General Plan is applicable thereto until the location, purpose, and
extent of such disposition has been submitted to and reported upon by the planning agency
having jurisdiction, as to conformity with said adopted General Plan or part thereof; and
WHEREAS, the City of Dublin General Plan was adopted on February 11, 1985, and
amended September 14, 1992; and
WHEREAS, the Eastern Dublin Specific Plan and Eastern Dublin General Plan
Amendment were adopted on May 10, 1993; and
WHEREAS, the property determined to be surplus, and proposed to be disposed of
by Alameda County, lies within the corporate limits of the City of Dublin; and
WHEREAS, the City of Dublin has adopted a General Plan and such Plan is
applicable to the property determined to be surplus, and proposed to be disposed of, by
Alameda County; and
WHEREAS, the property determined to be surplus by Alameda County and proposed
for disposal is located within an area encompassed by the Industrial Park and Campus Office
designations of the Dublin General Plan, and developed for industrial business park purposes
in a manner consistent with those designations; and
WHEREAS, the property determined to be surplus by Alameda County is to be
disposed of and developed for residential purposes in accordance with the requirements and
purposes of the Industrial Park and Campus Office designations of the Dublin General Plan;
and
WHEREAS, the property determined to be surplus by Alameda County and to be
disposed of and developed for industrial business park development purposes is within the
physical scope of the Dublin General Plan and therefore its extent will be encompassed by,
and consistent with, the General Plan.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does
hereby find that:
A. The General Plan of the City of Dublin is applicable to the property located
East of Arnold Way, South of Gleason Drive, West of the northerly projection of Hacienda
Drive and North of lands designated Campus Office on the Dublin General Plan which has
been determined to be surplus by Alameda County.
B. The property determined to be surplus by Alameda County and to be
disposed of is located within an area encompassed by the Industrial Park and Campus Office
designations of the Dublin General Plan, and to be developed for industrial business park
purposes in a manner consistent with those designations, and therefore the disposal of that
land is consistent with regard to location with the Dublin General Plan.
C. The property determined to be surplus by Alameda County is to be disposed
of and developed for industrial business park purposes in accordance with the requirements
and purposes of the Industrial Park and Campus Office designations of the Dublin General
Plan, and therefore the disposal of that land is consistent with regard to purpose with the
Dublin General Plan.
D. The property determined to be surplus by Alameda County and to be
disposed of and developed for industrial business park purposes is within the physical scope
of the Dublin General Plan, its extent will be encompassed by the Dublin General Plan,
therefore the disposal of that land is consistent with regard to extent with the Dublin
General Plan.
