~ Reqular Meetinq - June 3, 1991

~ A regular meeting of the City of Dublin Planning Commission was held on
June 3, 1991, in the Dublin Civic Center Council Chambers. The meeting was
called to order at 7:30 p.m. by Commissioner Burnham, Chairperson.

Present: Commissioners Barnes, Burnham, North, Rafanelli and Zika;
Laurence L. Tong, Planning Director; Maureen O'Halloran, Senior Planner;
Carol Cirelli, Associate Planner; and Gail Adams, Planning Secretary

PLEDGE OF ALLEGIANCE TO THE FLAG
Cm. Burnham led the Commission, Staff, and those present in the pledge of
allegiance to the flag.
ADDITIONS OR REVISIONS TO THE AGENDA
None
MINUTES OF PREVIOUS MEETING
The minutes of May 6, 1991 were approved.

PUBLIC HEARINGS
SUBJECT: PA 91-030 Crossroads Toyota/Pontiac Temporary Promotional Signs
Conditional Use Permit request to allow the use of temporary
promotional advertisinq displays for a maximum cumulative period
of 60 days within a 12-month period located at 6450 Dublin Court
Cm. Burnham opened the public hearing and asked for the staff report.
Ms. Carol Cirelli presented the staff report to the Commission. She
indicated that Staff was recommending approval of the Conditional Use
Permit for temporary promotional advertising displays.
Mr. Larry Alexander, Applicant, indicated that the balloons were a good
source of advertising. It made the public aware of special promotional
events and had been very successful for their business in the past. He
indicated that he would follow all of Staff's conditions of approval.
Cm. Zika asked if they had any plans on painting the balloon. ,

Mr. Alexander indicated ~at they had purchased a n~ balloon.
Cm. Rafanelli asked if 60 days would be enough time for their promotional
` advertisements.
Mr. Alexander indicated yes. They would be having promotional events every
3-4 weeks.
Cm. Burnham closed the public hearing.
On motion from Cm. Zika, seconded by Cm. North, and with a vote of 5-0, the
Commission adopted

Cm. North indicated he previously had concerns regarding the newspaper bin
at the Albertsons center and asked what the status was on this issue.
Mr. Tong indicated that the Zoning Investigator was looking into the
matter.
OTHER BUSINESS
Mr. Tong indicated that at the City Council's June lOth meeting, they would
be reviewing the General Plan Amendment and Rezoning for the Fire Station
located on Donahue Drive.
Mr. Tong indicated that at the next Planning Commission meeting, Staff
would be discussing the 1990-95 Capital Improvement Program.
PLANNING COMMISSIONERS' CONCERNS
Cm. Barnes had concerns regarding the continuous usage of real estate signs
for several residential developments. She indicated that the Shadow Creek
development was located in Danville 8 miles from where they were putting up
their advertising signs. Heritage Park, which was 6 miles away, was also
advertising their development.
Cm. Barnes indicated that it did not seem fair that citizens of Dublin
could not post garage sale signs; however, these real estate developers
were being allowed to advertise their homes, which were not even located in
Dublin.
Cm. North indicated that this concern had been brought up several times in
the past and asked what the status was.
Mr. Tong indicated that letters had been written to the developers; however
Staff had not received any responses as of yet. Staff may have to contact
the City Attorney's office to see what additional course of action could be
taken.
Cm. Zika asked if the police could pick up the signs.

,Mr. Tong indicated that this would only be a short-term solution. He
indicated that Staff would continue to pursue the issue.

Cm. Zika asked why should the Commission have meetings when there was only
one item. Unless the item was critical, it seemed that it would be more
appropriate to put the item off until the next meeting. Maybe this issue
should be considered a City policy in the future.
Cm. North asked Staff if there was a time limitation on approving public
hearing items.
Mr. Tong indicated yes. However, the statutory time limitations for minor
permits were relatively lengthy. The Applicant might not appreciate the
policy. We could work around this if the Commission was concerned.
Cm. Burnham indicated that he would like to save the City money.
Cm. Burnham asked if all Variance applications went to the Zoning
Administrator for approval.
Mr. Tong indicated yes, City policy requires that Variance are heard before
the Zoning Administrator. If the item is appealed, the application would
be reviewed by the Planning Commission.
The Planning Commission discussed policy changes on postponing hearings if
there was only one item. They indicated that it should be at the Planning
Director's discretion. However, if this did not work out, a formal policy
may be in order.
Cm. Barnes asked if the City Council had taken action on the American City
Truck Stop application.
Mr. Tong indicated that one condition of the Commission's approved
resolution had been modified. The Public Works Department would be
required to monitor the amount of truck trips on Houston Place and prorate
the repair costs between Admiral Van & Storage and American City Truck
Stop. All of the other conditions remained the same.
Cm. Burnham asked if the City Attorney's office had been consulted.
Mr. Tong indicated yes. The City Council determined that since there was
abnormal wear and tear, the trucks were responsible for the damage of the
street.

There being no further business, the meeting was adj.purned at 8:00 p.m.
