HomeMy WebLinkAboutPC Reso 93-19 PA93-017 Allsafe Storage CUP RESOLUTION NO. 93 - 019 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 93-017 ALLSAFE SELF STORAGE CONDITIONAL USE PERMIT TO ALLOW A MINOR A~ENDMENT TO THE PLANNED DEVELOPMENT GENERAL PROVISIONS TO ALLOW DEVELOPMENT PROPOSALS ON THE TWO NEWLY CREATED PARCELS TO BE REVIEWED IN CONFORMANCE WITH THE C-2, GENERAL COMMERCIAL DISTRICT DEVELOPMENT STANDARDS INSTEAD OF THE M-l, LIGHT INDUSTRIAL DISTRICT DEVELOPMENT STANDARDS, FOR THE PROPERTIES LOCATED AT 5959 AND 5971 DOUGHERTY ROAD WHEREAS, Ed Boersma, on behalf of Allsafe Self Storage, and John Moore, on behalf of BJ Dublin Commercial, have made application to the City of Dublin for 1) Approval of Tentative Parcel Map 6571 to divide an existing ~11.3 acre vacant parcel into two separate lots (Parcel A - 4.2 acres and Parcel B - 7.1 acres); 2) Site Development Review request to allow the construction of four single-story self- storage buildings totaling 99,920 square feet divided into 894 storage units and a 2,100 square foot manager's office and residence on Parcel A; 3) Conditional Use Permit approval to allow a minor amendment to the Planned Development General Provisions to allow development proposals on the two newly created parcels to be reviewed in conformance with the C-2, General Commercial District development standards instead of the M-i, Light Industrial District development standards; 4) Variance request to allow a reduction in the required number of parking spaces provided on-site and to allow a substandard effective lot frontage for Lot A; 5) Imposition of a Traffic Impact Fee for the property located at 5959 and 5971 Dougherty Road; and WHEREAS, the Planning Commission held a public hearing on said application on May 25, 1993; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, the application has been reviewed in accordance with the provisions of the California Environmental Quality Act (CEQA) and a Mitigated Negative Declaration has been adopted (Planning Commission Resolution No. 93-017). This project, as mitigated, will not have a significant effect on the environment; and WHEREAS, the Staff Report was submitted recommending that the application be conditionally approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony hereinabove set forth. NOW, THEREFORE, BE IT RESOLVED THAT THE Dublin Planning Commission does hereby find that: ae The proposed project will serve a public need by providing for the efficient utilization of property in Dublin. Be The proposed use will be properly related to other land uses and transportation and service facilities in the vicinity, as the proposed use will be compatible when compared to the type and nature of operations typically found in the neighborhood. The use, under all circumstances and conditions of this particular case, will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met. The use will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located. Ee The approval of this Conditional Use Permit will be consistent with the Dublin General Plan. BE IT FUR?~ER RESOLVED T~AT T~E Dublin Planning Commission does hereby conditionally approve PA 93-017 Allsafe Self Storage Conditional Use Permit as shown on Exhibit A, stamped approved and on file with the Dublin Planning Department, subject to the approval of the related Tentative Map/Site Development Review/Variance and to the following conditions: CONDITIONS OF APPROVAL: Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of building permits or establishment Of use, and shall be subject to Planning Department review and approval. The following codes represent those departments/agencies responsible for monitoring compliance of the conditions of approval. [PL] Planning, lB] Building, [PO] Police, [PW] Public Works, [ADM] Administration/City Attorney, [FIN] Finance, IF] Dougherty Regional Fire Authority, [DSR] Dublin San Ramon Services District, [CO] Alameda County Flood Control & Water Conservation District (Zone 7). PA 93-017 Allsafe Self Storage Conditional Use Permit approval is to allow a minor amendment to the Planned Development General Provisions to allow development proposals on the two newly created parcels to be reviewed in conformance with the C-2, General Commercial District development standards instead of the M-i, Light Industrial District development standards. This approval shall generally conform to the plans prepared by Cubix Construction Company, consisting of 7 sheets and the Tentative Parcel Map, prepared by Wilsey and Ham, consisting of 1 sheet, all dated received by the Planning Department on March 22, 1993, labeled Exhibit A, stamped approved and on file. [PL] Except as specifically modified herein, development of the two properties shall generally conform to the Planned Development General Provisions established by Alameda County Planning Commission Resolution No. 79-67 for the 1411th Zoning Unit (see Attachment D-i). [PL] - 2 - Ail lots shall observe a minimum lot size of 20,000 square feet. [PL] Prior to subsequent development approvals on Parcel B, the Property Owner shall submit an application for General Plan Amendment in order to initiate a land use designation change from Business Park/Industrial: Outdoor Storage to Retail/Office and Automotive. [PL] Prior to subsequent development approvals on Parcel B, the Property Owner shall submit an application for PD Rezone with a specific Development Plan which must include, at a minimum, the following provisions: internal circulation, joint parking, Emergency Vehicle Access, cross access easements, a comprehensive architectural and building design program, joint landscaping and maintenance, a joint sign program, and conditions, covenants and restrictions (CC&R's) to ensure the quality of design and operation.. [PL] The Applicant shall comply with all applicable Planning, Building, Dougherty Regional Fire Authority, Police Department and Alameda County Water & Flood Control District regulations and ordinances. [PL, B, F, PO, CO] The Applicant/Property Owner shall be responsible for clean-up and disposal of project related trash to maintain a clean, litter-free site. [PL] No loudspeakers or amplified music shall be permitted outside the enclosed buildings. All activities associated with the use shall be conducted entirely within the enclosed buildings. [PL] On an annual basis, this Conditional Use Permit approval shall be subject to Zoning Investigator review and determination as to the compliance with the Conditions of Approval. [PL] 10. This approval shall become null and void in the event the approved use ceases to operate for a continuous one-year period. [PL] 11. This permit shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. Any violation of the terms or conditions of this permit shall be subject to citation.
