' Regular Meeting - August 6, 1984
.
A regular meeting of the City of Dublin Planning Commission was
held on August 6, 1984, in the Meeting Room, Dublin Library. The
meeting was called to order at 7:30 p.m. by Vice Chairperson
Mack .

PRESENT: Commissioners Petty, Barnes, Raley, and Vice
Chairperson Mack, Thomas P. DeLuca, Associate Planner, and
Laurence L. Tong, Planning Director. ABSENT: Chairman Alexander

PLEDGE OF ALLEGIANCE
Vice Chairperson Mack led the Commission, Staff, and those
present in the pledge of allegiance to the flag.

MINUTES OF PREVIOUS MEETING
The minutes of the regular meeting of July 16, 1984, were
approved as written.

PUBLIC HEARING
SUBJECT: PA 84-035, Kawasaki of Dublin Conditional Use Permit
application for outside display of motorcycles at
6743 Dublin Boulevard
Mr. Tong presented the staff report. Mr. Tong noted that the
Planning Commission had continued this application from the
7/16/84 meeting to the 8/6/84 meeting so that the applicant and
staff could explore potential alternatives for displaying
motorcycles outside the Kawasaki building. Mr. Tong stated that
staff could not support the two alternatives; 1) displaying

PUBLIC HEARING
SUBJECT: PA 84-035, Kawasaki of Dublin Conditional Use
Permit application for outside display of motorcycles
at 6743 Dublin Boulevard.
Mr. DeLuca presented the Staff Report which was a request by
Kawasaki of Dublin for a Conditional Use Permit to allow an
outside display of motorcycles at 6743 Dublin Boulevard. Staff
noted that the applicant was given several extensions for either
bringing the motorcycles inside or applying for a Conditional Use
Permit. Staff could not support the application because the
motorcycles were within a pedestrian and vehicular circulation
area,the motorcycles did not present a desirable appearance from
Dublin Boule~ard, the display of motorcycles would be contrary to
previous City actions on outdoor displays of inerchandise, and the
site was inappropriate for the proposed outdoor display.
Chairman Alexander opened the public hearing.
William Lindsay, owner of Kawasaki of Dublin and apglicant,
addressed the Planning Commission and stated he was not told the
correct Section of the Zoning Ordinance that he was in violation
of until his citation hearing at the District Attorney's office.
Mr. Lindsay noted that the outside display area was a very
important part of his business and requested the Planning
Commission allow him to continue the outside display.
Mr. DeLuca responded that the applicant was notified of the
proper violation at an office hearing on 3/28/84.
Considerable discussion occurred between the Planning
Commissioners regarding the outside display area. The Planning
Commission brought up several potential alternatives for review
and consideration. It was the consensus of the Planning
Commission that the applicant should meet with Staff to study the
potential alternative locations for the display area, and bring
the alternative locations and findings back to the Planning
Commission.
It was moved by Cornmissioner Mack and seconded by Commissioner
Petty that this application be continued to the 8/6/84 Planning
Commission meeting to allow the applicant and Staff an
opportunity to study potential alternative locations and bring
the findings back to the Planning Commissian for further
consideration.

SUBJECT: 84-025, United Car Stereo Conditional Use Permit
7395 Village Parkway, Dublin, California
Mr. DeLuca presented the Staff Report which was a request by
United Car Stereo for a Conditional Use Permit to allow car
stereo installation at 7395 Village Parkway. It was noted that
there was an existing building addition behind United Car Stereo
that had been illegally constructed. This structure was required
to be removed by the building code. Staff expressed their
support of the application provided that an attractive addition
was constructed to replace the existing structure.
Chairman Alexander opened the public hearing.
Ron Subbraw, attorney representing the applicant, addressed the
Planning Commission and stated their concern with building a
permanent structure due to cost considerations. Mr. Subbraw
stated that the applicant would prefer a temporary structure that
could be attractively designed.
It was moved by Commissioner Raley and seconded by Commissioner
Mack that the public hearing be closed.
It was the consensus of the Planning Commission that the building
addition needed to be removed but felt it could be replaced with
a"temporary" structure, provided it was designed to be permanent
looking and architecturally compatible with the primary
structure.
It was moved by Commissioner Raley and seconded by Commissioner
Mack that the Commission adopt the Conditional Use Permit
Resolution with a change to condition #2 to read: "Any new
building structure shall be subject to the Site Development
Review approval; said structure may be "temporary" in nature but
shall be architecturally compatible with the primary structure."
The motion was passed by unanimous vote.
RESOLUTION NO 84-34
APPROVING PA 84-025, UNITED CAR STEREO REQUEST FOR A CONDITIONAL
USE PERMIT TO INSTALL CAR STEREOS AT 7395 VILLAGE PARKWAY
SUBJECT: 84-029, Nohr's Conditional Use Permit, at 6451 Scarlett
Court, Dublin, California
Mr. DeLuca presented the Staff Report which was a request by
Michael Nohr for a Conditional Use Permit to operate an RV Center
at 6451 Scarlett Court. Staff noted that an auto body shop was
in operation to the rear of the site. Staff indicated their
support of the application, provided the applicant installed
lighting, landscaping, fencing and circulation improvements. It
was further noted that a bond for the required improvements would
be necessary since the applicant was already in operation.

Chairman Alexander opened the public hearing.
John Nohr, representing Michael Nohr, addressed the Planning
Commission and stated he agreed with most of the Staff's
recommendations. Mr. Nohr noted that they had problems with the
street lights, installing curbing around the landscaping and
completing the improvements within 90 days.
It was moved by Commissioner Petty and seconded by Commissioner
Mack that the public hearing be closed.
The Planning Commission determined that the street lights and
curbing were necessary improvements but that 180 days to complete
the improvements would be more appropriate as opposed to 90 days.
It was moved by Commissioner Raley and seconded by Commissioner
Mack to adopt the Conditional Use Permit Resolution with
Condition (G) revised to read:
(g) the applicant shall submit a written agreement and
faithful performance and warranty bond for the required
improvements within 30 days and complete the improvements
within 180 days.
The motion was passed by unanimous vote
RESOLUTION NO 84-36
APPROVING PA 84-029, MICHAEL NOHR'S REQUEST FOR A CONDITIONAL USE
PERMIT TO ALLOW AN RV CENTER AT 6451 SCARLETT COURT
SUBJECT: PA 84-037, Bagel King, Conditional Use Permit for
outside eating area at 7168 Regional Street, Dublin,
California.
Mr. DeLuca presented the Staff report which was a request by
Bagel King for a Conditional Use Permit to allow an outside
eating area in front of their store at 7168 Regional Street.
Staff noted that the proposal called for four tables and eight
chairs to be located in front of the Bagel King shop for outside
eating. Staff indicated their support for the application,
provided the applicant did not impede the normal pedestrian
traffic along the sidewalk, and that the sidewalk and parking
area was kept clean of all debris. Staff also expressed their
concern with the illegal signs which had been erected throughout
the City.
Chairman Alexander opened the public hearing.
Nathan Litvin, owner of Bagel King and applicant, addressed the
Commission and stated that the outside eating area would be an
important aspect of their business. Mr. Litvin noted that every
precaution would be taken not to obstruct the sidewalk and to

keep the area clean. With respect to the signs, Mr. Litvin noted
that many Dublin residents did not know where the Bagel King was
located, which led to erecting the signs.
It was moved by Commissioner Raley and seconded by Commissioner
Barnes to close the public hearing.
The Planning Commission indicated their support for the
application but expressed their concern with the illegal sign
displays. It was noted that illegal signs may be grounds for
revocation of the Conditional Use Permit. Chairman Alexander
noted that he would not support the application because of the
previous sign problems.
It was moved by Commissioner Petty and seconded by Commissioner
Raley to adopt the Conditional Use Permit Resolution. The vote
found all in favor except for Chairman Alexander.
RESOLUTION NO 84-35
APPROVING PA 84-037, BAGEL KING'S REQUEST FOR A CONDITIONAL USE
PERMIT TO ALLOW ON OUTSIDE EATING AREA IN FRONT OF THEIR STORE AT
7168 REGIONAL STREET.
