FINANCI-AL STATEMENT: Office of Traffic Safety grant funding will be used for the
:.purchase of this equipment.
DESCRIPTION: The State of California, Office of Traffic Safety has awarded the City of
Dublin a. grant in the amoUnt of $35,000, to administer a "Traffic Safety Radar Enforcement and
Bicycle Safety Program". $28,930 of the grant funding is allocated for the purchase of radar
equipment, which includ~~ ~Ve (5) radar units and one ('1)speed radar trailer.
Staff has researched available radar equipment and has determineR that equipment manufactured
and supplied by Kustom Signal, Inc. best meets the City's needs. Ku~tOm Signal,'"Inc. has
advised that it is the sOle source of this specialized equipment. The steel construction and
weather resistance 6f' the products is of superior quality when comPared to that of their
competitors. The radar trailer features a unique computer unit that provides a comprehensive
data compilation system not offered by other manufacturers. The small, lightweight, ergonomic
design and custom "heads-up" displaY Of the radar units alloW for easier use by Officers. Kustom
Signal, Inc: is also the sole provider of an "environmental mode" that enables the radar unit to
track Vehicle speeds through glass. Additionally, they .are the' only company that offers free
expert testimony regarding their products if such information is required in court. Kustom
Signal, Inc. has provided a quote in the amount of $28,464 for the purchase of the needed
equipment.

The_ .City's Psrchasing Ordinance requires that major purchases (over $20,000) be subject to a
competitive bid process. However, the City Council is authorized to waive this requirement
under certain conditions. Dublin Municipal Code §2.36.050(A)(2), Exceptions to Competitive
Bidding Requirements, states that the bidding process may be waived "where the city's
requirements can be met solely by a single patented article or process." As Kustom Signal, Inc.
is the sole source for this equipment, Staff is requesting that the City Council waive the
competitive bid process.
RECOMMENDATION:
Staff recommends that the City Council adopt the 'Resolution, Attachment 1, waiving the
competitive bid process and authorize Staff to purchase the' equipment directly from the vendor.
Purchase of the necessary equipment to implement the "Traffic Safety Radar Enforcement and
Bicycle Safety Program" will 'assist staff in meeting the City CoUncil's high priority' ~oal of
reducing vehicular accidents by 10% at major intersections in the City.

OF THE CITY OF DUBLIN
WAIVING THE COMPETITIVE BID PROCESS AND AUTHORIZING STAFF TO
PURCHASE RADAR EQUIPMENT DIRECTLY FROM
K'USTOM SIGNALS, INC.
WHEREAS, the Dublin Municipal Code provides that exceptions to the competitive bid
process may be approved by the City Council subject to certain conditions; and
WHEREAS, Dublin' Municipal Code §2.36.050(g/) provides that the competitive bid
process shall not apply (2) where the city's requirements can be met solely by a single patented
article or,process; and ~-
WHEREAS, waivers of the competitive bid process are q, alid only upon approval by a
four-fifth (4/5) vote of the City Council; and
WHEREAS, it has been determined that Kustom Signals, Inc. is the sole source of the
needed radar equipment. . ~
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin
does specifically waive the competitive bid process pursuant to Dublin Municipal Code
§2.36.050(a)(11) and authorizes staff to purchase radar equipment directly from the sole source,
Kustom Signals, Inc.
