The meeting was called to order at 7:00 p.m. by Cm. Barnes, Chairman. ~ * ~ * ROLL CALL PRESENT: Commissioners Barnes, Burnham, Mack, and Zika, Laurence L. Permit request for a Special Easement Si~n at 6379 C1ark Avenue (continued from meetin~ of June 6, 1988) Cm. Barnes opened the public hearing. Cm. Barnes advised that since the Applicant had not provided the needed information, this item would be continued to the next Planning Commission meeting on July 5, 1988. SUBJECT: PA 88-023 Liquor Barn Site Development Review Appeal re~arding Conditions of Approval of request to remodel existing building at 6b33 Dublin Boulevard (continued from meeting of June 6, 1988) Cm. Barnes opened the public hearing. Cm. Barnes advised that since the Applicant had not provided the needed information, this item would be continued to the next PZanning Commission meeting on July 5, 1988. SUBJECT: PA 88-058 Diamond Signs Kildara Conditional Use Perrnit request for a Directional Tract Sign on the east side of San Ramon Road, North of Dublin Boule~ard Cm. Barnes opened the public hearing and called for the Staff Report. Ms. 0'Halloran indicated that the Applicant, Diamond Signs, was requesting approval of a Conditional Use Permit to allow one Directional Tract Sign for the Kildara Development on the east side of San Ramon Road. She indicated that the sign would be 10 feet tall, single faced with a 32 square foot sign area. Ms. 0'Halloran indicated that the sign would be on an undeveloped lot and has been used for a cons~ruction material storage in the past. Ms. 0'Halloran indicated that an Administrative Conditional Use Permit application has been submitted for a temporary sales office and model hame comples. She indicated that there was a condition in the Draft Resolution requiring the establishment of this sales office and model home complex prior to the erection of the sign. Ms. 0'Halloran indicated that the sign is in accordance with all Zoning Ordinances. Regular Meeting PCM-12-2 June 20, 1988 . . • . Cm. Burnham asked how many signs were located on this site at this time. Ms. 0'Halloran indicated that there were none at this time, however, directional tract signs had been approved for the site in the past. ~ Cm. Barnes closed the public hearing. On motion from Cm. Mack, seconded by Cm. Zika, with a vote of 4-0 (Cm. Tempel was absent), the Planning Commission adopted RESOLIITION N0. 8$-039 APPROVING PA 88-058, DIAMOND SIGNS/KILDARA CONDITIONAL USE PERMIT REQUEST TO LOCATE AN OFF-SITE DIRECTIONAL TRACT SIGN - ON AN UNDEVELOPED LOT ON THE EAST SIDE OF SAN RAMON ROAD, NORTH OF DUBLIN BOULEVARD. SUBJECT: PA 88-060 Diamond Si~ns Hacienda Heights Conditional Use Permit request for a Directional Tract Sign at 11740 Dublin Boulevard Cm. Barnes opened the public hearing and asked for the Staff Report. Ms. 0'Halloran indicated that this was a similar situation to the previous application whereby Diamond Signs was requesting a Conditional Use Permit for a Directional Tract Sign for the Hacienda Heights housing development which is also known as Pulte Homes. She indicated the Applicant, Diamond Signs, is proposing to locate the sign on Dublin Boulevard on the northeast corner of Dublin Bouelvard and Hansen Drive. She indicated the sign would be l0 feet tall, single faced, with 32 square feet of sign area. Ms. O'Halloran indicated that the site location of the sign is currently being graded for an office development and has supported directional tract signs before. She indicated that there was a condition in the Draft Resolution for the establishment of a sales office prior to erecting the proposed sign. Ms. 0'Halloran recommended that a condition be added to direct traffic to Dublin Boulevard right on Silvergate and left on Betlen Drive. Ms. 0'Halloran indicated that the proposed sign was in accordance with all zoning requirements. Cm. Zika asked for clarification on the direction of the route to the development. Ms. 0'Halloran indicated that Staff was proposing to change the direction of traffic from the proposed route. She indicated that Staff preferred having the traffic routed from Dublin Boulevard to Silvergate and then a left turn onto Betlen Drive. This direction would be able to handle the traffic better than the Applicant's proposed traffic route. Cm. Barnes closed the public hearing. Cm. Burnham asked which condition on the Draft Resolution pertains to the route change. Regular Meeting PCM-12-3 June 20, 1988 _ _ _ _ ~ . • • • Ms. 0'Halloran indicated that the route change would be Condition #6 and that the current Condition #6 on the Resolution would be changed to Condition #7. Cm. Zika asked if this condition would require Diamond Signs to have a sign in 4nore than one place, for example, on Silvergate or Betlen Drive. Ms. 0'Halloran indicated that it was not necessary to have more than one sign. She indicated that the one sign could show the route directions, for example, turn left on Silvergate, turn right on Betlen Drive. Mr. Tong indicated that Exhibit A shows how the sign would look. Cm. Burnham stated that if the sign was going to be on Dublin Boulevard how were customers going to be directed to Dublin Boulevard. Ms. 0'Halloran stated the sign copy would include directions. Doug Millsap, Applicant, Diamond Signs, indicated that he saw no problems with Staff's recommendations. Cm. Barnes closed the public hearing. On motion from Cm. Burnham, requesting the addition of Condition #6 showing the route to be from Dublin Boulevard to Silvergate and then to Betlen Drive, seconded by Cm. Mack, with a vote of 4-0 (Cm. Tempel was absent}, the Planning Commission adopted RESOLUTION N0. 88-040 APPROVING PA 88-060, DIAMOND SIGNS/HACIENDA HEIGHTS CONDITIONAL USE PERMIT REQUEST TO LQCATE AN OFF-SITE DIRECTIONAL TRACT SIGN ON THE NORTHEAST CORNER OF DUBLIN BOULEVARD AND HANSEN DRIVE, 11700 DUBLiN BOULEVARD SUBJECT: PA 88-059 Diamond Signs Kildara/Hacienda Heights Conditional Use Permit request for two Directional Tract Signs at 11960 Silvergate Drive Cm. Barnes opened the public hearing and asked for the Staff Report. Ms. 0`Halloran indicated that Diamond Signs was requesting a Canditional Use Permit for two Directional Tract Signs, one for Kildara and one for Hacienda Heights housing developments. She indicated that the proposed signs wauld be doubled faced, 10 feet tall and have 64 feet of sign area. She indicated that both signs would be located on the northeast corner of Silvergate Drive and San Ramon Road and that this lot location has supported similar signs in the past. Ms. 0'Halloran indicated that the Conditions of Approval were similar to the two previous applications and were consistent with all zoning ordinances. Cm. Barnes asked if the route would have to be changed for Hacienda Heights. Mr. Millsap indicated that there were no changes needed and that the route was already on Silvergate. Zika asked if the signs were one on top of the other. Ms. 0'Halloran stated that the signs would be side by side. Mr. Millsap stated that he would like to see the blank signs that are now at the proposed sign site be removed. He indicated that he was under the impression that after the previous permit had expired, the old signs should have been removed. He indicated that these signs have been the subjeet of vandalism and graffiti. Ms. 0'Halloran stated that if the Planning Commission wished, the Staff could look into the problem. Cm. Zika asked if this problem had anything to do with the current application in question. Ms. 0'Halloran indicated that no, these previous signs were for two different developments and Staff would check the Condition of Approval on the previous approvals. Cm. Zika asked if the bond posting was one of the conditions of this application. Ms. 0'Halloran indicated that the bond is typically a standard candition. Cm. Barnes closed the public hearing. On motion form Cm. Zika, seconded by Cm. Burnham, with a vote of 4-0 (Gm. Tempel was absent), the Planning Commission adopted RESOLUTION N0. 88-041 APPROVING PA 88-059, DIAMOND SIGNS CONDITIONAL USE PERMIT REQUEST TO LOCATE TWO OFF-SITE DIRECTIONAL TRACT SIGNS (KILDAR.A AND HACIENDA HEIGHTS) ON THE NORTHWEST CORNER OF DUBLIN BOIILEVARD AND HA.NSEN DRIVE, 11960 SILVERGATE DRIVE SUBJECT: PA 88-061 Crossroads Toyota-Pontiac Conditional Use Permit request for 60 days of temporary promotional displays at 6450 Dublin Court Cm. Barnes opened the public hearing and asked for the Staff Report. Mr. Tong indicated that Eric Hammon of Crossroads Toyota-Pontiac was requesting a Conditional Use Permit for temporary promotional displays for up to a 60 day period. He indicated that the site's address was 645D Dublin Court, that it was in a C-2 zoning district, and that this application was categorically exempt. He indicated that the property owners were notified and that the public hearing was posted. Regular Meeting PCM-12-5 June 20, 1988 t . ` ~ • Mr. Tong indicated that the sign regulations provided the use of a 60-day cumulative period on a Conditional Use Permit in addition to the 30-da.y cumulative period for an Administrative Conditional Use Permit. Mr. Tong ~stated that the previous car dealership had approved apglications for promotional displays. Mr. Tong indicated that Staff recommends that the standard form be used as shown on Attachment #4 and that Applicant be required to notify Staff at least 4 days prior to any promotional events. Mr. Tong indicated that Staff recommends the Planning Commission adopt the Resolution approving the Conditional Use Permit. Cm. Zika asked if the Applicant already had a 30-day use permit and why would the Applicant be requesting an additional 60-day use permit. Mr. Tong indicated that yes, there'was a 30-day use permit already approved; however, the use permits on a cumulative basis can be "up to" 90 days. He indicated that in regards to Ozzie Davis, the Planning Commission approved a Conditional Use Permit for up to 60 days and the Zoning Administrator approved a Administrative Conditional Use Permit for up to 30 days, which added up to 90 days of use. He indicated that there were similar applications in 1986. Cm. Zika asked if Staff kept a record of the days used. Mr. Tong indicated that the Applicant was required to give a 4 day notice before using the display. Cm. Barnes closed the public hearing. On motion from Cm. Mack, seconded by Cm. Zika, and with a vote of 4-0 (Cm. Tempel was absent), the Planning Commission approved RESOLUTION N0. 88-042 APPROVING PA 88-061 CROSSRAODS TOYOTA-PONTIAC CAR DEALERSHIP TEMPORARY PROMOTIONAL SIGNS - 60-DAY TIME FRAME CONDITIdNAL USE PERMIT, 6450 DUBLIN COURT The Planning Commission took a break. ~ ~ ~ ~ ' NEW BUSINESS OR UNFINISHED BUSINESS SUBJECT: Review of 1988-1993 Proposed Five-Year Capital Improvement Program (CIP) Cm. Barnes open the public hearing. Mr. Ambrose and Lee Thompson were present to discuss the proposed 5-year CIP for 1988-1993. Regular Meeting PCM-12-6 June 20, 1988 ~ , < ? ~ • Mr. Ambrose indicated that it was the responsibility of the Planning Commission to review the CIP and to determine if the CIP was in conformity with the Specific Plan. Mr. Ambro§e discussed the new and revised categories that the Planning Commission were not aware of from the previous CIP review. Mr. Ambrose stated that there were no resolutions in regard to the CIP and that the Planning Commission only had to vote as to whether the CIP was in eonformance with the Specific Plan. On motion by Cm. Mack and seconded by Cm. Burnham,'and a vote of 4-0 (Cm. Tempel was absent), the Planning Commission determined that the 1988-1993 Capital Improvement Program was in conformity with the Specific Plan. ~ * ~ * OTHER BUSINESS ' Mr. Tong stated that Albertsons' Site Development Review and the Wheels Bus Shelters were going to the City Council. He indicated that the City Council would be meeting June 21 through June 23 at the Shannon Center to review the CIP and would be held in the East Room at 7:00 p.m. Cm. Barnes asked why Albertson was going to the City Council instead of the Planning Commission. Mr. Tong explained that as a Condition of Approval of two variances approved by the City Council in 1982, the Council requested that the Site Development Review go back to them for review and approval. Cm. Barnes asked about the problems in relation to Target and Albertsons and the access between both Rainbow Investment and the Bank. Mr. Tong explained that they are suppose to connect the parking lot and add speed bumps and that this problem would be addressed by the City Council. Cm. Burnham asked about the addition of the Stationary Store. Mr. Tong advised that this had been approved and that this daes not affect the Target Store. He indicated that there would be no modifications of the front of store. Cm. Barnes commented on the height of the "no-right turn" signs in reiatian to the rearview mirror of her car. ~~~r~ PLANNING COMMISSIONERS' CONCERNS Cm. Zika asked why the Staff was adding staff reports to the agenda if the reports were not complete and were going to be continued to the next meeting: He indicated that he thought this was a waste of paper and time. Regular Meeting PCM-12-7 June 20, 1988 i ' ` ~ ~ Mr. Tong indicated that the Staff would work on the problem. Cm. Barnes stated that there was a problem with the way the mailboxes were situation at the post office and requested that someone look into the problem. ~ Mr. Tong indicated that Staff would look into the problem. Cm. Zika asked if Nahas' signs have been looked into. Mr. Tong indicated that he would ask Rod Barger for a status report. Cm. Barnes asked about The Oi1 Changers application.
