Regular Meeting - May 7, 1984
A regular meeting of the City of Dublin Planning Commission was
held on May 7, 1984, in the Meeting Room, Dublin Library. The
meeting was called to order at 7:30 p.m. by Interim Chairman, Cm.
Alexander.

Cm. Alexander Ied the Commission, Staff, and those present in the
pledge of allegiance to the flag.

MINUTES OF PREVIOUS MEETING
The minutes of the regular meeting of April 16, were approved
with the addition of Cm. Petty and Cm. Mack noted as extending
their congratulations to Cm. Vonheeder on her election to the
City Council.

ORAL COMMUNICATION
Bill Tenery, 3249 Casa Grande, San Ramon, extended his thanks and
appreciation to his fellow Commissioners for all he had learned
as Chairman of the Planning Commission. He also noted it had
been a pleasure working with staff.
Cm. Alexander along with Cm. Mack and Petty extended their well
wishes and noted it had been a pleasure working with Mr. Tenery.

PUBLIC HEARING
PA 83-042 (.l, .2 & .3) FESTIVAL ENTERPRISES,
(Dublin Town & County Shopping Center)
PLANNED DEVELOPMENT AND SITE DEVELOPMENT REVIEW
Mr. Hollander introduced the item, which is a request to
establish a 52,115 square foot shopping center on the west side
of San Ramon Road just south of Amador Valley Boulevard.
Mr. Hollander explained the application for the construction of
three, one-story commercial retail buildings to contain a total
of 52,115 square feet of use. The applicant is re£erring to this
project as the Dublin Town and Country Shopping Center. The
subject site has been approved for retail commercial use in the
San Ramon Road Specific Plan. The proposal is consistent with
the land use, design and circulation criteria of the Specific
Plan. The applicant is also requesting the Site Development
Review take place at the same time as the Planned Development
Rezoning.
Mr. Hollander noted that this shopping center would be similiar
to the Town & Country, Walnut Creek and the Palo Alto Town &
Country Shopping Center. He presented photos of these two
shopping centers noting that the character and quality would be
of the same type.
The project had two environmental consequences that were
addressed in the environmental review process, one being seismic
the other traffic. The applicant has agreed to design and locate
buildings and utility lines to minimize the potential for seismic
damage, and to mitigate the traffic problems by contributing to
and/or installing traffic signal and roadway improvements.
Mr. Hollander noted with regards to design, that views to and
from.the project are positive due to the building design and roof
treatment and the nature and location of the landscaping.
Mr. Hollander stated on the positive side, this development will
generate property taxes and sales tax revenues. These taxes will
pay for the municipal services made available to the center and
it will hopefully generate additional revenues for other City
uses.
Mr. Hollander noted that this project is consistent with the
City's land use regulations. It will provide adequate
environmental mitigation to mitigate potential environmental
impacts, The design elements of the shopping center are well
articulated and will result in an attractive, efficient and
marketable development which warrant City support and approval.
Mr. Richard Jeha, Developer, 211 Valley Oaks Drive, Alamo was
present and in agreement with all the conditions stipulated.

Mrs. Candy Larson, of 11696 Corto Court, stated that she was
happy with the design concept of the project and hoped the same
ideas could be incorporated into other developments along San
Ramon Road.
Al Bolla, a Corto Court resident, noted he was pleased with the
desi n of the ro'ect and felt it was im ortant for San Ramon

Road to look nice as it is one of the main roads entering into
the City.
Dawn Ritter, a Larkdale resident, expressed concern with the fact
that the children have to use this area going to and from school
and had any provisions been made for an overpass or pedestrian
crossing.
Mr. Nichandros stated he thought this was a good project and he
was in favor of its construction.
After the close of the public hearing Cm. Mack made the motion,
to recommend adoption of the mitigated negative declaration, with
Cm Petty's second. The motion passed unanimously.

RESOLUTION NO. 84-18
RECOMMENDING ADOPTION OF A MITIGATED NEGATIVE DECLARATION
CONCERNING PA 83-042 FESTIVAL ENTERPRISES -
DUBLIN TOWN & COUNTRY SHOPPING CENTER
Cm. Petty made the motion, to recommend approval of the planned
development rezoning. Cm. Mack seconded the motion. The motion

passed unanimously.

RESOLUTION NO. 84-19
RECOMMENDING APPROVAL OF PLANNED DEVELOPMENT REZONING CONCERNING
PA 83-042 FESTIVAL ENTERPRISES - DUBLIN TOWN & COUNTRY
SHOPPING CENTER
Cm. Petty questioned the removal of some of the old trees from
the site. The landscape architect explained that most of the
trees that were removed were in bad health and had low lying
branches. It was also noted that walnut trees with a lot of
landscaping under them usually do not fair well with all the
watering.
Cm. Mack made the motion to adopt the site development review.
Cm. Petty seconded the motion with the addition of two findings;
c) the proposal is in accordance with Site Development Review
procedures 8.95.0 & 8.95.1 of the Dublin Zoning Ordinance; and

d) the proposal is in accordance with San Ramon Specific PZan as
adopted by Dublin City Council. The motion passed unanimously.

RESOLUTION NO. 84-20
RECOMMENDING APPROVAL OF THE SITE DEVELOPMENT REVIEW FOR

PA 84-012 DANVILLE WHOLESALE LUMBER
CONDITIONAL USE PERMIT
Mr. DeLuca introduced the item, which was a request for outside
storage of lumber at 6015 Scarlett Court.
Mr. DeLuca explained that no retail sales of lumber at the site
will take place; the application was for a wholesale lumber
distribution facility only.
Mr. DeLuca noted that although on the surface this request seems
simple, there are numerous building code, drainage, fire service,
parking and aesthetic problems. Slides of the property were
shown to convey the present condition of the property.
Mr. DeLuca stated that Staff is recommending that if the
Conditional Use Permit is approved, the applicant file a Site
Development Review application to resolve the numerous technical
and aesthetic concerns.
It was also noted that the applicant should be aware that some of
the necessary improvements, particularly provision for water
service, will be very costly.
Mr. DeLuca stated that staff is recommending that the Planning
Commission approve the Conditional Use Permit as long as the -
applicant files a Site Development Review application with staff
to insure that the site can be brought up to an acceptable
standard.
Mr. Babbitt of Valley Engineering didn't feel that the problems
were that numerous that a Site Development Review was needed. He
stated that he was agreeable to installing landscaping at the
entrance to the site, installing slats into the existing
chainlink fence, if necessary, and removing building code
violations and debris.
Mr. Babbitt stated that the existing grading and paving is
adequate for their specific use. He stated the main concern for
them was to be able to move onto the site as soon as possible.

Mr. DeLuca stated that the City Engineer and himself had walked
the site earlier in the afternoon and there still needed to be
some discussion between the flood control district, applicant and
the City on how the property will drain and who will be
responsible for what improvements.
Henry Bettencourt, realtor, stated that if the applicant was not
in agreement with staff over landscaping, they would probably
have to come back to the Commission again for a decision.
Scott Greeley, Danville Wholesale Lumber employee, explained that
a forklift would be used to move the lumber on the site and that
the surface finish would not be a problem.
Mr. DeLuca noted that the existing surface treatment on the site
is not acceptable to staff. With regard to the landscaping, it
was noted that all of the Scarlett Court property owners have had
to make landscape improvements to their properties when
requesting site or use changes. The site in question should be
no exception.
After the close of the Public Hearing Cm. Petty made the motion
to approve the application with no modifications. Cm. Mack
seconded the motion. The motion passed unanimously.

RESOLUTION NO. 84-21
APPROVING PA 84-012, DANVILLE WHOLESALE LUMBER'S REQUEST FOR A
CONDITIONAL USE PERMIT TO ALLOW THE OUTSIDE STORAGE OF LUMBER AT
6015 SCARLETT COURT

At this point (9:15 p.m.), Chairman Alexander called for a recess
to 9:25 p.m.
PA 84-015 CROWELL/ADAMS
CONDITTONAL USE PERMTT
Mr. DeLuca introduced the item, which is a request to establish
an automotive and truck repair business at 5787 Scarlett Court.
The proposal calls for the existing 9,480 sq. ft. building to be
utilized for the automotive repair business and the construction
of a new 4,000 sq. ft. building for the truck repair
establishment.
Mr. DeLuca noted that the site has building code, drainage,
paving, fire service and aesthetic problems. Mr. DeLuca
presented slides of the area which conveyed the present condition
of the property.

Mr. DeLuca mentioned that the applicant should be aware that the
~ required improvements, particularly for fire service, will be
very costly.
Mr. DeLuca further noted that if the Conditional Use Permit is
approved, staff is recommending that the applicant file a Site
Development Review application in order to bring the site up to
an acceptable level.
Mr. Adams, 6015 Scarlett Court, stated he had no problem with the
requirement to bring the site up to standards, as long as costs
are economical.
Mrs. Nolton, a"resident" of the Dublin Mini-Storage project,
asked if she was going to have to look at the abandoned cars and
junk.
Mr. Adams replied to Mrs. Nolton's statement by noting that a
lot of the abandonded cars were dumped on the site and he has to
go through legal means to have them removed.
After the close of the Public Hearing, Cm. Mack made the motion
to adopt the Conditional Use Permit, with Cm. Petty's second.
The motion passed unanimously.

RESOLUTION NO. 84-22
APPROVING PA 84-015, CROWELL/ADAMS REQUEST FOR A CONDITIONAL USE
PERMIT TO OPERATE AN AUTOMOTIVE & TRUCK REPAIR BUSINESS AT
5787 SCARLETT COURT

' NEW BUSINESS
Cm. Mack had a question regarding the appointment of Planning
Commissioners by the City Council. Cm. Alexander expanded on
what he knew of the new selection system.
Mr. DeLuca noted that the City of San Ramon Planning Commission
extended an invitation to the City of Dublin Planning Commission
for a joint meeting on Wednesday, May 23, 1984. The Commission
expressed their interest in attending.
