EXECUTIVE SUMMARY:
Citation Homes Central and Eden Housing Inc. are in the process of acquiring the former Arroyo
Vista Housing site property from the Dublin Housing Authority and filing the Final Map for Tract
7943. The proposed Ar.royo Vista residential development will be a community of 378 residential
units comprised of 198 market rate and 180 affordable units. Filing the Final Map for Tract 7943
will allow both parties to acquire their separate parcels from the Dublin Housing Authority.
FINANCIAL IMPACT:
Park Land dedication requirements are proposed to be satisfied by the payment of fees in lieu of
dedicating park land. Park Land In-Lieu Fees in the amount of $257,509.50 are being collected
for the Eden Housing project in conjunction with the filing of the Map. This amount reflects the use
of credits for the existing units. Payment of Park Land In-Lieu Fees by the market rate developer
will be completed at the time of subsequent map approval by the City Council. The Developers
will construct certain public streets and improvements and will pajr the cost of construction
inspection. The City requires that Performance and Labor & Materials bonds are posted to
guarantee construction of the street, grading, utility improvements and landscaping.

Once these improvements are accepted, the~City will incur maintenance costs for City-maintained
improvements within Tract 7943. Maintenance cost information will be provided to the City Council
at the time of improvement acceptance. The Homeowners' Association will be responsible for
maintaining certain project-related landscape features and sidewalk within the public right-of-way.

Staff recommends that the City Council: (1) Adopt the Resolution Approving Final Map and Tract
Improvement Agreement for Tract 7943, Arroyo Vista; (2) Adopt the Resolution Approving the
Agreement for Long Term Encroachment for Landscape Features with Tract 7943, Arroyo Vista;
and (3) Adopt the Resolution Accepting Parkland Dedication In-Lieu Fees for Parkland Dedication
Requirements for Eden Portion of Tract 7943, Arroyo Vista.

DESCRIPTION:
The Final Map for Tract 7943 (Attachment 1) will create bulk parcels, some of which are intended
to ultimately be subdivided to create a community of 378 residential units. The total project will be
comprised of 198 market rate and 180 affordable units.
The market rate "for sale" component of the Project will include a total of 198 for-sale dwelling
units, including 141 attached town homes and 57 detached dwellings. Up to 14 of the for-sale units
will. be affordable dwellings. This portion of the Project will be acquired from Dublin Housing
Authority by Citation Homes Central (hereafter "Citation Homes").
The apartment component of the Project will include a total of 180 units and it will be developed by
the project co-sponsor Eden Housing Inc. The Eden portion of the project contains two elements:
1) 130 affordable family apartment units, with 129 income restricted units (one unit will be
designated as a live-in manager unit), and 2) a 50 unit Senior Housing component.
The Final Map for Tract 7943 dedicates the rights-of-way for Mariposa Circle, North Mariposa
Lane, South Mariposa Lane, North Mariposa Court, South Mariposa Court, Monterey Way,
Ventura Way, public service easement, storm drain easement, sidewalk easement, and
emergency vehicle access easement. The Final Tract Map 7943 creates two bulk parcels for
Citation Homes. This will require that the Developer process a subsequent map to create the
individual town home and detached residential lots. The parcels to be acquired by Eden Housing
Inc. will not require a further subdivision based on their intent to construct apartment type
residential units which does not require further subdivision of the bulk parcel.
The Final Map for Tract 7943 has been reviewed and found to be in conformance with the
Tentative Map and Conditions of Approval adopted by Planning Commission Resolution No. 09-
15 on April 28, 2009. The Developer has submitted an executed Tract Improvement Agreement,
together with the required Performance and Labor & Material Bonds.
The Agreement for Long Term Encroachment for Landscape Features for Tract 7943 provides for
the Homeowners' Association to maintain project-related landscape features within the public
rights-of-way, including planter strips, sidewalks, and street trees.

Staff has prepared a resolution approving the Finai Map and Tract Improvement Agreement for
Tract 7943, Arroyo Vista (Attachment 2), a resolution Approving Agreement for Long Term
Encroachment for Landscape Features with Tract 7943, Arroyo Vista (Attachment 3) and a
Resolution Accepting Parkland Dedication In-Lieu Fees for Parkland Dedication Requirements for
Eden Portion of Tract 7943, Arroyo Vista (Attachment 4).
Parkland Dedication Requirements
Pursuant to Dublin Municipal Code Chapter 9.28, a subdivider is required to dedicate parkland or
pay a fee in lieu of dedicating such land. As discussed above, there will be additional subdivision
of the Citation Homes portion of the project, at which time fees in lieu of park dedication will be
required. Therefore, only the parkland dedication requirements for the Eden Housing project need
to be addressed at this time.
Eden Housing Inc. and Citation Homes have requested that the City allocate the credit for the
existing 150 units at Arroyo Vista entirely to the Eden Housing Project. The location of the project
is outside the boundaries of the Neighborhood Parkland Fee established in the Public Facility Fee.
Therefore the contribution for Neighborhood Parkland is calculated according to a formula
specified in Chapter 9.28 of the Dublin Municipal Code which takes into account the market value
of the property and the number of units. Community Parkland Fees are paid based on the
schedule in the Public Facilities Fees.
Staff has calculated the amount due from Eden Housing Inc., to satisfy the Parkland requirements
for Tract 7943 as follows:

In accordance with City of Dublin Municipal Code Chapter 9.28, the payment towards Community
Park Land is the Community Park Land component of the Public Facility Fee. Staff has prepared
a Resolution recognizing the parkland in-lieu fees for Eden Housing Inc. (Attachment 4). Citation
Homes will need to satisfy a similar requirement when the Final Map is filed creating individual
residential lots.. However, pursuant to agreements between Citation Homes and Eden Housing,
the market rate project will pay fees without any credits applied as all available credits were
applied to the Eden Project.

iVOTICING REQUIREMENTS/PUBLIC OUTREACH:
Public noticing occurred as part of the Tentative Map process. Approval of the Final Map is
affirmation of the Final Map's concurrence with the approved Tentative Map. Copies of this report
have been provided to Citation Homes Central and Eden Housing, Inc.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

APPROVING FINAL MAP AND TRACT IMPROVEMENT AGREEMENT
FOR TRACT 7943, ARROYO VISTA
WHEREAS, the Final Map for Tract 7943, in the incorporated territory of the City of Dublin,
State of California, has been presented to this City Council for approval, all in accordance with provisions
of the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and
WHEREAS, the Developer, Citation Homes Central and Eden Housing Inc., has executed and
filed with the City of Dublin a Tract Improvement Agreement for Tract 7943 to improve required
subdivision improvements in accordance with the Conditions of Approval for the Tentative Map, and with
the improvement plans attached thereto; and
WHEREAS, said Tract Improvement Agreement is secured by bonds furnished by the Bond
Vintage Insurance Inc. in the amount of $ 3,866,600 for the in-tract improvements (Bond No. 50012),
conditioned upon faithful performance of said Agreement; and
WHEREAS, said Tract Improvement Agreement is secured by bonds furnished by the Bond
Vintage Insurance Inc. in the amount of $ 3,866,600 for the in-tract improvements (Bond No. 50012),
conditioned upon payment for labor performed or material furnished under the terms of said Agreement;
NOW, THEREFORE, BE IT RESOLVED that said agreement and bonds are hereby approved.
BE.IT FURTHER RESOLVED that the City Manager of the City of Dublin is hereby autharized
to.execute said Tract Improvement Agreement, attached hereto as Exhibit "A."
BE IT FURTHER RESOLVED that the Final Map of Tract 7943 be and the same is hereby
approved, and that rights to the areas marked as Mariposa Circle, North Mariposa Lane, South Maziposa
Lane, North Mariposa Court, South Mariposa Court, Monterey Way, Ventura Way, and Public Service
Easement~(PSE), Storm Drain Easement (SDE), Sidewalk Easement (SE), and Emergency Vehicle Access
Easement (EVAE) offered for dedication to public use in conformity with the terms of dedication be, and
they are hereby accepted, subject to improvement, and that the Clerk of this City Council is hereby
directed to transmit said Map to the County Recorder for filing.

APPROVING AGREEMENT FOR LONG TERM ENCROACHMENT
FOR LANDSCAPE FEATURES WITH TRACT 7943,
ARROYO VISTA
WHEREAS, a Vesting Tentative Map for Tract 7943 for Arroyo Vista was approved by Planning
Commission Resolution 09-15 on Apri128, 2009, with Conditions of Approval; and
WHEREAS, said Conditions of Approval required the developer to construct project=related landscape
features within the public rights-of-ways; and
WHEREAS, said Conditions of Approval required the developer to enter into an "Agreement for '
Long-Term Encroachment" for the maintenance of the landscape features; and
WHEREAS, the developer has executed and filed with the City of Dublin a Tract Improvement
Agreement to improve required Tract improvements, including said landscape features; and
WHEREAS, the developer has executed and filed with the City of Dublin an Agreement for Long
Term Encroachment for Landscape Features with Tract 7943, Arroyo Vista, attached hereto as Exhibit "A";
NOW, THEREFORE, BE IT RESOLVED that said Agreement is hereby approved.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized by the City Council to
execute the Agreement.
BE IT FURTHER ItESOLVED that the Clerk of this City Council is hereby directed to transmit said
Agreement to the County Recorder for filing.

ACCEPTING PARK LAND DEDICATION IN-LIEU FEES
FOR PARK LAND DEDICATION REQUIREMENTS FOR
EDEN PORTION OF TRACT 7943, ARROYO VISTA
WHEREAS, pursuant to City of Dublin Municipal Code Chapter 9.28, each subdivider
of land for residential uses shall, as a Condition of Approval of a Final Subdivision Map,
dedicate or reserve lands, pay fees in lieu thereof, or a combination of both, for park and/or
recreational purposes; and
WHEREAS, the Developer, Eden Housing, Inc., is filing Tract 7943 Map for developing
a community of 180 residential apartment units; and
WHEREAS, as Apartment Units the housing can be developed on large master lots
not requiring any further tract map to create individual residential lots; and
WHEREAS, the In-Lieu of Parkland dedication fee requirements for the project based
on the requirements of the Municipal Code, have been calculated for the Eden Housing
component of Tract 7943, including allocating a credit for the existing 150 housing units on
the existing Arroyo Vista site; and ~'
WHEREAS, Eden Housing will pay a Neighborhood Parkland Fees (Quimby Fees)
based upon the calculated market value of the property and the formula outlined in Chapter
9.28 of the Dublin Municipal Code, and will pay Community Parkland fees as determined in
the Public Facility Fee Schedule;
NOW, THEREFORE, BE IT RESOLVED that the aforesaid payment of $80,959.50
Neighborhood Parkland (Quimby Fees) and $176,550.00 for Community Parkland Fees as
provided for in the Public Facility Fee Schedule, which is net of credits for existing units, shall
be deemed to complete performance of said subdivider's obligation under Subdivision
Requirements in Chapter 9.28 of the Dublin Municipal Code, for the Eden Housing portion of

BE IT FURTHER RESOLVED_ that the Quimby Fees collected shall be used for the
development of park and recreational facilities within a period of five years from the dafe of
adoption of this resolution to serve the residents of the subject tract.
