Regular Meeting - May 16, 1994
A regular meeting of the City of Dublin Planning Commission was held
on May 16, 1994, in the Dublin Civic Center Council Chambers. The
meeting was called to order at 7:30 p.m. by Commissioner North.

Cm. North led the Commission, Staff, and those present in the pledge

PUBLIC HEARING
SUBJECT: PA 93-062 City of Dublin Siqn Ordinance Revision Project
proposal to amend the Zoninq Ordinance pertaining to the
requlation of siqns (continued from the 5/16/94 Plannina
Commission meetina - to be continued to the 6/6/94 Planning
Commission meetina).
Cm. North indicated that Staff recommended that the Commission
continue this item to the June 6, 1994, Planning Commission meeting in
order to provide time for the City Attorney's comments to be
incorporated into the document and delivered to the Commission in a
timely manner.

Cm. Z~ka noted that he would not be present for the June 6th meeting.
Cm. Downey suggested the meeting be delayed until the June 20, 1994,
Planning Commission meeting in order to have all commissioners
present.
With a unanimous vote from the Planning Commission, this item was
continued to the June 20, 1994, Planning Commission meeting.
SUBJECT: PA 94-015 Zoninq Ordinance Amendment Study to the PD
(Planned Development) District Provisions of the Dublin
Zoning Ordinance.
Cm. North opened the public hearing and asked for the staff report.
Ms. Carol Cirelli, Senior Planner, presented the staff report,
indicating that Staff recommended that the Planning Commission adopt
Draft Resolution Exhibit B recommending City Council adoption of
PA 94-015 Dublin Zoning Ordinance Amendment.
Cm. North asked if an environmental study would be needed for the
initial zone change.
Ms. Cirelli indicated that the EIR done for the Eastern Dublin project
would suffice.
Cm. North clarified that when the first planned development was
submitted, an environmental review would have to be done on that
particular development.
Mr. Tong indicated that each Land Use and Development Plan would have
to be reviewed on its own.
Bob Harris, Eastern Dublin property owner representative, expressed
concern with Section 8-31.2d) and suggested that the word "change" be
replaced with "Land Use and Development Plan". After a Land Use and
Development Plan had been reviewed, if no action had taken place in
two years, the City could review the Land Use and Development Plan
instead of just reviewing the zoning on the property.
Mr. Harris also asked for clarification to the sentence of the revised
Section 8-31.16 which read, "The initial Planned Development District
zoning shall include provisions sufficiently detailed to be found
consistent with the polices of the General Plan of the City of
Dublin."
Cm. North referred to Mr. Harris' first concern regarding Section 8-
31.2d), indicating that if no application was submitted during the
first two years, the Commission may look at it again in case there
were changes in the zoning that had taken place during that two years.
That way the zoning would not have to be changed with the first
project.
Mr. Tong indicated that this holdover from the County ordinance had
come into effect on at least one planned development where the

Applicant was not ready to move forward with actual construction
within the two-year time frame. At that point, the Planning
Commission reviewed the item, heard the Applicant's reasons why the
project was not ready to move forward, and the Commission acknowledged
the information with no actual change to the zoning district. It did
not require an automatic change and did not mean there was an
expiration to the zoning; it simply meant there was another review
time period. The Planning Commission and the Council always had the
discretion to review the zoning, which did not have to take place at
two years.
Mr. Harris suggested that once a development plan was approved for a
piece of property (or a portion of the property), the two-year review
should go into effect, and two years after that the development plan
should be reviewed.
Commission and Staff discussed the two-year review and indicated that
the review was not automatic; it was only subject to review, if Staff
determined the need.
Mr. Tong referred to the question regarding the revised Section
8-31.16, indicating that a portion of the section was a reiteration of
the new Section 8-31.2c), in order to clearly make the finding of
consistency with the first planned development zoning and the general
plan.
Mr. Harris asked how much more information would need to accompany the
application in order to make it consistent with the general plan.
Mr. Tong indicated that ~he Applicant would need to show that the
initial PD District zoning, in terms of land use policies and
provisions, were consistent, and in enough detail, with the specific
plan and general plan (primarily the land use policies).
Cm. North closed the public hearing.
On motion by Cm. Zika, seconded by Cm. Rafanelli, and with a vote of
5-0, the Planning Commission adopted
RESOLUTION NO. 94-014
RECOMMENDING ADOPTION OF PA 94-015 ZONING ORDINANCE AMENDMENT RELATING
TO THE PD (PLANNED DEVELOPMENT) DISTRICT PROVISIONS

NEW OR UNFINISHED BUSINESS
SUBJECT: General Plan Conformity for the Alameda County Sheriff's
Department Office of Emergency Services located on the
Alameda County Santa Rita Jail site, at the northwest corner
of Madigan Road and Broder Boulevard intersection.

Ms. Cirelli presented the staff report, indicating that Staff
recommended approval of the draft resolution finding that the County's
proposed construction of the Alameda County Sheriff's Department
Office of Emergency Services building on the 5anta Rita Jail site was
in conformance with the Dublin General Plan.
Cm. Zika asked if the San Leandro facility would be closed.
Mr. Tong indicated the San Leandro facility would be relocated to the
Santa Rita site.
Cm. Downey asked if there would be enough on-site parking to
accommodate all facility activity.
Cm. North pointed out that the facility would be primarily used for
communications and speculated that no more than 60 people would be on-
site at any given time.
Cm. North then asked if there had been coordination with Public Works
and Dougherty Regional Fire Authority to provide services on-site.
Mr. Tong indicated that, as per a previous agreement with the County,
the Sheriff's Department would provide their own police services. The
facility was also covered by a master agreement with DRFA.
Cm. North advised that a DRFA fire truck would have difficulty
reaching the facility in a timely manner and suggested that one of
Pleasanton's fire departments might reach the facility more quickly.
Mr. Tong indicated that Camp Parks and DRFA had been discussing the
possibility of DRFA servicing all of Camp Parks. As part of the
implementation of the Eastern Dublin General Plan Amendment and
Specific Plan, there were provisions for reviewing additional fire
station locations.
Cm. North pointed out that those stations may be a long time in coming
and reiterated his concern about the possible delay in response time
for fire services.
On motion from Cm. Rafanelli, seconded by Cm. Downey, and with a vote
of 5-0, the Planning Commission adopted
RESOLUTION NO. 94-015
REPORT BY THE CITY OF DUBLIN PLANNING COMMISSION AS TO THE CONFORMITY
OF LOCATION, PURPOSE AND EXTENT OF THE PROPOSED CONSTRUCTION OF THE
AT.AMEDA COUNTY SHERIFF'S DEPARTMENT OFFICE OF EMERGENCY SERVICES WITH
THE DUBLIN GENERAL PLAN
Cm. Zika asked what would happen if the Commission decided the plan
was not in conformity with the general plan.
Mr. Tong indicated that the County would be made aware of the City's
opinion; however, State law did not require they be in conformity with
a city's general plan.

OTHER BUSINESS (Commission/Staff Informational Only Reports)
Cm. Zika indicated that Levitz Furniture, which had recently moved out
of town, had parked their trucks across the street in the parking lot
in front of the bowling alley for at least two weeks. He asked Staff
if that was legal.
Mr. Tong indicated that he would have the Zoning Investigator look
into the situation.
Cm. North indicated that two citizens had asked him when the trees
which had been removed for the new Burger King would be replaced.
Ms. Cirelli indicated that all of the trees Burger King was required
to put in, according to their approved plan, have been planted. She
speculated that the concerned citizens may have been talking about the
trees which were removed to accommodate Home Express.
Cm. North asked that the project planner check to see if Burger King
was in compliance with their approved plans.
Ms. Cirelli advised that Staff had verified compliance prior to
issuance of final occupancy.
Cm. North requested that Staff review the conditions of approval for
the number and size of replacement trees required and call him with
the verification.
Cm. Zika asked when the trees removed by Home Express would be
replaced.
Mr. Tong indicated that Home Express would replace the removed trees
with 21 Honey Locust trees, which had a thinner canopy that would not
block the visibility of signage or tear up the asphalt.
Cm. North asked what type of approval process Home Express went
through.
Mr. Tong indicated that the project was approved through Site
Development Review, which was a Staff action.
Cm. North indicated that he had two citizens ask him why Home Express
could do such major modifications without going before the Planning
Commission.
Mr. Tong advised that the Planning Director had always had the
authority to take action on Site Development Reviews and, as part of
that discretion, Staff processed the SDR for Home Express.
Cm. Downey expressed concern regarding water seepage delaying the
Village Parkway repaving project.

Mr. Tong indicated that, at the May 9th City Council meeting, the
Council adopted a budget adjustment to authorize the extra monies
needed to complete the repair work.
Cm. Burnham, returning to the subject of Burger King, suggested that
stop signs be installed where the parking lot roadway parallel to
Dublin Boulevard intersected with the parking lot entrance off Dublin
Boulevard. He expressed concern regarding the confusion as to which
car had the right-of-way.
Cm. Burnham then indicated that two citizens had called him with
concerns regarding a very poorly maintained home on Beverly Court and
requested that the Zoning Investigator complete a zoning violation
investigation. He expressed concern regarding the possibility of a
fire hazard due to the height of the weeds and the abundance of debris
in the back yard.
Mr. Tong indicated that a citizen complaint had been made regarding
the house on Beverly Court, and the Zoning Investigator would
investigate a possible property maintenance violation.
