HomeMy WebLinkAboutPC Reso 93-11 PA93-005 Tag's Towing CUPRESOLUTION NO. 93-011 ~ A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN ---------------------------------------------------------------------- APPROVING PA 93-005 TAG'S TOWING CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A STORAGE FACILITY AND YARD FOR ABANDONED, WRECKED AND INOPERATIVE VEHICLES AND FOR THE PARKING OF TOW TRUCKS AND OTHER VEHICLE STORAGE USES SUCH AS LONG TERM RECREATIONAL VEHICLE STORAGE LOCATED AT 6005 "A" SCARLETT COURT WHEREAS, Reinie Tagliapietra, Applicant and Owner of Tag's Tawing, filed a Conditional Use Permit request to allow the operation of a storage facility and yard for abandoned, wrecked and inoperative vehicles and for the parking of tow trucks and other vehicle storage uses such as long term recreational vehicle storage; and WHEREAS, the Planning Commission held a public hearing on said application on April 5, 1993; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and was found to be Categorically Exempt under Section 15301, Class 1 of the State CEQA Guidelines; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: A. The proposed project will serve a public need by providing a storage facility and yard for abandoned, wrecked and inoperative vehicles and long term recreational vehicle storage in the City of Dublin. B. The use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible to the type and nature of operations typically found in the neighborhood. C. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. D. The use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located. E. The approval of the Conditional Use Permit is consistent with the Dublin General Plan. BE IT FURTHER RESOLvED THAT THE Dublin Planniri Commission does hereby conditionally approve PA 93-005 Tag's TowingJConditional Use Permit as generally depicted on the site plan and building floor plan, labeled Exhibit A, stamped approved and on file with the Dublin Planning Department, subject to the following conditions and restrictions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitorinq_ compliance of the conditions of approval. [PLC Planning, (B Building, [POD Police, (PW~ Public Works, (ADM Administration/City Attorney, [FINS Finance, F~ Dougherty Regional Fire Authority, [DSR] Dublin San Ramon Services District, (CO] Alameda County Department of Environmental Health. 1. This approval for PA 93-005 is to allow the operation of a storage facility and yard for abandoned, wrecked and inoperative vehicles and for the parking of tow trucks and other vehicle storage uses such as long term recreational vehicle storage within the existing Dublin Security Storage facility located at 6005 "A" Scarlett Court. This approval shall generally conform to the site plan and building floor plan, labeled Exhibit A, dated January 26, 1993, stamped approved and on file with the Dublin Planning Department. [PL] 2. The outside storage of vehicles and equipment as specified by Condition #1, shall be limited to the separate and enclosed Tag's Towing storage yard area. The applicant shall store all wrecked and totaled vehicles within the warehouse building at all times. [PL] 3. No more than twenty (20) abandoned and/or inoperative vehicles shall be stored or maintained within the exterior storage area. The exterior storage area for the abandoned and/or inoperative vehicles shall be limited to the location as shown on the site plan labeled Exhibit A. [PL] 4. The Applicant shall install a chain link fence with redwood slats to screen and separate the abandoned and/or inoperative vehicle storage area from the long term parking and storage area. [PL] 5. The outdoor parking of recreational vehicles or other long term vehicle or equipment storage shall occur within the designated parking area as shown on the site plan labeled Exhibit A. [PL] 6. Any additional outdoor storage of vehicles or other equipment requested by the applicant or property owner shall be considered by the Planning Commission through the Conditional Use Permit process. [PL] 7. The Applicant shall not conduct any major automotive or equipment repair; including washing and detailing activities on site. The minor repair and maintenance of the Applicant's tow trucks is permitted. [PL] - 2 - 8. The dismantling of vehicles or the removal of any parts from vehicles shall not be permitted. The storage of dismantled parts or equipment shall not be maintained on the site at any time. [PL] 9. The Applicant shall submit an outdoor storage parking lot striping plan subject to review and approval by the Planning Director. Standard size 9 foot by 20 foot parking spaces shall be provided and shall be single striped (4-inch stripe) between each space. A minimum 20 foot unobstructed fire and access lane shall be maintained on a continous basis throughout the vehicle storage area to allow adequate emergency vehicle access. [PL] 10. The Applicant shall provide appropriate pavement markings and/or signage designating the parking spaces and areas. [PL] 11. The Applicant shall comply with all applicable Planning Department. Building Inspection Department, Dougherty Regional Fire Authority and Dublin Police Services regulations and ordinances. [PL, B, F, PO] 12. The Applicant shall provide written documentation to the Planning Department that the requirements of the various departments and agencies specified by Condition #11, have been met. [PL] 13. The Applicant shall obtain approval and environmental clearance from the Alameda County Department of Environmental Health, Hazardous Materials Division regarding storage and disposal of oil and fluids removed from the abandoned, wrecked and inoperative vehicles. The Applicant must provide written documentation to the Planning Department that this condition has been met. [PL, CO, F] 14. The Applicant shall not park or store any vehicles or equipment or block the 15 foot Zone 7, Alameda County Flood Control District access easement along the northeast portion of the site. The easement shall be unobstructed at all times. [PL, CO] 15. The Applicant shall comply with all applicable Alameda County Department of Environmental Health, Hazardous Materials Division and Zone 7, Alameda Flood Control District regulations and provisions. [PL, CO] 16. The Applicant shall provide on-site informational signage identifying the vehicle storage yard and operation, including a contact name and telephone number for use in case of an emergency. [PL, PO, F, CO] 17. All signage for the site shall be subject to the requirements of the Sign Regulations within the Zoning Ordinance. [PL] 18. Any changes in the operation or use of the ancillary vehicle storage yard use shall be subject to the Planning Director's review and determination as to whether the use is still compatible and ancillary to the Dublin Security Storage facility or whether other planning approvals are required. [PL] 19. No modifications to the site shall occur without prior review and written approval of the Planning Director and all modifications - 3 - ._ ._. shall comply with atl applicable Zoning, Buil~_.~g Code and Public Works regulations including issuance of building permits if required. [PL, B, PW] 20. The Applicant shall maintain the vehicle storage yard in a clean, and well kept manner at all times. [PL] 21. The Applicant and/or Property Owner shall maintain and enhance all existing landscaped areas on the site. [PL] 22. The Applicant shall control activity so as to not create a public or private nuisance to the existing or surrounding businesses. [PL, PO, F] 23. No loudspeakers or amplified music shall be permitted outside the warehouse building. All activities, except for the outdoor storage of vehicles and equipment, shall be conducted entirely within the warehouse building. [PL] 24. This Conditional Use Permit approval shall be subject to Zoning Investigator review and determination as to compliance with the Conditions of Approval. [PL] 25. This use permit shall be valid for one year, until April 15, 1994. At the end of one year, the Zoning Investigator will review the use for any zoning complaints or violations and will determine if all conditions of approval have been complied with on a continuous basis. If the conditions of approval are continually being met and there have been no valid zoning complaints or zoning violations, the Zoning Investigator may extend the use permit indefinitely. [PL] 26. This approval shall become null and void in the event the approved use ceases to operate for a continuous one year period. [PL] 27. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to citation.
