The meeting was called to order at 7:30 p.m. by Chairperson Zika. * * * * ROLL CALL Present: Commissioners Barnes, Burnham, North and Zika; Laurence L. Tong, Planning Director; Maureen O'Halloran, Senior Planner; Carol R. Cirelli, Associate Planner; and Gail Adams, Recording Secretary. Absent: Commissioner Rafanelli * * * * PLEDGE OF ALLEGIANCE TO THE FLAG Cm. Zika led the Commission, Staff, and those present in the pledge of allegiance to the flag. * * * * ADDITIONS OR REVISIONS TO THE AGENDA None * * * * MINUTES OF PREVIOUS MEETING The minutes for May 4, 1992 were approved. * * * * ORAL COMMUNICATIONS None * * * * WRITTEN COMMUNICATIONS None * * * * PUBLIC HEARINGS SUBJECT: PA 92-025 Dublin Security Storage Conditional Use Permit request to continue the operation of an existing self stora e facilitv with outdoor storaqe of recreational vehicles, Ryder truck rentals and PG&E trucks and equipment located at 6005 Scarlett Court June 1, 1992 Regular Meeting PCM-1992-91 ! [6-lmin] ~ ~ Cm. Zika opened the public hearing and asked for the staff report. Ms. Carol Cirelli presented the staff report to the Commission. Staff recommended that the Commission approve the Conditional Use Permit request. Cm. Burnham questioned who had painted the curbing along the right-of- way. There was a yellow strip along Scarlett Court. Was this a private road? Mr. Thompson, Public Works Director, indicated that the property owner must have painted the curbing. The City had no jurisdiction over this road. Cm. Burnham asked why P.G.&E. was allowed to have a sign on the fence; however, other businesses could not have their signs located there. Mr. Tong recalled that Dublin Security Storage was allowed one freestanding sign. Directional signs had a maximum allowance of 8 square feet. He indicated that Staff would look into P.G.&E.'s sign. It might conform to the Zoning Ordinance. He would get back to the Planning Commission. Glenn Kierstead, Applicant, concurred with Staff's recommendations. Cm. North asked how long P.G.&E. had been a tenant. Ms. Cirelli referred to a letter addressed to Mr. Tong dated October 18, 1989, stating P.G.&E.'s intent to lease the property for the mid-term with the option to renew. Cm. North referred to page 16 of Attachment #2 and asked if P.G.&E. had 4-6 vehicles per day or per week. He asked how close was this property to the Dublin Boulevard Extension. Would the application require a traffic study? I Mr. Tong referred to page 11, Attachment 1. The road extension would II pass through the Southern Pacific Railroad area, just north of the i site. i Ms. Cirelli indicated that a traffic study was not required. There I',i was an error on the traffic data. It should indicate 4-6 vehicles per , day, not week. Cm. Zika closed the public hearing. On motion from Cm. Burnham, seconded by Cm. North, and with a vote of 4-0, the Commission adopted Regular Meeting PCM-1992-92 June 1, 1992 [6-lmin] ~ . ~ I RESOLUTION NO. 92-032 APPROVING PA 92-025 DUBLIN SECURITY STORAGE CONDITIONAL USE PERMIT TO ALLOW THE CONTINUED OPERATION OF AN EXISTING SELF-STORAGE AND TRUCK RENTAL FACILITY AND ANCILLARY P.G.&E. FACILITY WITH OUTDOOR STORAGE OF RECREATIONAL VEHICLES, RYDER TRUCK RENTALS AND P.G.&E. TRUCKS AND EQUIPMENT LOCATED AT 6005 SCARLETT COURT SUBJECT: PA 92-024 Marg-Etts Art & Craft Fair Conditional Use Permit rectuest to allow two separate four day Art & Craft Fairs at the Dublin Plaza Shoppinq Center (July 16-19 and December 3- 6, 1992) located at 7155-7333 Reqional Street Cm. Zika opened the public hearing and asked for the staff report. Ms. O'Halloran presented the staff report to the Commission. Staff recommended approval of the application. Marietta Lewis, Applicant, concurred with Staff's recommendation and hoped the Commission would approve her application. Cm. Zika closed the public hearing. On motion from Cm. Barnes, seconded by Cm. North, and with a vote of 4-0, the Planning Commission adopted RESOLUTION NO. 92-034 APPROVINGIPA 92-024 MARG-ETT ART AND CRAFT FAIRS - MARIETTA LEWIS (APPLICA~IT) DUBLIN PLAZA SHOPPING CENTER MERCHANTS ASSOCIATION (SPONSOR) CONDITIONAL USE PERMIT REQUEST TO ALLOW TWO ART AND CRAFT ' FAIRS AT THE DUBLIN PLAZA SHOPPING CENTER SUBJECT: PA192-020 Tri-Cit Ba tist Church Conditional Use Permit re uest for the operation and use of a church and its mi~istry within the Parkwav Plaza Center located at 6912 Vi~Llage Parkway Cm. Zika ope#~ed the public hearing and asked for the staff report. Ms. O'Halloran presented the staff report to the Commission. She indicated that the existin com lex had several vacant tenant spaces 9 P as was the case with a number of other retail centers in Dublin. Staff did not feel that the church operation would adversely affect opportunities for retail/office uses since there was an abundance of available retail space. Staff was recommending approval of a two year Conditional Use Permit. William Bryson, Applicant, had concerns with Condition #2. He indicated that they were not yet formerly a church in the State of California. The company is a non-profit organization and the parent organization is licensed through the State of New York. Cm. Zika felt that the Applicant was required to have a permit through the State showing their non-profit status. Regular Meeting PCM-1992-93 June 1, 1992 [6-lmin] i • . Cm. North indicated that a permit was not required since there were no taxes taken for the State of California. Ms. O'Halloran commented that the condition could be amended to require that a letter from the parent organization be given to Staff showing their articles of incorporation. The Planning Commission requested Staff to incorporate this language. Mr. Bryson referred to Condition #5 and indicated that he had not received the "Non-Residential Security Requirements" attachment. He also asked for clarification on the language requiring all conditions of approval to be complied with within 21 days. Ms. O'Halloran explained that after the 10 day appeal period, the 21 day requirement would start. Mr. Bryson asked if this was the amount of time allowed the Applicant to coordinate all of their permit approvals. Ms. O'Halloran indicated yes. Cm. Zika closed the public hearing. On motion from Cm. Barnes, seconded by Cm. North, with Staff's language revisions to Condition #2, and with a vote of 4-0, the Planning Commission adopted RESOLUTION NO. 92 - 034 APPROVING PA 92-020 TRI-CITY BAPTIST CHURCH CONDITIONAL USE PERMIT APPLICATION FOR THE ESTABLISHMENT OF A CHURCH AND MINISTRY AT 6912 VILLAGE PARKWAY NEW OR UNFINISHED BUSINESS SUBJECT: Review of 1992-97 Capital Improvement Program (CIP)_ Mr. Rich Ambrose explained that State Law requires the Planning Commission to review the Capitol Improvement Program and make findings as to whether or not the capitol improvements are in conformance with the General Plan. At tonight's meeting he would be reviewing projects for the 92-93 fiscal year and ending in 1997. Most of the projects had been considered by the Planning Commission last year and, because of financial reasons, there are not a lot of new projects. Mr. Ambrose anticipated that some projects will have a great deal of discussion with the City Council; so a number of projects are included but do not have funding because it is anticipated that the priorities will get realigned at the budget hearings. Mr. Ambrose discussed the new projects that had not been reviewed in the past capitol improvement discussions. He referred to the Park and Recreation Section and indicated there were three projects that had not been added to last year's program; two which were maintenance items: 1) Dublin Swim Center boiler replacement and 2) Shannon Center Regular Meeting PCM-1992-94 June 1, 1992 [6-lmin] ~ i > Social Hall floor replacement. These projects have been identified as items that need to be taken care of in the future. Mr. Thompson indicated that the boiler was very old and needed to be replaced as soon as possible. There was a solar panel at the center that worked very well when there are sunny days. When the temperature drops too far, the boiler takes over. Mr. Ambrose discussed the third project identified as the Heritage Center acquisition proposal; which includes acquiring and improving the old historic cemetery, the old Murray School and St. Raymonds church property. Details of this project were located on page 20. This item was not prioritized since the City does not have title to it yet. Cm. Barnes asked if the City did not go through with the Heritage Center acquisition, what would happen to the site. Mr. Ambrose was unsure. There were a lot of issues that needed to be resolved. Mr. Ambrose reviewed the various street improvements, such as Dublin Boulevard widening at Silvergate Drive and the bike bath at North Avenue along Dougherty Road. There were some concerns with the slope stability at the end of Dublin Boulevard which would need to be repaired. The detail was shown on page 26. Mr. Thompson explained that the bike path would run along side Dougherty Road up to Dublin Meadows. This would tie into a proposed bike path along Alamo Creek. There was a grant given to the City for $75,000 from the Transportation Development Act that would fund this project. Mr. Thompson indicated there were also surveying work to be done to update various benchmarks and monuments. Cm. North asked if the landscaping project on Silvergate Drive was still proposed. Mr. Ambrose indicated that this project might be completed within the 93-94 fiscal year. It had been proposed for the 92-93 budget but has been postponed. He commented that there was very little General Fund money available at this time. On motion from Cm. Barnes, seconded by Cm. North, and with a vote of 4-0, the Commission voted that the Capital Improvement Program was in conformity with the General Plan. OTHER BUSINESS Mr. Tong indicated that the General Plan Amendment and Specific Plan documents for the Eastern Dublin project have been released for public review. At this time, Staff recommends that the Commission set a public hearing date for the Eastern Dublin project. Regular Meeting PCM-1992-95 June 1, 1992 [6-lmin] ~ ~ , Since the release of the Draft Environmental Impact Report would not be until sometime at the end of July or beginning of August, the Commission decided to postpone the public hearings until that time. Cm. Barnes advised that she would be on vacation September 2-12. Cm. Zika advised that he would be out of town the second week of every month for the rest of the year. Cm. North asked what the letter received from Mr. Doolittle was about. Mr. Tong explained that Zone 7 was proposing a pedestrian pathway underneath I-580 to access the Pleasanton area. The City Council reviewed the proposal and the Park and Recreation Department would be responding to that letter. Mr. Tong indicated that the City Council would be taking action on the Western Dublin project at the June 8th meeting. Their recommendations were consistent with the Planning Commission's recommendations. Cm. Burnham indicated he had read several articles regarding the Western Dublin project and felt that the newspaper was over exaggerating. The Commission had approved guidelines for developing the project; they had not approved any specific project. Mr. Tong concurred. Staff was a long ways from development and there was a lot more processing to be done, such as tentative map and site development review approvals. PLANNING COMMISSION'S CONCERNS Cm. Barnes asked about meetings regarding the Zoning Ordinance. Mr. Tong indicated that revisions to the Zoning Ordinance was considered a medium priority by the City Council. Meetings have not been scheduled. It could be a few months before any work is started. Cm. Burnham referred to the Zoning Administrator meeting scheduled for the Almond Plaza project and asked if this was considered a minor alteration. Mr. Tong explained that Almond Plaza's proposal was considered minor when you look at the whole site. There would be a right turn only into the site from San Ramon Road. No exiting would be allowed. Cm. Burnham asked if vehicles would be allowed to circulate behind the stores. Mr. Tong indicated that there was a service drive on the perimeter of the site. This access would be a one-way aisle servicing the tenants. Cm. North mentioned that all of the incumbants of the Zone 7 board were against allowing water allocation to the western Dublin area. Channel 30 aired that 6 out of 7 board members were against the project. Regular Meeting PCM-1992-96 June 1, 1992 [6-lmin] • i Mr. Tong indicated that the numbers indicated in the western Dublin reports were assured by DSRSD. There would be conservation measures, and additional water sources pursued. There was an excellent system already in place. Cm. Barnes indicated that she did not have a lot of faith in Zone 7's remarks. Mr. Tong commented that there was ground water available and this water source had carried everyone through the drought. There was a historical low; however the Tri-Valley area has not yet reached this mark. Cm. Zika asked if there was a lot of well drilling proposed. Mr. Tong indicated that Zone 7 as well as DSRSD were reviewing these possibilities. Cm. Barnes commented that there were not enough reservoirs to hold enough water.
