A regular meeting of the City of Dublin Planning Commission was held on November 7, 1994, in the Dublin Civic Center Regional Meeting Room. The meeting was called to order at 7:30 p.m. by Commissioner Northo * * * * * * * * * * ROLL CALL Present: Commissioners Burnham, Geist, North, and Zika; Laurence L, Tong, Planning Director; Dennis Carrington, Senior Planner; Ralph Kachadourian, Assistant Planner; and Fawn Holman, Recording Secretary. Absent: Commissioner Rafanelli * * * * * * * * * * PLEDGE OF ALLEGIANCE TO THE FLAG Cm. North led the Commission, Staff, and those present in the pledge of allegiance to the flag. * * * * * * * * * * ADDITIONS OR REVISIONS TO THE AGENDA The minutes of the October 3, 1994, meeting were approved as submitted. * * * * * * * * * * ORAL COMMUNICATIONS None * * * * * * * * * ~ WRITTEN COMMiJNTCATIONS None * * * * * * * * * * PUBLIC HEARING SUBJECT: PA 94-046 Cuttin' Up Salon Massage Establishment Conditional - Use Permit request for the establishment of a massage service within an existing beauty salon located at 6982 Village Parkwayou Cm. North opened the public hearing and asked for the staff report, Mr. Kachadourian presented the staff report, indicating that Staff recommended approval of the Conditional Use Permit request to allow a Regular Meeting PCM-1994-111 November 7, 1994 [11-7min] massage establishmen•and use, sub°ect to the co~itions of a roval J PP specified in draft resolution, Exhibit B. Cm. Zika asked if there were any problems with the other massage establishment in Dublin. Mr. Kachadourian indicated no. Cm. Burnham commented that the approval process for the existing massage establishment located on Dublin Boulevard which included police reports, was much more complicated, and wondered why this project was so uncomplicated. Mr. Kachadourian indicated that the Police Department felt the proposed project posed no problems Cm. North asked the Applicant for comments. Linda Marie Peixoto, the Applicant, agreed with the conditions of approval. Cm. North asked the Applicant if she had already obtained the police permit for massage use, or was she waiting for Planning Commission approval. Mss Peixoto indicated that she had already applied for the police permito however, the Police Department was waiting for Planning Commission approval before issuing the permita Cm. North closed the public hearing. On motion by Cm. Zika, seconded by Cm. Burnham, and with a vote of 4-0, the Planning Commission adopted PA 94 - 031 APPROVING PA 94-046 CUTTIN' UP SALON MASSAGE ESTABLISHMENT CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A MASSAGE ESTABLISHMENT WITHIN AN EXISTING BEAUTY 3ALON FACILITY LOCATED AT 6982 VILLAGE PARRS~TAY * * * * * * * * * * NEW OR UNFINISHED BUSINESS SUBJECT: PA 94-003 Harrison's Marine Center Boat Sales and Storaae Facility Conditional Use Permit Time Extension request located at 5933 Dougherty Road. Cm. North asked for the staff report. Mr. Kachadourian presented the staff report, indicating that Staff felt the Applicant had done an outstanding job improving and cleaning up the site and recommended approval of the one-year time extension requeste Cm. North asked if the Applicant was present. Regular Meeting PCM-1994-112 November 7, 1994 [11-7min] ~ . i • Mr. Kachadourian indicated that the Applicant was out of state; however, the applicant had asked Staff to relay their need for the time extension, which would allow them the needed time to located a permanent site in Dublin. Cm. North clarified that the Applicant was requesting an extension which would end February 17, 1996. Mr. Kachadourian agreed with the clarification. Cm. Burnham asked why the Applicant would look for another site if they were doing so well at the existing location. Mr. Kachadourian indicated that the Applicant's needed a larger site, approximately 22-3 acres, because they would also be relocating their existing Oakland facility to Dublin. Cm. Zika expressed pleasure that the Applicant requested the time extension before the application expired and was also pleased at the improvements the Applicant had made to the existing site without complaint. Therefore, although it was his habit to vote against a request if the Applicant was not present, he would vote in favor of the time extension request. Cm. North was pleased that the Annual Review Inspection Form was included in the staff report, indicating that it was very helpful. On motion by Cm. Geist, seconded by Cm. Zika, and with a vote of 4-Os the Planning Commission approved the request for a one-year time extension, until February 7, 1996, of the approved Conditional Use Permit for the boat sales and storage facility located at 5933 Dougherty Road. * * * * ~ * * * * * OTHER BUSINESS (Commission/Staff Information Only Reports~ Cm. Burnham referred to the letter from the Police Department regarding the commercial truck which parked in the Chuck E Cheese parking lot, and asked if it meant that the City's hands were legally tied. 1Kr. Tong indicated that the City could pursue the matter with the property owner. However, the property owner would need to post the necessary signage per the Vehicle Code, which i.ndicated that it was private property and unauthorized vehicles would be towed. It would be up to the property owner to have an illegally parked vehicle towed off site. Cm. North commented that the qun shop truck had been moved over the weekend and hoped it would stay away. Mr. Tong indicated that LAFCo would hold a public hearing on November lOth, at 4:30 p.m., regarding the Eastern Dublin Annexation #1. Regular Meeting PCM-1994-113 November 7, 1994 [11-7min] Mr. Tong then introduced Jeri Ram the new Associate Planner in Current Planning, who was involved in processing the Homart application. Commission welcomed Ms. Ram to the Planning Staff. Mr. Tong also introduced Gaylene Burkett as the new Planning Secretary. Ms. Burkett would replace Fawn Holman, who planned to return to college. . Cm. Zika asked Ms. Holman if she had already returned to school. Ms. Holman indicated she had already begun classes and planned to graduate from UC Hayward with a BA in Environmental Studies, with an option in Land Use Planning and Management.
