_ Regular Meeting - December 19, 1983
A regular meeting of the City of Dublin Planning Commission was
held on Monday, December 19, 1983, in the Meeting Room, Dublin
Library. The meeting was called to order at 7:30 p.m. by Cm.
Tenery, Chairman.

Tenery, Thomas DeLuca, Associate Planner, and Laurence L. Tong,
Planning Director.

MINUTES OF PREVIOUS MEETING
The minutes of the regular meeting of December 5, 1983, were
approved, with the correction of Ms. Schmitt's address, to
Cypress Court.

PUBLIC HEARING
PA 83-059 BUSICK PROPERTIES
CONDITIONAL USE PERMIT
This planning application had been continued from the
November 21, 1983, Planning Commission meeting, by request of the
applicant. On December 15, 1983, Staff received another request
to continue the hearing until the next Commission meeting.
Staff recommended that the hearing be continued to the Tuesday,
January 3, 1984, Planning Commission meeting (Monday, January 2,
1984, is a legal holiday). It was suggested that, since Staff
has had some difficulty in obtaining the applicant's compliance
with certain conditions, the Commission specify that additional
continuances would not be granted.
All Commissioners agreed to Staff's recommendation, and the
public hearing on PA 83-059 Busick Properties Conditional Use
Permit was continued until January 3, 1984.

NEW BUSINESS
PA 83-090 HOLLAND BRASS SALES
ADMINISTRATIVE CONDITIONAL USE PERMIT
The Zoning Administrator reviewed the application for an
Administrative Conditional Use Permit to allow the one-time
outdoor sale of brass novelty items, at 7249 Village Parkway
(AM/PM Minimart). He explained that the current zoning (C-N -
Neighborhood Commercial) allows the sale of inerchandise within an
enclosed building, only.
A brief history was given, of events leading to the referral of
this item to the Planning Commission. It was pointed out that
past determinations have not allowed peddler activities of this
nature. A policy direction was requested at this time.

Mr. Holland, applicant, and a Dublin resident, was present and
stated that his merchandise is not in direct competition with any
items currently available in the City. He mentioned that, as a
resident of Dublin, he reported all earnings from sales from his
Dublin address, thereby contributing to the City's tax base.
A discussion ensued regarding the desirability of street vendors
within the City limits. Mr. Tong pointed out that Mr. Holland
does possess a valid peddler's permit issued by Alameda County.
It was noted that local businesses have opposed other outdoor
activities, and the Chamber of Commerce has also formally
complained in the past.
Cm. Vonheeder addressed the Planning Commission briefly regarding
the sales tax base issue.
Cm. Alexander questioned Mr. Holland as to whether or not
receipts were issued with each sale. h7r. Holland stated that
receipts were available, but not normally given with each sale.
It was generally agreed among the Commissioners that a sales
receipt should accompany all sales, should the permit be
approved, and Mr. Holland said he would comply if required to do
so.
After closing the public hearing, Cm. Alexander recommended
approval of the Administrative Conditional Use Permit to allow
Mr. Holland to sell his merchandise for one day. The motion was
seconded by Cm. Petty and was passed by roll-call vote, as
follows:

REVIEW OF CITY COUNCIL DIRECTION
REGARDING GENERAL PLAN ALTERNATIVE SKETCH PLANS
Staff described revisions, by the City Council, of the Planning
Commission's recommendations regarding the General Plan
Alternative Sketch Plans.
Cm. Tenery noted that there appeared to be limited area for
mixed/medium density residential units.

Cm. Vonheeder wished to go on record that she felt the City
Council short-sighted with regard to the lack of park space on
the west side of the City.

REVIEW OF AMENDMENTS TO SUBDIVISION ORDINANCE
Mr. Tong explained that the City Council amended the Subdivision
Ordinance, with respect to park dedication fees, to require that
the City of Dublin will now receive park dedication land or fees,
instead of DSRSD. He briefly described the effect this amendment
will have on the City, as well as the methods of determining
population by the Revenue and Taxation Code.
Cm. Mack requested a cross-referenced display of the old and
revised sections of the of the ordinance, and Staff agreed to
provide this information at the next meeting.

REVIEW OF SECOND UNIT REGULATIONS (SB 1534)
AND "GRANNY FLAT" REGULATIONS (SB 1160)
Mr. DeLuca presented a brief history of available information
regarding the two Senate Bills dealing with second unit housing.
He noted that SB 1160 authorizes the City to grant a variance for
second units in an R-1 District, with age restrictions and a size
limitation of 640 sq.ft. He explained that, under this bill,
applicants must go through the Conditional Use Permit application
process, and enforcement of the age restriction would be
difficult.
SB 1534 does not address age restrictions, and requires a City to
adopt a second unit ordinance, or opt to preclude second units.
It was Staff's recommendation that the public hearing regarding
this issue be rescheduled to the January 16, 1984, meeting to
consider a draft ordinance implementing SB 1534. Staff also
agreed to provide examples of other cities' second unit
ordinances at that meeting.

OTHER BUSINESS
Mr. Tong took a few moments to recap the year's activities of the
Planning Commission and to thank the Commissioners, on behalf of
Staff, for their support. Cm. Petty, in turn, thanked Staff.

Mr. Tong noted that the 1984 Planning Commissioners' Institute
would take place from February 29, 1984, to March 2, 1984, in San
Diego. More information would be forthcoming regarding this
event.
Cms. Tenery and Vonheeder requested name badges and business
cards for the Planning Commissioners.
