HomeMy WebLinkAboutReso 07-11 Arroyo Vista Land Ded in-Lieu FeesRESOLUTION NO. 7 - 11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ********* ACCEPTING PARK LAND DEDICATION IN-LIEU FEES FOR PARK LAND DEDICATION REQUIREMENTS FOR EDEN PORTION OF TRACT 7943, ARROYO VISTA WHEREAS, pursuant to City of Dublin Municipal Code Chapter 9.28, each subdivider of land for residential uses shall, as a Condition of Approval of a Final Subdivision Map, dedicate or reserve lands, pay fees in lieu thereof, or a combination of both, for park and/or recreational purposes; and WHEREAS, the Developer, Eden Housing, Inc., is filing Tract 7943 Map for developing a community of 180 residential apartment units; and WHEREAS, as Apartment Units the housing can be developed on large master lots not requiring any further tract map to create individual residential lots; and WHEREAS, the In-Lieu of Parkland dedication fee requirements for the project based on the requirements of the Municipat Code, have been calculated for the Eden Housing component of Tract 7943, including allocating a credit for existing housing units that will be replaced by the project; and WHEREAS, Eden Housing will pay a Neighborhood Parkland Fees (Quimby Fees) based upon the calculated market value of the property and the formula outlined in Chapter 9.28 of the Dublin Municipal Code, and will pay Community Parkland fees as determined in the Public Facility Fee Schedule. NOW, THEREFORE, BE IT RESOLVED that the aforesaid payment of $315,742.05 Neighborhood Parkland (Quimby Fees) and $688,545.00 for Community Parkland Fees as provided for in the Public Facility Fee Schedule, shall be deemed to complete performance of said subdivider's obligation under Subdivision Requirements in Chapter 9.28 of the Dublin Municipal Code, for the Eden Housing portion of the Tract 7943. BE IT FURTHER RESOLVED that the Quimby Fees collected shall be used for the development of park and recreational facilities within a period of five years from the date of adoption of this resolution to serve the residents of the subject tract.
