RECOMMENDATION: Staff recommends that the Planning Commission: 1) Receive Staff presentation; 2) Open the public hearing; 3) Take testimony from the Applicant and the public; 4) Close the public hearing and deliberate; and 5) Adopt a Resolution approving a Conditional Use Permit for "Retail - Outdoor Storage" for the Grocery Outlet. Outdoor display is considered "Retail - Outdoor Storage" and is conditionally permitted in the C-1 Zoning District. ANALYSIS: The outdoor storage and sales of materials for a retail use is subject to approval of a Conditional Use Permit by the Planning Commission in the C-1 Zoning District. As noted above, Grocery Outlet is a "Retail - General" Use Type and is therefore allowed to have outdoor storage of merchandise pursuant to a Conditional Use Permit. The main entrance to the building is located on the south elevation at the west end of the building Grocery - (see Figure 2). The merchandise display ' Outlet area would be approximately 900 square" feet and would be located near the main J rin'Entrance entrance to the building (Attachment 1, Exhibit A). - :1-0 Grocery Outlet proposes to place up to 18 field bins (see Attachment 11 Exhibit ® N B) for the display of fresh produce and vegetables. Outdoor Storage 2of5 Conditions of Approval have been placed on the project to ensure an attractive display environment outside of the grocery store. All field bins are required to be similar in design; colors, materials and size (see Attachment 1, Condition of Approval No. 10). Pallets, cardboard boxes and wire racks would not be permitted outside of the store. Condition of Approval No. 14 requires that the property be maintained in a safe, clean and litter free condition at all times and Condition of Approval No. 19 requires that the placement of the field bins comply with all accessibility requirements. Parkin Grocery Outlet is required to provide 1 parking space for every 300 square feet of gross building area. The building is 13,500 square feet and thus requires 45 parking spaces. Outdoor storage requires additional parking at a ratio of 1 parking space for every 1,000 square feet. The merchandise display area is approximately 900 square feet resulting in a parking requirement of 0.90 spaces. Section 8.76.040.K of the Zoning Ordinance states that when the number of required parking spaces results in a fraction of 0.50 or higher, the required parking is rounded up to the next whole space. Therefore, Grocery Outlet is required to provide 1 additional parking space for the merchandise display area. The total parking requirement for Grocery Outlet would be 46 parking spaces; 45 spaces for the store and 1 space for the outdoor display. A total of 121 spaces are provided on-site resulting in a surplus of 75 parking spaces. ENVIRONMENTAL REVIEW: The California Environmental Quality Act (CEQA), together with the State Guidelines and City Environmental Regulations require that certain projects be reviewed for environmental impacts and when applicable, environmental documents prepared. Staff is recommending that the Conditional Use Permit for "Retail - Outdoor Storage" at Grocery Outlet be found exempt from CEQA pursuant to Section 15301 (Existing Facilities). CONSISTENCY WITH THE GENERAL PLAN, SPECIFIC PLAN AND ZONING ORDINANCE: The project site is designated Retail/Office on the Dublin General Plan Land Use Map and is located in a PD (Planned Development) Zoning District (the Downtown Core Specific Plan area) with underlying C-1 (Neighborhood Commercial) Zoning. Grocery Outlet is a "Retail - General" Use Type and is permitted in the C-1 Zoning District. The C-1 Zoning District allows "Retail - Outdoor Storage" associated with "Retail - General" Use Types subject to approval of a Conditional Use Permit by the Planning Commission. Conditions of Approval have been placed on the project to ensure an attractive display environment in front of the store. REVIEW BY APPLICABLE DEPARTMENT AND AGENCIES: The Building Division, Fire Prevention Bureau, Public Works Department, Dublin Police Services and Dublin San Ramon Services District have reviewed the project and, where appropriate, have provided Conditions of Approval to ensure that the project is established in compliance with all local Ordinances and Regulations. Conditions of Approval from these departments and agencies have been included in the attached Resolution (Attachment 1). 3of5 NOTICING REQUIREMENTS/PUBLIC OUTREACH: In accordance with State law, a Public Notice was mailed to all property owners and occupants within 300 feet of the proposed Project. A Public Notice was also published in the Valley Times and posted at several locations throughout the City. A copy of this Staff Report was also forwarded to the Applicant.
