The meeting was called to order at 7:30 p.m. by Cm. Alexander, Chairman. * * * * ROLL CALL PRESENT: Commissioners Alexander, Barnes, Petty, Mack, and Raley, and Laurence L. Tong, Planning Director. * * * * PLEDGE OF ALLEGI~NCE Cm. Alexander led the Commission, Staff, and those present in the pledge of allegiance to the flag. * * * * MINUTES OF PREVIOUS MEETING The minutes of the regular meeting of April l, 1985, were approved as written. * * * * ORAL COMMUNICATION None * * * * WRITTEN COMMUNICATION Letter from E. Greg Kent regarding PA 85-020 the Tom Huening Project. * * * * PUBLIC HEARING 7.1 PA 85-021 Rafanelli & Nahas/Ponderosa Homes Minor Subdivision application to subdivide 135+ acres into four parcels at the northwest and southwest corners of Amador Valley Boulevard and Dougherty Road. Mr. Tong presented the Staff report. Mr. Nahas was requesting approval to subdivide 135+ acres into four parcels. No formal development proposal had been complete. Staff had expressed reservations whether a subdivision application filed without a Regular Meeting PCM-5-038 4/15/85 ~ • • concurrent submittal of a Master Planned Development Rezoning application would compromise the City's ability to assure compliance with applicable General Plan policies. The City's Environmental Assessment of any project subsequently submitted covering a portion of the subject property would be difficult to assess if the property was allowed to subdivide and then developed on a piece-meal basis. Specifically, it would be difficult to assess potential impacts related to ground water, sedimentation, flooding, etc., transportation, air pollution, biotic impacts, impacts to municipal services, and similar categories where the cumulative impact of the entire project would need to be assessed to develop appropriate mitigation measures. Mr. Tong said that Staff was concerned that the premature subdivision of the Site could compromise General Plan policies, especially those related to Neighborhood Diversity and Residential Compatibility. Staff recommended approval with three items to assure compliance with the General Plan: 1) Prior to development, the 130+ acre area north of Amador Va11ey Boulevard be rezoned to a Planned Development District. 2) Require detailed review and approval of the park site and design prior to recording the Parcel Map. 3) Require a deed to the park site prior to recording the Parcel Map. Cm. Alexander opened the public hearing. Mr. Nahas stated that they could concur with the park site and park designer. The Deed would be given to the City. The PD Rezoning is a concern with them. Mr. Nahas gave a brief explanation of the project. He was concerned that requiring a Planned Development prior to development might put a cloud on the title. It would need concurrence of two property owners and one might veto the other. Cm. Raley asked if it needed to be rezoned anything other than single family. Staff said the General Plan required a Planned Development Rezoning. Cm. Petty asked when does the Site Development Review come into the picture. Staff said the Site Development Review would occur either after the PD Rezoning or concurrently with the PD Rezoning. Mr. Nahas stated that the creek located on the property, was the natural divider for the property lines. Regular Meeting PCM-5-039 4/15/85 ' ~ ~ He also stated that all hydraulias were completed. Traffic analysis has been given out, and the PD process is well underway. The City would receive a Deed for the Park. Mr. Nahas also stated that all the decisions were in the hands of the City, whether they acted upon the PD or not. The completed PD application shall be on file prior to recordation of the Parcel Map. Mark Rafanelli, wanted a point of clarification. Will the park site and design need City Council, Planning Commission or Staff approval? Mr. Tong stated that the area and design of the park must go through the Parks and Recreation Commission, Planning Commission, and the City Council. Cm. Ralev confirmed that Parcel #4 was to be deeded to the City. Martin Locust stated he was concerned about the large site being divided into smaller parcels and losing the opportunity to prepare an overall development plan. He did not feel that Ponderosa Homes and Rafanelli and Nahas would work together if they each had separate parcels. Mr. Nahas said that the property should be looked at as a whole. He said that the best consultants in the business were hired to work on this project. They did not feel they were exposing the City to a poor plan. They did not want the timing to lose the opportunity. Mr. Rafanelli said they will shortly submit a complete application. Mr. Nahas confirmed Cm. Raley's statement that, as part of an option, the parcel map needed to be approved by April 25, 19$5. He would then have 90 days to close the transaction by telling the seller they were willing to buy the property. Mr. Gunther, representing Ponderosa Homes, stated that it was a simple subdivision. He assured the Commission that they were in total agreement with Rafanelli & Nahas and the City Staff. Mr. Locust asked if the Parcel Map is approved, can it be reparcelled again. Staff said that while there was some potential, the Subdivision Map Act wc~uld control. Cm. Alexander closed the public hearing. Cm. Petty said both Parcels #2 and #3 should be developed as a single Planned Development. Regular Meeting PCM-5-0?~D 4/1S/85 ~ • . Voice vote found all in favor of adopting: RESOLUTION N0. 85-015 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN ADOPTING A NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE CONCERNING PA 85-021, RAFANELLI & NAHAS/PONDEROSA HOMES The Planning Commission took a 10 minute recess. Following the recess, the Planning Commission discussed the application. Cm. Mack motioned, seconded by Cm. Barnes, to approve the application as Staff recommended. The motion failed, 2-3, Cm. Alexander, Cm. Raley and Cm. Barnes voted no. Cm. Raley suggested modifying the conditions to require a complete Planned Development Rezoning application be filed prior to recording the Parcel Map. If the PD Rezoning application is denied, then individual PDs may be processed, but they must be consistent and compatible with the General Plan. On Motion of Cm. Raley, secanded by Cm. Mack, and by unanimous vote, the Commission agreed to amend Condition #18 to add "if found necessary by the City" and to revise Condition #22 to read; 22. "Prior to recording the final Parcel Map, a complete Planned Development Rezoning application for the entire 130+ acre site north of Amador Valley Boulevard (Parcels 2, 3 and 4) shall be submitted to the City. If the Planned Development REzoning application is ultimately denied, then individual Planned Development Rezoning applications may be submitted for Parcel 2 and Parcel 3. The Planned Development Rezoning application or applications shall be consistent with the Dublin General Plan, (in particular with Section 2.1.2 Neighborhood Diversity and Section 2.1.3 Residential Compatibility." Voice vote found all in favor of adopting as amended: RESOLUTION NO. 85-016 ~ A RESOLUTION OF THE PLANNING CO1~~IISSION OF TIiE CITY OF DUBLIN APPROVING TENTATIVE PARCEL MAF 4575 CONCERNING PA 85-021 RAFANELLI & NAHAS/PONDEROSA HOMES * * * * 7.2 PA 85-020, a request by Tom Huening for a Planned Development Rezoning and Site Development Review at 6767 Dublin Boulevard Regular Meeting PCM-5-041 4/15/85 . ~ ~ Mr. Tong presented the Staff Report. Mr. Huening was requesting a PD rezonin~ and Site Development Review to construct a 4,485 sq. ft, building on the abandoned DSRSD well site on the north side of Dublin Boulevard, south of Sierra Court. The existing commercial site had surplus parking which would provide the required parking for the building. An access and easement would need to be recorded so that a potential future owner of the building would have adequate access and garking. Mr. Huening informed Staff that he was keeping the parcels separate at that tirne. The main concern of Staff related to the design of the west elevation. The elevation would be the most visible to the public and yet was the back side of the building. Staff suggested that the building be setback 5' from the property line and landscaping be installed to soften the appearance of the wall. Staff felt that the proposed project would result in a substantial improvemeht to the site and eliminate an eyesore in this area on Dublin Boulevard. Cm. Alexander opened the public hearing. Cm. Raley was concerned over the letter received from Mr. Kent regarding potential parking problems. The Planning Comission discussed a provision for new tenants to submit a floor plan and parking plan for Zoning Approval prior to operation. Mr. Huening explained the parking situation to the Commission. Mr. Huening stated that, with minor exception regarding street trees, he was in agreement with Staff. He also stated that Burns European Motors would keep the internal walkways clear. Cm. Alexander closed the public hearing. On motion of Cm. Petty, seconded by Cm. Raley, voice vote found all in favor of adopting: RESOLUTION NO. 85-017 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN RECOMMENDING THAT A NEGATIVE DECLARATION BE ADOPTED FOR PA 85-020, A REQUEST BY TOM HUENING FOR A PD AND SITE DEVELOPMENT REVIEW ON THE ABANDONED DSRSD PROPERTY ON THE NORTH SIDE OF DUBLIN BOULEVARD SOUTH OF SIERRA COURT On motion of Cm. Mack, seconded by Cm. Raley, voice vote found all in favor of adopting: Regular Meeting PCM-5-042 4/15/85 • ~ RESOLUTION NO. 85-018 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN RECOMMENDING AND ESTABLISHMENT OF FINDINGS AND GENERAL PROVISIONS FOR A PLANNED DEVELOPMENT REZONING CONCERNING PA 85-020, TOM HUENING COMMERCIAL DEVELOPMENT On motion of Cm. Raley, seconded by Cm. Barnes, and by unanimous vote, the Commission agreed to add to Condition #16, "either and or the new site, if deemed feasible by Staff" and to add a Condition #22 "Prior to occupancy each new tenant sha11 submit a floor plan (with gross and net area) and parking plan and shall obtain Zoning Approval from the Dublin Planning Department." and adopted: RESOLUTION NO. 85-019 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN RECOMMENDING THE APPROVAL OF A SITE DEVELOPMENT REVIEW FOR PA 85-020, TOM HUENING'S REQUEST TO CONSTRUCT A 4,485 SQ. FT. BUILDING ON THE ABANDONED DSRSD PROPERTY ON THE NORTH SIDE OF DUBLIN BOULEVARD, SOUTH OF SIERRA COURT * * * * * OLD BUSINESS None * * * * NEW BUSINESS 8.1 Status Report on Previous Conditional Use Permits. This item was briefly discussed at this meeting. With the exception of PA 84-046 Payless Conditional Use Permit, the Planning Commission continued this item until the May 6, 1985 Planning Commission Meeting. The Planning Commission requested Staff to proceed with Zoning Enforcement Action on the Payless Conditional Use Permit. 8.2 Draft Memo re: Property Maintenance Staff presented a brief report on the existing property maintenance ordinance and a draft memo. The Planning Commission discussed the pros and cons of the draft memo. On motion of Cm. Mack, seconded by Cm. Barnes, and by a 3 to 2 vote (Cm. Raley and Cm. Petty opposed), the Planning Commission directed Staff to send a property maintenance memo to the City Council for consideration.
