Regular Meeting - November 19, 1984
A regular meeting of the City of Dublin Planning Commission was
held on November 19, 1984, in the Meeting Room, Dublin Library.
The meeting was called to order at 7:30 p.m. by Cm. Alexander,
Chairman.

ROLL CALL
PRESENT: Commissioners Alexander, Barnes, Petty, Mack, and
Raley, Laurence L. Tong, Planning Director, Kevin J. Gailey,
Senior Planner, and Thomas P. DeLuca, Associate Planner.

PLEDGE OF ALLEGIANCE I
Cm. Alexander led the Commission, Staff, and those present in the
pledge of allegiance to the flag.

MINUTES OF PREVIOUS MEETING
The minutes of the regular meeting of November 5, 1984, were
approved as written.

ORAL COMMUNICATION
At this time Mr. Tong introduced Kevin J. Gailey, the new Senior
Planner.

WRITTEN COMMUNICATION
Mr. Tong noted a letter which had been submitted to the Planning
Commission in opposition to the Growing Tree Daycare application.

PUBLIC HEARING
SUBJECT: PA 84-065, St. Philip Lutheran Church, Conditional Use
Permit extension to allow the continued operation of a
preschool for 24 children at 8850 Davona Drive

Mr. DeLuca presented the Staff Report, which was a request by St.
Philip Lutheran Church for an extension to a Conditional Use
Permit to allow the continued operation of a preschool for 24
children at 8850 Davona Drive.
Mr. DeLuca noted that Staff did not have any problems with this
application, since the City has not received any complaints
regarding excessive noise or traffic from the existing preschool
or the elementary school recently approved by the City.
Chairman Alexander opened the public hearing.
No one spoke for or against the application.
It was moved by Commissioner Raley and seconded by Commissioner
Barnes to close the public hearing.
Commissioner Raley asked Staff what authority the City had in
regulating daycare centers.
Mr. Tong responded that the City had limited control and it was
the State who did the licensing and regulation.

It was moved by Commissioner Raley and seconded by Commissioner
Petty to approve PA 84-065 St. Philip Lutheran Church Conditional
Use Permit.
Voice vote found all in favor.
RESOLUTION NO. 84-53
APPROVING ST. PHILIP LUTHERAN CHURCH CONDITIONAL USE PERMIT
REQUESTING FOR AN EXTENSION OF A CONDITIONAL USE PERMIT TO ALLOW
THE OPERATION OF A NURSERY SCHOOL FOR
24 CHILDREN AT 8850 DAVONA DRIVE
SUBJECT: PA 84-061 Growing Tree Preschool application for a
Conditional Use Permit to establish a daycare center at
the Fallon School Site, 7425 Larkdale Avenue, Dublin,
California
Mr. DeLuca presented the Staff Report which was a request by
Growing Tree Preschool for a Conditional Use Permit to operate a
daycare center in Wing Ca of the Fallon School Site for
approximately 120 children ranging in age from 8 weeks through 10
years of age.
Mr. DeLuca went over the previous applications which have been
approved for this site and the Staff position that there is a
tremendous need for daycare facilities in the City of Dublin.

Mr. DeLuca also outlined a letter submitted by one of the
neighbors in opposition to the Growing Tree Preschool
application.
Chairman Alexander opened the public hearing.
Commissioner Raley asked the applicant whether a registered nurse
would be on site. The applicants indicated that a nurse would
not be on the site. Commissioner Barnes indicated that a
registered nurse was only at the high school on a limited basis.
No one spoke in opposition.
It was moved by Commissioner Mack and seconded by Commissioner
Barnes to approve PA 84-061 Growing Tree Daycare Conditional Use
Permit.
Voice vote found all in favor.
RESOLUTION NO. 84-54
APPROVING PA 84-061 GROWING TREE PRESCHOOL APPLICATION
FOR A CONDITIONAL USE PERMIT TO ESTABLISH A
DAYCARE CENTER AT THE FALLON SCHOOL SITE,
7425 LARKDALE AVENUE, DUBLIN, CALIFORNIA
SUBJECT: PA 84-068 Burns European Motors, a request for a
Conditional Use Permit and Site Development Review to
sell reconditioned automobiles at 6787 Dublin Boulevard
Mr. DeLuca presented the Staff Report which was a request by Gary
Burns for a Conditional Use Permit and Site Development Review to
sell reconditioned automobiles at 6787 Dublin Boulevard.
Staff recommended the application be approved with the
requirement that 8 parking stalls in front of the applicant's
store receive special surface treatment to distinguish it from
the general parking area.
Chairman Alexander and Commissioner Raley asked Staff how this
application would be similar to the Kawasaki application.
Mr. Tong and Mr. DeLuca indicated that the application is
similar, however there is a great deal of difference in the site
configuration, landscaping and site characteristics. It was
noted by Staff, that the Kawasaki application was denied not
because of the motorcycles, but because there was not sufficient
room on the site to display motorcycles.
Chairman Alexander opened the public hearing.
Mr. Burns addressed the Planning Commission and stated that it
was his desire to relocate to this project because it was an
approved location.

Tom Huening property owner addressed the Planning Commission and
stated that he was opposed to the special surface treatment
required by Staff, and with the limited time period for the
Conditional Use Permit.
It was moved by Commissioner Raley and seconded by Commissioner
Barnes to close the public hearing.
It was moved by Commissioner Raley and seconded by Commissioner
Mack to approve PA 84-068 Burns European Motors Conditional Use
Permit with the following changes to the resolution:
#8: Adequate security lighting shall be provided to the
satisfaction of the Planning Director
#9: This approval is valid until November 19, 1989 and shall be
revocable for a cause in accordance with Section 8-90.3 of
the Dublin Zoning Ordinance
RESOLUTION NO. 84-52
APPROVING PA 84-068 GARY BURNS CONDITIONAL USE PERMIT AND SITE
DEVELOPMENT REVIEW APPLICATION TO ALLOW THE SALE OF RECONDITIONED
AUTOMOBILES AT 6797 DUBLIN BOULEVARD
SUBJECT: PA 84-049 Imperial Freeholds California lncorporated
application for a Parcel Map Extension
Mr. DeLuca presented the Staff Report which was a request by
Imperial Freeholds California lncorporated for an extension to
Parcel Map 3582.
Mr. DeLuca noted that the principle issue associated with this
extension relates to the intersection location at Dublin
Boulevard. Staff prefers to have the entrance relocated so that
it is across from Sierra Court, as opposed to its present
location just east of Alamo Canal. In this manner, only one
intersection would be needed and would avoid the necessity of
having two intersections in close proximity along a major
thoroughfare. The only way to relocate the entrance would be to
acquire the necessary property from the Dublin/San Ramon
Services District. In exchange for this property, the developers
could give Dublin/San Ramon Services District a portion of their
property which is located to the rear of their site adjacent to
the Sports Grounds. This issue has been just previously
discussed with the applicant. No final decisions have been made.
Mr. DeLuca noted that one of the conditions required that a good
faith effort be made to relocate the entrance across from Sierra
Court.

Chairman Alexander opened the public hearing.
Rodger Coupe, representing the applicant addressed the Planning
Commission and stated he was concerned with the requirement to
pay for the full cost of the signalization project at Sierra
Court and Dublin Boulevard.
Mr. Coupe indicated that his client was willing to pay for a
portion of the signal costs, but not the entire cost.
It was the concensus of the Planning Commission that any action
on this extension would be premature until there was further
information on the relocation of the entrance onto Dublin
Boulevard.
It was moved by Commissioner Raley and seconded by Commissioner
Barnes to continue this item to the December 17, 1984.

UNFINISHED BUSINESS
Mr. Tong gave the status on the McCartney Variance appeal and the
Valley Christian Conditional Use Permit appeal

NEW BUSINESS
Commissioner Raley stated that he would feel more comfortable if
the City established more stringent regulations for daycare
centers within the City and considered requiring nurses at such
facilities.

ADJOURNMENT
There being no further business, the meeting was adjourned at
