OF THE CITY OF DUBLIN

APPROVING PA 93-008 CONDITIONAL USE PERMIT REQUEST TO ALLOW 7,"HE
OPERATION OF A RECYCLE REDEMPTION CENTER IN THE PAK'N SAVE SHOPPING
CENTER PARKING LOT, LOCATED AT 6605 DUBLIN BOULEVARD
WHEREAS, Robert Warner, on behalf of 20/20 Recycle Center,
requests approval of a Conditional Use Permit to allow the operation
of a recycle redemption center for aluminum, plastic and glass
beverage containers in the Pak'n Save shopping center parking lot
located at 6605 Dublin Boulevard; and
WHEREAS, the Planning Commission did hold a public hearing on
said application on April 5, 1993; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act {CEQA) and was
found to be Categorically Exempt under Section 15303, Class 3 of the
State CEQA Guidelines; and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning
Commission does hereby find that:
A. The proposed project will serve a public need by providing a
recycle/redemption center for the Dublin community.
B. The proposed use will be properly related to other land uses and
transportation and service facilities in the vicinity, as the
proposed use will be compatible when compared to the type and
nature of operations typically found in the neighborhood.
C. The proposed use, under all circumstances and conditions of this
particular case, will not materially adversely affect the health
or safety of persons residing or working in the vicinity, or be
materially detrimental to the public welfare or injurious to
property or improvements in the neighborhood, as all applicable
regulations will be met.
D. The proposed use will not be contrary to the specific intent
clauses or performance standards established for the District in
which it is to be located.
E. The approval of the Conditional Use Permit will be consistent
with the Dublin General Plan.

BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve PA 93-008 Conditional Use Permit
application as generally depicted on the plans labeled Exhibit A,
stamped approved and on file with the Dublin Planning Department,
subject to the following conditions:

1. This Conditional Use Permit approval for PA 93-008 is to allow
the operation of a recycle redemption center for aluminum,
plastic and glass beverage containers in the Pak'n Save shopping
center parking lot, located at 6605 Dublin Boulevard. This
approval shall generally conform to the plans labeled Exhibit A,
stamped approved and on file with the Dublin Planning Department,
and as modified by the following conditions of approval,
consisting of a Site Plan, Elevations and Photograph (3 sheets)
dated received by the Planning Department February 19, 1993.

2. 20/20 Recycle Center shall utilize a maximum number of six
parking spaces. The utilization of additional parking spaces
shall be subject to the review and approval of the Planning
Director. [PL]
3. The Applicant and/or Property Owner shall post signage along the
drive aisle indicating "No Double Parking" and "No Blocking Drive
Aisle". Specific location and wording of the signage shall be
subject to the Planning Director review and approval prior to
installation. Each sign shall not exceed 8 square feet of sign
area in compliance with Section 8-87.50E) of the Zoning
Ordinance. [PL]
4. The Applicant shall have a current annual Recycling Facility
Permit and Recycling Transporter Permit for the site as required
by the Dublin Municipal Code Section 5-32. [ADM]
5. The Applicant shall submit evidence to the Planning Director that
appropriate state and local licenses, permits or certificates
(including City Business License) have been obtained. [PL, ADM,

6. All recyclable materials shall be stored inside the approved
trailer and igloo containers. [PL]

7. All containers shall be clearly marked to identify the type of
material to be deposited and a notice shall be displayed stating
that no material shall be left outside the recycling containers.

8. The Applicant shall take all necessary precautions to ensure that
the facility's litter and materials are controlled and the units
are maintained in an attractive and functionally operative
manner. (PL]
9. The Applicant and/or Property Owner shall be responsible for
ensuring that the premises surrounding the recycling facility is
maintained free of litter, recyclable and nonrecyclable materials
and other debris. [PL]
10. The Applicant shall control activity so as not to create a
nuisance to the existing businesses or shoppers. [PL, PO]
11. On-site directional and identification signs shall not exceed
eight {8) square feet and shall not contain advertising messages.
These signs shall be subject to Planning Director review and
approval. [PL]
12. A minimum of one, 40 gallon all-weather trash receptacle shall be
provided in each collection area. [PL]
13. The trailer shall have a notice identifying the name and
telephone number of the facility operator and the hours of
operation, including a 24 hour emergency telephone number. [PL,
PO]
14. The Applicant and/or Property Owner shall post, in a convenient
and visible location at the Pak'n Save store entrances and exits,
the location of the recycling facility. [PL]
15. The Applicant shall bring the site into conformance with the
project conditions of approval within thirty (30) days from the
effective date of this approval. [PL, ADM]
16. No modifications or relocation of the recycling center shall
occur without prior review and written approval of the Planning
Director. The Applicant shall comply with all applicable zoning,
building code and Public Works regulations, including issuance of
building permits if required. [PL, B, PW]
17. On an annual basis, this Conditional Use Permit approval shall be
subject to Zoning Investigator review and determination as to the
compliance with the conditions of approval. [PL]
18. This approval shall become null and void in the event the
approved use ceases to operate for a continuous one-year period.

19. This permit shall be revocable for cause in accordance with.
Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of

the terms or conditions of this permit shall be subject to
citation. [PL]

Above is a photograph of a standard 20/20 Recycle Center proposed to be
located in the parking lot. When the trailer is full, it is replaced with an
empty trailer that is steam cleaned prior to placement in the field. The igloos
are constructed of fiberglass material which is cleaned daily by the 20/20
attendant. The color is bonded into the fiberglass which makes it relatively
easy to remove any graffiti. 'fhe igloos and the trailer ar secured at night with
heavy duty locks to prevent any theft. The trailer is also fitted with aking-pin
locking device to minimize complete trailer theft.
