Reqular Meetinq - February 20, 1990
A regular meeting of the City o~ Dublin Planning Commission was ,
held on February 20, 1990, in the Dublin Civic Center Council
Chambers. The meeting was called to order at 7:35 p.m. by ,
Chairman Burnham, Chairperson. '

Mr. Tong introduced two new planning staff inembers; Ralph
Kachadourian, Assistant Planner and Dennis Carrington, Senior
Planner.

PUBLIC HEARINGS I
SUBJECT: PA 89-136 Therp Conditional Use Permit request to
continue use of a reconditioned car sales facility and
outdoor vehicle displ~y are located at 6787 Dublin
Boulevard

Cm. Burnham opened the public hearing and asked for the staff
report.
Mr. Kachadourian presented the staff report regarding the
continued use of a reconditioned car sales facility and outdoor
vehicle display located at 6787 Dublin Boulevard. He indicated
that the Applicant had expanded the showroom display to 11,826 I
square feet with 1,730 sguare feet of warehouse space. ,

Mr_. Kachadourian indicated that the Applicant had been operating !
the facility for the past two years within compliance of the use
permit and Staff recommended that the Planning Commission adopt
the draft resolution approving the Conditional Use Permit.
Cm. Burnham closed the public hearing.
On motion from Cm. Mack seconded by Cm. Okun, and with a vote of
5-0, the Commission adopted
RESOLUTION NO. 90-005
APPROVING PA 89-136 THERP COLLECTION CONDITIONAL USE PERMIT
APPLICATION TO ALLOW THE CONTINUED SALE OF RECONDITIONED
AUTOMOBILES AND OUTDOOR AUTO SALE DI5PLAY AT 6787 DUBLIN
BOULEVARD
SUBJECT: PA 90-001 Lew Doty/Cadillac Conditional Use Permit
request to allow a 35 foot tall freestandinq siqn which
would exceed the 20 foot maximum heiqht limit and a
Variance request to locate a freestandinq siqn within
the required 10 foot sideyard setback area located at
6301 Scarlett Court
Cm. Burnham opened the public hearing and asked for the Staff
Report.
Mr. Kachadourian presented the Staff Report to the Commission
regarding the 35 foot tall freestanding sign located at 6301
Scarlett Court.
Mr. Kachadourian indicated that Staff recommended the Variance be
denied. Staff indicated the Applicant had two options available
regarding the location of the freestanding sign: (1) to relocate
the siqn approximately l00 feet west of the east property line
within the landscaped planter (this option would still require a
Conditional use Permit); or (2) reduce the sign to a 27.5 foot
tall double-faced freestanding sign with 205 square feet of sign
area, setback 35 feet from the street frontage within the
landscaped planter. Staff recommended the Planning Commission
approve Option #2 based on the conditions identified in the draft
resolution.
Cm. Okun asked if any of the surrounding businesses expressed
their concerns.

Mr. Kachadourian indicated no.
Mr. Wade McClure, 1026 San Miguel Road, Concord, Applicant,
indicated his preference for Option #2 with a 35 foot tall
freestanding sign. He indicated that there were other
dealerships in the area that had 35 foot tall signs and because
of the 15 degree vision angle of the proposed siqn, the
additional height was needed for visibility. He indicated that
the landscaping would need to be redone and there would also be a
loss of parking spaces.
Cm. Zika asked Staff if there were other businesses on Scarlett
Court that had 35 foot tall signs.
Mr. McClure indicated that the Nissan dealership and U-haul had
signs of that height.
Ms. O'Halloran indicated that the signs Mr. McClure was referring
to were not located in the parcel's setback area.
The Staff and Planning Commission discussed the City's sign
regulations. It was indicated that the sign ordinance would
allow up to a 35 foot freestanding sign with a Conditional Use
Permit outside of the setback area of the parcel.
Mr. McClure indicated that he was unaware of any city having a 10
foot sideyard setback requirement for signs, with the exception
of Alameda County.
Cm. Burnham closed the public hearing.
Cm. Okun took a motion indicating that the Variance should be
approved. There was no second to that motion.
On motion from Cm. Zika to deny the Variance, seconded by Cm.
Barnes, and with a vote of 3-2, the Commission adopted
RESOLUTION NO. 90-006
DENYING PA 90-001 LEW DOTY CADILLAC/OLDSMOBILE VARIANCE REQUEST
TO LOCATE A 35 FOOT TALL FREESTANDING SIGN WITHIN THE REQUIRED 10
FOOT SIDEYARD SETBACK AREA AT 6301 SCARLETT COURT
In regards to the Conditional Use Permit, the Commission and
Staff discussed the options available to the Applicant.
Motion was made by Cm. Barnes requesting approval of Exhibit C
(Conditional Use Permit) per Option #2, and seconded by Cm. Zika.
Staff clarified to the Commission that Condition of Approval #1
would need to be amended if the Commission wishes were to approve
the Conditional Use Permit with flexibility to allow Staff to
review and approve the location. Additional discussion followed
and Cm. Zika withdrew his second.

Cm. Burnham re-opened the public hearing to enable the Applicant
to address the Commission.
Mr. McClure indicated that if the Planning Commission decided to
deny the Variance, then the Applicant would need to redo the
landscaping and eliminate a few parking spaces in order to
accommodate the freestanding sign. `
Mr. Tong suggested to the Commission that they could continue the
item so that the Applicant would have time to bring forth
alternate options or they could act on the Conditional Use Permit
with conditions of approval showing that the sign would be in
compliance with the Sign Ordinance.
Mr. McClure indicated that the sign could be relocated 9 feet to
the west of his original proposal.
Mr. Tong indicated that a Conditional Use permit would still be
required.
The Planning Commission voted to continue the item until the
March 5th meeting.
Cm. Zika reguested information on the sign dimensions of the
surrounding businesses.
SUBJECT: PA 89-050 First Western Planned Development Rezoning
request to rezone from a C-1 to PD restricting future
new development to the northwestern portion of Parcel A
establishinq permitted and conditional uses and
development standards located at 7450 Amador Valley
Boulevard
Cm. Burnham opened the public hearing and asked for the Staff
Report.
Ms. O'Halloran presented the staff report to the Commission. She
indicated that where Attachment 1 had been typed it should read
Exhibit A(i.e., page 4 of the staff report).
Ms. O'Halloran indicated that the Applicant and Staff disagree on
two provisions regarding the Applicant's sign, 1) relating to
exsiting freestanding sign and 2) relating to wall signs on the
east elevation ofthe building currently under construction.
Staff's position is represented in the draft resolution of
approval.
Ms. O'Halloran indicated that Staff was recommending the Planning
Commission adopt the resolutions recommending that the City
Council (1) approve a Negative Declaration (Exhibit B) and (2)
approve the Planned Development General Provisions and PD
Rezoning (Exhibit C).

Ms. O'Halloran also indicated that the Planning Commission needed
to recommend that the City Council make findings in compliance
with AB1600 and Government Code 60000 with City Attorney review.
The AB1600 relates to imposition of traffic mitigation fees.
Cm. Zika and Staff discussed the dimensions of the two parcels on
the site. `
Cm. Burnham asked if a restaurant was constructed on the corner
of the site, would there be sufficient parking for that use.
Ms. O'Halloran indicated that it would depend on the square
footage of the building.
Cm. Burnham asked for clarification regarding the east face of
Parcel "B". There would be no signage allowed? The freeway was
not considered a frontage?
Ms. O'Halloran referenced the Howard Johnson signage and
indicated that the ordinance did not typically considered the
freeway a frontage area except for large parcels.
Mr. Rick Hess, Applicant, indicated that he was in agreement with
Staff except for the two sign provisions mentioned by Staff. He
indicated that he could work out the sign location with Staff and
would like to see signage on the east frontage.
Scott Brenner, Regional Manager from Kuppenheimer, indicated that
signs would be needed for visibility and the signs would be
tastefully designed.
Cm. Burnham closed the public hearing.
On motion from Cm. Mack, seconded by Cm. Okun, with a vote of 5-0
the Planning Commission adopted
RESOLUTION NO. 90-007
RECOMMENDING THAT THE CITY COUNCIL ADOPT A NEGATIVE DECLARATION
OF ENVIRONMENTAL SIGNIFICANCE CONCERNING PA 89-050 FIRST WESTERN
DEVELOPMENT REZONING APPLICATION
A motion was heard from Cm. Okun and seconded by Cm. Zika. After
discussions between Staff and the Commission regarding sign
regulations and approvals, Cm. Zika withdrew his second. After
further discussions, Cm. Zika re-seconded and the Planning
Commission, with a vote of 5-0, adopted
RESOLUTION NO. 90-008
RECOMMENDING THAT THE CITY COUNCIL ADOPT AN ORDINANCE REZONING
THE SITE FOR A PD DISTRICT AND ESTABLISH FINDINGS AND GENERAL
PROVISIONS FOR A PD, PLANNED DEVELOPMENT REZONING CONCERNING PA
89-050 FIRST WESTERN DEVELOPMENT

SUBJECT: PA 88-010 Dublin Boulevard Extension General Plan
Amendment to modify the location of the Dublin
Boulevard Extension located north of Interstate 580,
west of Southern Pacific riqht-of-way and east of
Tassajara Road
Mr. Tong indicated that Staff was recommending the continuance of
this item. Staff was in the process of looking at several
alternate alignments in conjunction with the East Dublin studies
as well as the coordination with Camp Parks and Alameda County
properties.
Mr. Tong indicated that the item would be re-noticed prior to
consideration by the Planning Commission.
On motion from Cm. Barnes, seconded by Cm. Mack, with a vote of
5-0, the Planning Commission continued the item indefinitely.
NEW OR UNFINISHED BUSINESS
Mr. Tong indicated that the City Council had cancelled their
special meeting of February 22nd and would be rescheduling that
meeting for a later date. At the February 26th City Council
meeting, they would be discussing the Dublin Environmental
Guidelines and Tri-Valley Transportation Council issues, as well
as scheduling a joint Planning Commission and City Council
meeting regarding the East Dublin land use alternatives.
OTHER BUSINESS
None
PLANNING COMMISSIONERS' CONCERNS
Cm. Burnham had received a report from the Dougherty Valley Ad
Hoc Committee which had notations regarding schools, open space
trails, parks, etc. He had concerns that the information was
not specific enough and wanted to know the names of the committee
members.
Cm. Okun asked what the status was regarding the BART issues and
the Livermore Airport issues.
In regards to the BART issue, Mr. Tong indicated Staff would be
reporting their point of view to the City Council. Regarding the
airport, the City Council's position had been fowarded to the
Livermore City Council.
