RESOLUTION NO. 11-XX
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING A SITE DEVELOPMENT REVIEW TO ADD A RAISED TOWER ELEMENT TO
THE REAR OF THE NEW RETAIL BUILDING APPROVED FOR THE PROJECT SITE AT
7099 AMADOR PLAZA ROAD AND DIRECTING STAFF TO WORK WITH THE APPLICANT
ON A MASTER SIGN PROGRAM FOR THE PROJECT SIGNAGE
(APN 941-0305-026-00)
PLPA-2010-00062
WHEREAS, Michael Carey of Laconia Development (Applicant and Property Owner),
submitted a Site Development Review (SDR) application to add a new, raised tower element to
the rear of a new retail building approved for the project site at 7099 Amador Plaza Road. The
application also includes a conceptual design for a freeway-oriented wall sign for the future
tenant (Recreational Equipment, Inc. - REI) on the 40' tower element (the "Project"); and
WHEREAS, the Project site is located in the Planned Development (Downtown Core
Specific Plan) Zoning District, which permits retail uses, and has a General Plan Land Use
designation of Retail/Office; and
WHEREAS, the California Environmental Quality Act (CEQA), together with State
Guidelines and City Environmental Regulations require that certain projects be reviewed for
environmental impacts; and
WHEREAS, Staff recommends that the project be found exempt from the California
Environmental Quality Act (CEQA) in accordance with Section 15301 (Minor alterations to
existing facilities involving little or no expansion); and
WHEREAS, a Staff Report was submitted to the City of Dublin Planning Commission
recommending Site Development Review approval of the project; and
WHEREAS, the Planning Commission held a public hearing on said application on
January 24, 2011; and
WHEREAS, proper notice of said hearing was given in all respects as required by law;
and
WHEREAS, the Planning Commission did hear and consider all reports,
recommendations and testimony herein above set forth and used its independent judgment to
evaluate the project.
NOW, THEREFORE, BE IT RESOLVED that the City of Dublin Planning Commission
does hereby make the following findings and determinations regarding the Site Development
Review:
A. The proposal is consistent with the purposes of Chapter 8.104, with the General
Plan and with any applicable Specific Plans and design guidelines in that 1) the
proposed tower element is well designed in relation to surrounding properties and

incorporates architectural metal panels on the feature that are consistent with the rest of
the building.
B. The proposal is consistent with the provisions of Title 8, Zoning Ordinance in that.
1) the proposed tower element is consistent with the purposes of Chapter 8.104 (Site
Development Review) as described above; and 2) the Project complies with Chapter 8.36
(Development Regulations) and does not exceed the maximum building height
allowance.
C. The design of the project is appropriate to the City, the vicinity, surrounding
properties and the lot in which the project is proposed in that the proposed tower
element is consistent with the rest of building and the Project continues the incorporation
of colors and details on all sides/elevations of the building providing an attractive
environment to the public.
D. The subject site is physically suitable for the type and intensity of the approved
development in that the proposed tower element does not include additional building
square footage or increase the development intensity of the site.
E. Impacts to existing slopes and topographic features are addressed in that the
proposed tower element will be located on a fully developed site that is relatively flat and
will not alter the existing grade or topography.
F. Architectural considerations including the character, scale and quality of the
design, site layout, the architectural relationship with the site and other buildings,
screening of unsightly uses, lighting, building materials and colors and similar
elements result in a project that is harmonious with its surroundings and
compatible with other development in the vicinity in that the proposed tower element
is consistent with the rest of building and the Project continues the incorporation of colors
and details on all sides/elevations of the building providing an attractive environment to
the public and the Project's architectural elements will provide an interesting variation to
other development in the vicinity.
G. Landscape considerations, including the location, type, size, color, texture and
coverage of plant materials, and similar elements have been incorporated into the
project to ensure visual relief, adequate screening and an attractive environment
for the public in that while no additional landscaping is proposed with the project, the
proposed tower element will aid in the screening of rooftop equipment from vehicles
travelling on 1-580.
H. The site has been adequately designed to ensure proper circulation for bicyclists,
pedestrians and automobiles in that the proposed tower element does not contain any
modifications to the site that may impact circulation.
BE IT FURTHER RESOLVED that the Planning Commission does hereby approve Site
Development Review modifications to the new retail building to allow a new tower element at
7099 Amador Plaza Road as shown on the Project Plans date-stamped "Received by Dublin
Planning on December 10, 2010" and included as Exhibit A, subject to the following conditions:

CONDITIONS OF APPROVAL
Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance
of building permits or establishment of use, and shall be subject to Planning Division review and
approval. The following codes represent those departments/agencies responsible for
monitoring compliance of the conditions of approval: [PL] Planning; [B] Building; [PO] Police;
[PW] Public Works; [ADM] Administration/City Attorney; [FIN] Finance; [PCS] Parks and
Community Services; [F] Dublin Fire Prevention; [DSR] Dublin San Ramon Services District;
[LDD] Livermore Dublin Disposal; [CO] Alameda County Department of Environmental Health;
[Zone 7] Alameda County Flood Control and Water Conservation District, Zone 7; [LAVTA]
Livermore Amador Valley Transit Authority; and [CHS] California Department of Health
Services.

Prior to:
GENERAL
1. Approval. The following Conditions of Approval PL On-going Planning
apply to PLPA-2010-00062, modification to the
Site Development Review approval for a retail
building at 7099 Amador Plaza Road (the
"Project") as originally approved by the
Community Development Director on January 7,
2011. The changes from the original SDR
approval include the addition of a tower element
to the west and north facing elevations, as
illustrated in Sheets A6, A7, and A8 (the Project
Plan set).
This approval for PLPA-2010-00062 shall
generally conform to Sheets A6, A7, and A8 (the
Project Plan set) prepared and submitted by
Architectural Network, Inc. dated received by the
Dublin Planning Division on December 10, 2010
stamped approved and on file in the Community
Development Department, Planning Division and
other plans, text, and diagrams relating to this
approval, unless modified by the Conditions of
Approval contained herein.
Except as modified by this approval, all other
sheets of the Project Plan set approved by the
Community Development Director on January 7,
2011 shall remain in effect, and the Conditions of
Approval approved by the Community
Development Director on January 7, 2011 shall
remain in effect. This SDR approval is for the
addition of the tower element and the concept of
the freeway-oriented si na a only.
2. Permit Expiration. Construction or use shall PL Two years from DMC
commence within two (2) years of the Site Permit Approval 8.96.020.D
Development Review approval or the permit(s)
shall lapse and become null and void.
Commencement of construction or use means the
actual construction or use pursuant to the permit

approval or demonstrating substantial progress
toward commencing such construction or use.
3. Time Extension. The original approving decision- PL Two years from DMC
maker may grant a time extension of permit Permit Approval 8.96.020.E
approval for a period not to exceed six (6) months
provided that: 1) the Applicant submits a written
request for an extension prior to expiration of the
permit approval; and 2) a determination can be
made that all Conditions of Approval remain
adequate to assure that the applicable findings of
approval will continue to be met. All time
extension requests shall be noticed and a public
hearing or public meeting shall be held as
required b the articular permit.
4. Revocation. The Site Development Review PL On-going DMC
approval shall be revocable for cause in 8.96.020.1
accordance with Section 8.96.020.1, Revocation
of the Dublin Zoning Ordinance. Any violation of
the terms and conditions of this approval may be
subject to the issuance of a citation.
PLANNING - SITE DEVELOPMENT REVIEW
5. Permit Validity. The Site Development Review PL On-going DMC
approval shall be valid for the remaining life of the 8.96.020.F
approved structure so long as the operators of the
subject property comply with the project's
Conditions of A royal.
6. Exterior Building Colors. All exterior colors and PL Occupancy Planning
finishes shall be consistent with the approved
Project Plans and the color and materials boards.
7. Occupancy Permits. Final inspection and final PL, B Occupancy Planning &
occupancy permits will not be granted until all Building
construction and landscaping is complete in
accordance with approved plans and the
conditions required by the City. During inclement
weather, bonding for landscaping may be
permitted.
8. Signs. No signage is approved as part of this PL Installation of Planning
Site Development Review approval. The signage signage
shown on the Project Plan Set is conceptual only.
All signs shall be reviewed and approved
separately by the Zoning Administrator through a
Zoning Clearance and/or Master Sign Program as
necessary.
