A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN

APPROVING PA 93-011 CELEBRITY'S COFFEE COMPANY OUTDOOR SEATING/LIVE
ENTERTAINMENT CONDITIONAL USE PERMIT AT 669-Z AMADOR PLAZA ROAD
WHEREAS, Mr. Jerry Newton, representing Celebrity's Coffee Company,
has filed an application for a Conditional Use Permit to amend the PD,
Planned Development, General Provisions to allow the establishment of an
outdoor seating area and indoor live entertainment, as conditionally
permitted uses within the PD District. The Applicant owns and operates
the existing Celebrity's Coffee Company restaurant located within the
Enea Plaza Shopping Center at 6694-Z Amador Plaza Road; and
WHEREAS, the Planning Commission did hold a public hearing on said
application on May 25, 1993; and
WHEREAS, proper notice of said public hearing was given in all
respects as required by law; and
WHEREAS, the application has been reviewed in accordance with the
provisions of the California Environmental Quality Act (CEQA) and was
found to be Categorically Exempt under Section 15301, Class 1(a); and
WHEREAS, the Staff Report was submitted recommending that the
application be conditionally approved; and
WHEREAS, the Planning Commission did hear and consider all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission
does hereby find that:
A. The proposed use will serve the public need by providing an
outdoor seating/eating area and indoor live entertainment which
contributes to the diversity of activities available to the
community.
B. The proposed use will be properly related to other land uses
and transportation and service facilities in the vicinity, as
the proposed use will be compatible to the type and nature of
operations typically found in the neighborhood.
C. The proposed use, under all circumstances and conditions of
this particular case, will not materially adversely affect the
health or safety of persons residing or working in the
vicinity, or be materially detrimental to the public welfare or
injurious to property or improvements in the neighborhood, as
all applicable regulations will be met.
D. The proposed use will not be contrary to the specific intent
clauses or performance standards established for the district
in which it is to be located in that conditions have been
applied to insure conformance with the Zoning Ordinance.

E. The project is consistent with the policies contained in the
City's General Plan and Downtown Specific Plan.
BE IT FURTHER RESOLVED THAT THE Dublin Planning Commission does
hereby conditionally approve PA 93-011 Celebrity's Coffee Company
Conditional Use Permit shown by materials labeled Exhibit "A" on file
with the Dublin Planning Department, subject to the following conditions.
CONDITIONS OF APPROVAL:
Unless stated otherwise all Conditions of Approval shall be complied
with prior to the issuance of building permits or establishment of use,
and shall be subject to Plannina Department review and approval. The
following codes represent those departments/agencies responsible for
monitoring compliance of the conditions of approval. fPLI Plannina, fBl
Building, [PO] Police LPW] Public Works, [ADM1 Administration/City
Attorney, fFINI Finance fFl Dougherty Regional Fire Authority, [DSR]
Dublin San Ramon Services District [CO] Alameda County Department of
Environmental Health.
1. PA 93-011 is approved to amend the PD, Planned Development, General
Provisions to permit the addition of an outdoor seating area and
indoor live entertainment to the existing Celebrity's Coffee Company
restaurant located at 6694-Z Amador Plaza Road, as generally
depicted on the plans consisting of two (2) sheets, dated received
March 10, 1993, (Exhibit A) stamped approved. [PL]
2. Except as specifically modified herein, development within the Enea
Plaza Shopping Center Phase II, shall generally conform to the
Planned Development General Provisions established by City Council
Resolution No. 30-88 for PA 87-178 (see Attachment B-1). [PL]
3. The outdoor seating area is limited to a maximum of 12 tables and a
maximum of 48 seats. If these tables are not bolted to the ground,
or otherwise secured, then the tables shall either be brought inside
or stored in a secured enclosure, during non-business hours. [PO,

4. The placement of the tables shall not obstruct the free movement of
pedestrians utilizing the sidewalk within the shopping center. [PL]
5. Operation of the outdoor seating area and the live entertainment
shall be conducted so as not to create a nuisance to adjacent
businesses. [PL, POJ
6. No loudspeakers or amplified music shall be permitted to project or
be placed outside of the building. All activities associated with
the live entertainment use shall be conducted entirely within the
building. [PL, PO]
7. A minimum of three trash containers shall be installed within the
outdoor seating area. The Applicant shall be responsible for clean
up and disposal of project related trash to maintain a clean and
litter-free site. [PL]

8. Signs utilized for this building shall conform with the sign program
established for the Enea Plaza Shopping Center. [PL]
9. On at least an annual basis, this Conditional Use Permit shall be
subject to Zoning Investigator review and determination as to
compliance with the conditions of approval. [PL]
10. This approval shall be null and void in the event the approved use
ceases to operate for a continuous one year period. [PL]
11. This permit shall be revocable for cause in accordance with Section
8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms
or conditions of this use permit shall be subject to citation. [PL]
