A RESOLUTION OF THE PLANNtNG COMMISSION
OF THE CITY OF DUBLIN
APPROVING A CONDITIONAL USE PERMIT FOR THE OPERATION OF A
VETERINARY CLINIC AT
4524 AND 4526 DUBLIN BOULEVARD (APN 986-0035-001)
PLPA 2010-00072
WHEREAS, Christopher and Keri Tripi, the "Applicants", on behalf of Four Paws Veterinary
Center, have requested approval of a Conditional Use Permit to operate a Veterinary Clinic at
4524 and 4526 Dublin Boulevard in a PD, Planned Development Zoning District (PA 94-001); and
WHEREAS, the Project consists of a 2,679 square-foot tenant space located within a multi-
tenant commercial building; and
WHEREAS, the Applicants propose to offer veterinary services that include internal
medicine, general surgery, dental care, geriatrics, exotic animal care, humane euthanasia and
contracted disposal, medical boarding, preventative care and behavior counseling; and
~ WHEREAS, the tenant space would consist of four exam rooms, a treatment area, a dog
ward, surgery room, an isolation room, radiology room and an ICU and cat ward. Other rooms
within the tenant space include a doctor office, break room, waiting area and two bathrooms;
WHEREAS, the Planning Commission is the reviewing body for a Conditional Use Permit
request to operate a Veterinary Clinic; and
WHEREAS, a complete application for the above noted entitlement request is available and
on file in the Community Development Department; and
WHEREAS, the Project is Categorically Exempt from the environmental review
requirements of the California Environmental Quality Act (CEQA), State guidelines and City
environmental regulations pursuant to CEQA Guidelines Section 15301 (Existing Facilities); and
WHEREAS, a Staff Report was submitted describing the Project and recommending that
the request be conditionally approved; and
WHEREAS, the Planning Commission held a properly noticed public hearing on said
application on February 22, 2011; and
WHEREAS, the Planning Commission did hear and consider all said reports,
recommendations and testimony herein above set forth and used its independent judgment to
evaluate the project; and
WHEREAS, the Planning Commission has found that the proposed Project is appropriate
for the subject site.

NOW, THEREFORE, BE IT RESOLVED that the City of Dublin Planning Commission does hereby
find that:
A. The proposed use and related structures, as conditioned, are compatible with other land
uses, transportation and service facilities in the vicinity in that: 1} the Project is located in a
multi-tenant building within a portion of the Dublin Corners Shapping Center which includes
a mix of retail, restaurant, commercial and personal service uses; 2) the Project is
accessible from Dublin Boulevard and Toyota Drive which are fully improved and functional
roadways; 3) the Project will be served by existing service facilities and will not generate or
create an additional demand on services to be an adverse impact; and 4) a Veterinary
Clinic use is permitted in the PD (Planned Development) Zoning District (PA 94-001) with a
Conditional Use Permit approved by the Planning Commission.
B. The proposed use, as conditioned, will not adversely affect the health or safefy of persons
residing or working in the vicinity, or be detrimental to the public health, safety and welfare
in that: 1) the Project has been conditioned to require that all activities be conducted entirely
within the existing building so as not to disturb surrounding businesses and outdoor
activities shall not be allowed without a Temporary Use Permit in accordance with Section
8.108 of the Zoning Ordinance.; 2) the Project has been conditioned to require that lighting
of the parking areas meet D`ublin Municipal Code Section 8.76A70 in order to provide
adequate lighting to the project site; 3) there is a su~cient amount of parking to support`the
existing and proposed mix of tenants and parking will not overflow onto adjacent properties;
and 3) the Project has been conditioned, to require the Applicant to be responsible for
maintaining the site in a clean and litter free condition on a regular and continuous basis.
C. The proposed use, as conditioned, will not be injurious to property or improvements in the
neighborhood in that: 1) the Project has been conditioned to require Building Permits for all
modifications to the tenant space to accommodate the veterinary clinic and to ensure that the
Project complies with all applicable Building and Fire Codes; 2) a sufficient number of spaces
is provided to meet the greatest parking demands of the participating use types and to
ensure that there will not be a parking deficiency; and 3) the veterinary clinic will be located
within an existing 2,679 square foot tenant space and all activities shall take place within
the tenant space.
D. There are adequate provisions for public access, water, sanitation, and public utilities and
services to ensure that the proposed use and related structures would not be detrimental to
the public health, safety, and welfare in that: 1) the Project will occupy an existing
commercial building that is connected to public water, sanitation, utilities and services and
will not generate or create additional demand on services to be an adverse impact; and 2)
the Project has adequate vehicular and pedestrian access from Dublin Boulevard and
Toyota Drive and is required to comply with Title 24 for disabled accessibility.
E. The subjecf site is physical/y suitable for the type, density and intensity of the use and
related structures being proposed in that: 1) Conditions of Approval have been incorporated
into the Project requiring that all activities associated with Four Paws Veterinary Center be
conducted entirely within the building; 2) the Project is allowed by the PD zoning to operate
in this location with an approved Conditional Use Permit; and 3) the Project has been
conditioned to prohibit the boarding of animals with the exception of those animals receiving

medical treatment from the veterinary center who may remain on-site overnight.
F. The proposed use, as conditioned, will not be contrary to the specific intent c/auses,
development regulations, or performance standards established for the zoning district in
which it is located in that: 1) Conditions of Approval have been applied to the Project to
ensure on-going compatibility with surrounding uses; 2) the Project, as conditioned, meets
the development regulations; and 3) adequate parking is available on the site to support the
use.
G. The proposed project, as conditioned, is consistent with the Dublin General Plan and any
applicable Speci~c Plans in that: 1) the Project has a General Plan Land Use Designation
of General Commercial, is located within the Eastern :Dublin Specific Plan with a Specific
Plan Land Use Designation of General Commercial, and is located within the PD, Planned
Development Zoning District. A Veterinary Clinic is conditionally permitted in the PD Zoning
District which is consistent with the General Commercial Land Use Designation for the site.
BE IT FURTHER RESOLVED THAT the City of Dublin Planning Commission does hereby :
approve PLPA 2010-00072 Four Paws Veterinary Center Conditional lJse Permit for: 1) the
operation of a Veterinary Clinic located at 4524 and 4526 Dublin Boulevard, APN 986-0035-001.

Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance of
building permits or establishment of use, and shall be subject to Planning Division review and

with Section 8.96.020 of the Dublin Zoning Ordinance. ~

improvements related to this project, the Developer
shall supply written statements from each such , •

indicating that all applicable conditions required have
been or will be met.
11. Clarification to the Conditions of ApprovaL In the Various On-going & Standard
event that there needs to be clarification to the Prior to
Conditions of Approval, the Director of Community approval of
Development and the City Engineer have the authority . improvement

30. Construction Drawings. Construction plans shall be B Issuance of Building

section 3406 of the CA Building Code, a change of Completion
occupancy requires the building to meet the,
requirements of a new building for the proposed
occupancy type. This may require upgrades to the
structural and fire rating systems. The building/space
will be required to meet accessible codes as listed in
Chapter 11 B of the California Building Code.

34. Sitework Permit. All improvement work must be PW Issuance of ~Public ~

connection to the sanitary sewer system.: In addition,
a hose bib shall be provided for convenient wash-
down of the trash enclosure. The enclosure shall not
obstruct access (24' min wide drive aisle) and shall
have accessible route and entrance door.
37• Site Accessibility Requirements. All disabled PW Occupancy Public

current UBC Title 24 requirements and City of Dublin

50. Improvement Plans. Prior to issuance of any DSR Issuance of DSRSD
building permit, complete improvement plans shall be building
submitted to ~DSRSD that conform to the requirements permits
of the Dublin San Ramon Services District Code, the .
DSRSD "Standard Procedures, Specifications and
Drawings for Design and Installation of Water and
Wastewater Facilities", all applicable DSRSD Master
Plans and all DSRSD olicies.
51. Fees. Prior to issuance by the City of any Building DSR Issuance of DSRSD

52. Harmless and Indemnify. The applicant shall hold DSR Through DSRSD

claims, or fines resulting from the construction and

53. Sewer Demand Charges. A preliminary review of the DSR Issuance of DSRSD
sewer demand charges which have been paid for this building
site, and the sewer demand charges normally due permits
from a veterinary clinic of this square foot size,
demonstrate that additional sewer demand charges
