HomeMy WebLinkAboutPC Minutes 05-16-1983 . s ~ ~ ~ Regular Meeting - May 16, 1983 A regular meeting of the City of Dublin Planning Commission was held on Monday, May 16, 1983, in the Meeting Room, Dublin Library. The meeting was called to order at 7:30 p.m. by Cm. Tenery, Chairman. * * * * ROLL CALL PRESENT: Commissioners Alexander, Mack, Vonheeder, Tenery and Laurence L. Tong, Planning Director. ABSENT: Cm. Woy * * * * PLEDGE OF ALLEGIANCE Cm. Tenery led the Commission, Staff and those present in the , pledge of allegiance to the flag. * * * * MINUTES OF PREVIOUS MEETING The minutes of the regular meeting of May 2, 1983, were approved, with the correction of the name Gary Frazier to Gary Fritsch. * * * * , r ~ ~ • ~ ORAL COMMUNICATION None * * * * WRITTEN COMMUNICATION l. Minutes from City Council Regular Meeting of April 11, 1983. 2. Appealable Action Letter, dated May 2, 1983, to Amador Lanes. 3. Appealable Action Letter, dated May 3, 1983, to Motor Lodge Associates. * * * * UNFINISHED BUSINESS Mr. Tong clarified the subject matter contained in Assembly Bills 647 and 696, as requested by the Commission at the last meeting. Cm. Tenery asked if the letter to Beth DeRoos, pertaining to the sign committee, had been sent as requested. Mr. Tong indicated that the letter had been sent. Cm. Vonheeder questioned the status of the Diamond Sign Conditional Use Permit controversy. Staff has received no correspondence from Diamond Signs, and the removal and revocation process has begun. Cm. Tenery inquired as to whether the City Council has commented regarding items 1, 2, 6, and 8, which were contained in City Attorney Nave's response to questions raised by the Commission, pertaining to the Brown Act. Mr. Tong indicated that no response had been received as yet from the City Council. Cm. Tenery also questioned the status of the request from the Commission to the City Council regarding changing the name of San Ramon Road to Foothill Road. Mr. Tong stated that the request is being processed. NEW BUSINESS PA 83-012 KARNS, DAYCARE CONDITIONAL USE PERMIT Mr. Tong presented the Staff report concerning the application, by Mr. & Mrs. Robert Karns, for a Conditional Use Permit to allow a daycare facility in a Single Family Residential district (specifically, 6851 Langmuir Lane.) Staff recommended approval of the permit subject to conditions. - i ! Mr. Karns spoke in behalf of himself and his wife, answering several questions posed by the Commissioners, and indicating that the Karns' would comply in all aspects of the conditions of approval. However, since the daycare facility would not be licensed to enroll handicapped students, he felt it unnecessary to construct the restroom facility to accommodate handicapped ' individuals. Cm. Alexander questioned whether a bond would be posted insuring that the garage would be restored to its original usefulness, should the daycare center cease to exist. Mr. Tong clarified to the Commission, and to the Karns', that a$500 bond was required to be submitted, as a condition of approval, to assure that the garage would be restored. After the discussion, Cm. Vonheeder motioned, with Cm. Alexander's second, that the Commission adopt the Resolution approving PA 83- 012, Conditional Use Permit Application from Robert & Margaret Karns to allow the operation of a daycare center in a single family residential district, subject to the addition of the following conditions: ~ R e ardin Conditi on 4 referrin to the 0 g g , 50 bond to assure g $ restoration of the garage: ..the garage space [must be] made accessible to at least two (2) cars, if Condition 7 is adopted; Condition 7: If the applicant's State license does not allow handicapped children, then a restroom facility, modified to accommodate the handicapped, as required by the State and Alameda County Building Department, may be omitted. The motion was carried by unanimous vote of the Commissioners present (Cm. Woy, absent.) Cm. Alexander proposed that, in the future, all public hearings be closed by motion, after all evidence has been received. After a brief discussion, the Commissioners agreed that, henceforth, all public hearings conducted by the Planning Commission would be closed by motion. * * * * PLEASANTON PLANNING COMMISSION JOINT MEETING In response to the Planning Commission's suggestion, the Pleasanton Planning Commission proposed holding the joint meeting on June lst, or July 6th, with June lst being the Pleasanton Planning Commission's first choice. The Dublin Planning Commission agreed that June lst was also best for them to meet at the Pleasanton Council chambers. Staff will convey the decision of the Commission to the Pleasanton Planning Staff. _ i ~ SAN RAMON ROAD SPECIFIC PLAN DISCUSSION Mr. Tong noted that on April 25, 1983, the City Council reviewed the San Ramon Road Traffic Study and schematic improvements. The City Council determined that a Specific Plan should be prepared for all parcels adjacent to, and west of, San Ramon Road, between Dublin Blvd. and Silvergate Drive. An Interim Zoning Ordinance was adopted by the City Council which regulates development in that area, and is effective for 45 days, unless extended by the City Council. Staff gathered background information and materials for the Planning Commissioner's review and discussion, which will assist in future Specific Plan discussion. It was clarified that at the June 20th Planning Commission meeting, more specific and detailed information would be available regarding the draft Specific Plan proposals. It is at that meeting that the Specific Plan is tentatively scheduled to be heard by the Planning Commission. * * * * OTHER BUSINESS Cm. Tenery requested that Staff review all correspondence addressed to the Commissioners, which is not marked "Personal", in order to assure that all time-dated material be forwarded to the Commissioners immediately. * * * * ADJOURNMENT There being no further business, the meeting was adjourned at 9:15 p.m. Respectfully submitted, Q~I~' ' ~ /,r'~ Laurence L .
