A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN

APPROVING PA 92-085 Q-ZAR LASER TAG CONDITIONAL USE PERMIT TO OPERATE A
COMMERCIAL RECREATIONAL FACILITY AT 6543 REGIONAL STREET
WHEREAS, John Richardson, representing Reality World Entertainment
Corporation, has filed an application for a Conditional Use Permit to
operate a commercial recreational use (Q-ZAR Laser Tag) in an existing
6,700± square foot tenant space located at 6543 Regional Street; and
WHEREAS, the Planning Commission did hold a public hearing on said
application on January 4, 1993; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA} and a
Negative Declaration has been prepared for this project as it will not
have a significant effect on the environment; and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
A. The proposed use will serve the public need by providing an
activity which contributes to the diversity of recreational
facilities available to the community.
B. The proposed use will be properly related to other land uses
and transportation and service facilities in the vicinity, as
the proposed use will be compatible to the type and nature of
operations typically found in the neighborhood.
C. The proposed use, under all circumstances and conditions of
this particular case, will not materially adversely affect the
health or safety of persons residing or working in the
vicinity, or be materially detrimental to the public welfare or
injurious to property or improvements in the neighborhood, as
all applicable regulations will be met.
D. The proposed use will not be contrary to the specific intent
clauses or performance standards established for the district
in which it is to be located in that conditions have been
applied to insure conformance with the Zoning Ordinance.
E. The project is consistent with the policies contained in the
City's General Plan and Downtown Specific Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve PA 92-085 Q-ZAR Laser Tag Conditional Use
Permit shown by materials labeled Exhibit "A" on file with the Dublin
Planning Department, subject to the following conditions.
CONDITIONS OF APPROVAL:
Unless stated otherwise, all Conditions of Approval shall be complied
with prior to the issuance of building permits or establishment o~ use
and shall be subject to Planning Department review and approval. The
following codes represent those departments/agencies responsible for
monitoring compliance of the conditions of approval. [PL] Planning, [
Building, [PO] Police, [PW] Public Works, [ADM] Administration/City
Attorney, [FIN] Finance, [F] Dougherty Regional Fire Authority, [DSR]
Dublin San Ramon Services District, (CO] Alameda County Department of
Environmental Health.
1. PA 92-085 is approved for a commercial recreational use (Q-ZAR Laser
Tag), located at 6543 Regional Street, as generally depicted on the
plans labeled Exhibit A, consisting of two (2) sheets, dated
received December 16, 1992, stamped approved. [PL]
2. Hours of operation for the use shall be as follows:
Monday - Thursday, 11:00 a.m. to 12:00 a.m.
Friday, 11:00 a.m. to 1:00 a.m.
Saturday, 9:00 a.m. to 1:00 a.m.
Sunday, 9:00 a.m. to 10:00 p.m.
Restrictions on admission include:
- No one under 18 admitted during school hours, unless
accompanied by a parent or guardian or proof of graduation;
- No one under 13 admitted after 10:00 p.m. on weeknights and
11:00 p.m. on Fridays, Saturdays and Holidays, unless
accompanied by a parent or guardian;
- No one under 10 admitted unless accompanied by a parent or
guardian.
At the end of six months from the establishment of use, the
Applicant may submit a written request to the Dublin Police Services
Department and Planning Director to extend the operating hours on
Friday and Saturday evenings to 2:00 a.m.
The Planning and Police Services Departments will evaluate the past
performance of the use, and determine whether the extension request
should be denied, approved as submitted or approved with
modifications. [PL, PO]
3. Approval of this use is limited to a maximum of 30 participants
within the primary game area (Arena) at one time. [PL]

4. The Applicant shall control activity so as not to create a public or
private nuisance to the existing or surrounding businesses. Should
the Planning or Police Services Departments determine that an
excessive amount of patrons waiting to utilize the facility are
queueing in the parking lot of adjacent properties, the Applicant
shall establish a "reservation only" process for admitting patrons.

5. The Applicant shall work with the Dublin Police Services Department
to establish and maintain an effective security program, including,
but not limited to, improved lighting in the parking lot. A minimum
of one (1) security guard, licensed by the State Department of
Consumer Affairs, shall be present on-site during all hours of
operation.
An additional security guard, licensed by the State Department of
Consumer Affairs, shall be present on-site during peak hours of
operation (Friday and Saturday - 7:00 p.m. to 1:00 a.m.).
At the end of six months from the establishment of use, the
Applicant may submit a written request to the Dublin Police Services
Department and Planning Director to revise the security program.
The Planning and Police Services Departments will evaluate the past
performance of the use, and determine whether the revision request
should be denied, approved as submitted or approved with
modifications. [PL, PO]
6. Approval of a modification to the hours of operation or the security
program, shall not prohibit the Dublin Police Services Department
from requesting future modifications (reducing the hours of
operation or increasing on-site security) should problems arise.

7. The Applicant should be aware that when the new Dublin Boulevard
Parallel Road is constructed, the existing access from Regional
Street will be closed and ingress and egress to the site will be
achieved from the new roadway. [PW]
8. The Applicant shall install and maintain secure bicycle racks to
accommodate a minimum of 10 bicycles. The design and location of
the bicycle racks shall be subject to Planning Director and Dublin
Police Services review and approval. [PO, PL]
9. In case of a power failure, emergency lighting shall be supplied to
illuminate any obstacles to provide safe and easy egress to the exit
doors. [B, F]
10. Exit signs must be visible from all locations. Additional exit
directional signs may be required. [B, F]
11. All areas which are raised (platforms, stages, seating areas, etc.)
and are over four feet in the least dimension must have fire
sprinklers underneath. [B, F]

12. Additional portable fire extinguishers are required, the number and
location of which will be determined by the Fire Marshall, at a
later date. [B, F]
13. Any cooking procedures in the concession area which produces grease
vapors will require a fire extinguishing system. [B, F)
14. The Applicant shall obtain the necessary permits from the Alameda
County Health Services Department to prepare and serve food on-site.

15. A minimum of fifty-six (56) parking spaces shall be maintained on-
site at all times. (PL]
16. No loudspeakers or amplified music shall be permitted to project or
be placed outside of the building. All activities associated with
this use shall be conducted entirely within the building. [PL, PO]
17. The Applicant shall be responsible for clean up and disposal of
project related trash to maintain a clean and litter-free site.

18. Signs utilized for this building shall conform with the provisions
of the Sign Ordinance. [PL]
19. On at least an annual basis, this Conditional Use Permit shall be
subject to Zoning Investigator review and determination as to
compliance with the conditions of approval. [PL]
20. This approval shall be null and void in the event the approved use
ceases to operate for a continuous one year period. [PL]
21. This permit shall be revocable for cause in accordance with Section
8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms
or conditions of this use permit shall be subject to citation. [PL]
