Regu ar Meeting - February 16,~93 A regular meeting of the City of Dublin Planning Commission was held on February 16, 1993, in the Dublin Civic Center Council Chambers. The meeting was called to order at 7:30 p.m. by Commissioner Zika. ROLL CALL Present: Commissioners Burnham, North, Rafanelli and Zika; Dennis Carrington, Senior Planner; Carol Cirelli, Associate Planner; and Gail Adams, Recording Secretary. Absent: Commissioner Barnes PLEDGE OF ALLEGIANCE TO THE FLAG Cm. Zika led the Commission, Staff, and those present in the pledge of allegiance to the flag. ADDITIONS OR REVISIONS TO THE AGENDA The minutes for the December 7 and December 21, 1992, and January 4 and February 1, 1993, were approved as submitted. ORAL COMMUNICATIONS None WRITTEN COMMUNICATIONS I None PUBLIC HEARINGS SUBJECT: PA 92-080 Donlan Canyon Tentative Map 5926 request for a three-year extension for a 196+ acre area to allow 17 sinqle-family homes, 300 multi-family units and 170+ acres of open space. Ms. Carol Cirelli presented the staff report to the Commission. She indicated that Conditions of Approval 3, 8 and 9 involved future ordinances and the Applicant would be required to prepare a fiscal impact analysis prior to issuance of building permits. Staff recommended approval of the Tentative Map extension. Michael Gleason, the Applicant, stated that his family had owned the Donlan Canyon Ranch property for 30 years and began development plans in 1986. Due to the poor housing market, they have not obtained the capital needed to continue the project. Cm. North asked what would happen if the economy did not improve enough to build the houses within the next three years. Regular Meeting PCM-1993-4 February 16, 1993 [2-16min] r , , ~ ~ Mr. Gleason respondea°that, to his knowledge, th~State Map Act did not provide for further extensions and assumed he would need to re- apply to the City and begin the process again. Cm. Zika clarified that if the fees changed before the Applicant began the project, they would be required to pay the increased fees. Marjorie LaBar, resident, indicated that she was on the Preserve Area Ridgeland Committee (PARC) at the time of the original approval. PARC was in favor of the project's passage because of the Applicant's efforts to preserve the unique environmental characteristics of the property, while providing needed affordable housing in the area. She indicated there had been no change in the group's opinion since that time. John Anderson, resident, questioned if a 3-year extension meant the project would be started or finished within that 3 years. He expressed concern about construction going on for an infinite time period. Ms. Cirelli responded that the Applicant would have to begin the Site Development Review process within the 3-year extension time frame and then begin construction within one year of that approval. There was also a six-month extension option available for the Site Development Review approval. Mr. Carrington added that, per Building Code ordinance, constructian of a project needed to begin within one year of building permit issuance or the building permit would expire. However, construction did not need to be completed within the one-year permit expiration time frame. Cm. Burnham indicated that the cost factor involved usually kept a project from dragging on. Mr. Anderson asked who would pay for the rest of the Dublin Boulevard ' extension since the western Dublin project had been defeated. He referred to a story in the newspaper which indicated the Applicant would pay only a part of the improvements to Dublin Boulevard. Cm. Zika responded that the Applicant would pay only for the impact his project would have on the road improvements. Ms. Cirelli indicated that the Hansen Hills Ranch project would also have some affect on traffic, and therefore, pay for some of the improvement costs to Dublin Boulevard. Cm. North referred to page 27 of the oriqinal approval commenting that the costs would be split between the Donlan Canyon and Hansen Hills projects on a prorata basis based upon the amount of traffic generated by each project. Zika responded th t, after viewing pictures ~owing the grading and visual impacts of the project at the original presentation, he thought that only one part of a roof-ridge would be visible from I- 580. Mr. Anderson asked if there were any non-mitigated environmental impacts involved. Cm. Zika stated that no substantial environmental impacts were addressed. Ms. LaBar indicated that there would have been substantial environmental impacts had the project been designed the way the City had originally envisioned that area. However, the designs submitted by the developer had no substantial environmental concerns. Cm. Zika stated that the only major concern came from the Department of Fish and Game, who requested a 3 acre replacement for every 1 acre removed. He commented that there was still no commitment from East Bay Regional Parks as to whether or not they would take over the 160 acres. Ms. Cirelli responded that all of the impacts disclosed in the EIR were mitigable to a level of insignificance. Mr. Anderson asked if there were any conflicting issues with the new Alameda County Plan. Mr. Gleason responded that the Donlan Canyon had been annexed to the City of Dublin, so the Alameda County Plan did not apply. Mr. Gleason then expressed concern regarding the Fiscal Impact Study condition which, when originally presented to him, did not have the final sentence, "An analysis must demonstrate that the project will have either a neutral or positive impact on the City or building permits will be withheld." In his opinion, the City should enact such an ordinance that would cover every development; to single out his project was not appropriate. He suggested that since there was a General Plan policy regarding this matter, it should be put into the Zoning Ordinance. Cm. Zika verified that there was a General Plan policy and agreed with Mr. Gleason's suggestion. Cm. Burnham asked Staff if, at the end of three years, the Tentative Map could be extended again, if needed. Ms. Cirelli responded that the Subdivision Map Act and our City Ordinance only allowed for a one-time extension. Mr. Carrington clarified that the Subdivision Map Act was very clear in allowing only one 3-year extension. After that, the Applicant would need to re-apply with a new map and Environmental Impact Report. Cm. Zika closed the public hearing. Burnham, and with a vote of 4-0, the Planning Commission adopted RESOLUTION NO. 93-003 APPROVING TENTATIVE MAP 5926 EXTENSION CONCERNING PA 92-080 DONLAN CANYON SUBJECT: PA 92-081 Dublin Honda Conditional Use Permit/Site Development Review request to expand the existing auto dealership facility by locatinq additional service stalls, - retail (parts), storage and office uses in the existing buildinq located at 7159 Amador Plaza Road with minor parkinq lot and buildinq modifications and to voluntarily contribute traffic improvement funds in the amount of $5,750. Ms. Cirelli presented the staff report and indicated that Staff recommended approval of the application request subject to the conditions specified. Cm. Zika asked on what the Traffic Impact Fee was based. Ms. Cirelli responded that the fee was based on the amount of additional square footage. Cm. Zika asked if the fee was comparable to the fee charged to the Ford Dealership's expansion. Ms. Cirelli indicated that the fee was comparable. Ken Harvey, the Applicant, referred to condition #36 regarding the existing fuel station and indicated that the fuel station would be removed rather than covered; however, the removal may not happen before the approval of the project. He added that they would discontinue use of the pump immediately. Commissioners and Staff discussed the enforcement of the request and decided to meet with Public Works to discuss allowing the tank to remain uncovered temporarily. Cm. Zika suggested a six-month time limit to remove the tank, in conjunction with pulling the pump out before removing the tank. Mr. Harvey indicated that, due to monetary constraints, 6 months may not be enough time. Cm. North expressed concern with fuel spills and suggested that the pump be inactivated or covered. Cm. Zika wondered how long the EPA would let an unused tank remain without pulling it out. Regular Meeting PCM-1993-7 February 16, 1993 [2-16min] Mr. Carrington stress~d the importance of coordii'~ating with the Alameda County Department of Health Services; the process could become very complex. Cm. Burnham suggested that the condition of approval indicate that, upon completion of this project, the fuel station would be inactivated and would be covered or removed within a set time frame. Cm. North recommended the Planning Director and Public Works Department come up with an agreeable compliance time frame. Mr. Harvey will work with the Planning Department, Public Works Department and Alameda County Environmental Health Department prior to issuance of building permits and establishment of use. Mr. Harvey then referred to condition #37 regarding the existing car wash area and indicated that the condition was not needed since another off-site location was used. Ms. Cirelli in~icated that Public Works would enforce the condition prior to issuance of building permits and compliance would not be needed if the Applicant could prove the existing on-site car wash was not used. Cm. Zika closed the public hearing. On motion from Cm. Rafanelli, seconded by Cm. North, and with a vote of 4-0, the Planning Commission adopted RESOLUTION NO. 93-004 APPROVING PA 92-081 DUBLIN HONDA CONDITIONAL USE PERMIT REQUEST TO ALLOW THE EXPANSION OF AN EXISTING AUTO DEALERSHIP WITH OUTDOOR STORAGE IN THE C-2, GENERAL COMMERCIAL DISTRICT, LOCATED AT 7099 AND 7159 AMADOR PLAZA ROAD RESOLUTION NO. 93-005 APPROVING PA 92-0$1 DUBLIN HONDA SITE DEVELOPMENT REVIEW APPLICATION TO CONSTRUCT PARKING LOT AND BUILDING MODIFICATIONS AND TO VOLUNTARILY CONTRIBUTE TRAFFIC IMPROVEMENT FUND5 IN THE AMOUNT OF $5,750.00, LOCATED AT 7099 AND 7159 AMADOR PLAZA ROAD UNFINISHED BUSINESS None OTHER BUSINESS None COMMISSIONER'S CONCERNS Cm. Burnham asked Staff about the status of the request to have the ordinance regarding the Enea Properties cul-de-sac and the possibility of applying residential laws to commercial projects. Regular Meeting PCM-1993-8 February 16, 1993 [2-16min] ~ i , ~ . y Mr. Carrington stated that, in Mr. Tong's opinion, residential standards were not being applied to the commercial projects, and the ordinance was properly applied to a commercial project. Cm. Burnham questioned the process of the appointment for a new planning commissioner. Mr. Carrington indicated that the Planning Commission had decided to wait for the City Council to appoint a new Commissioner. Cm. North mentioned the Wayne's Gun Shop van had flat tires again.
