TO: Honorable Mayor and City Councilmembers FROM: ~ Joni Pattillo, City Manager SUBJE : Authorization to Solicit Bids - Contract No. 11-02, Fiscal Year 2010-2011 Annual Sidewalk Safety Repair Program and Curb Ramp Installation. Prepared By: Ananthan Kanagasundaram, Assistant Civil Engineer EXECUTIVE SUMMARY: Contract No. 11-02 is proposed to complete improvements identified in two Capital Improvement Projects. The Annual Sidewalk Safety Repair Program (CIP No. 949102) will remove and replace approximately 3,900 square feet of sidewalk with offsets of 3/4-inch or more that may pose a tripping hazard. Replacement of sidewalks and associated improvements on Village Parkway at Dublin High School are also included in this project. The Americans with Disabilities Act (ADA) Transition Plan (CIP No. 939102) will complete the installation of 11 curb rarrips as well as modifications to the Frederiksen School pedestrian entrance. - FINANCIAL IMPACT: The total budgets for the projects include project design, inspection and administration, related contract services and improvements. • For the Annual Sidewalk Safety Program (CIP No. 949102), the total appropriation is $193,790. Of this amount $155,400 is included for improvements and necessary tree removal services as part of Contract No. 11-02 proposed to be bid ($85,400 is funded by the General Fund which includes a$35,000 grant from Dublin Unified School District, and $70,000 from Measure B Bicycle / Pedestrian Funds). • For the ADA Transition Plan (CIP No. 939102), the total appropriation is $49,650. Of this amount $47,850 is budgeted for improvements as part of Contract No. 11-02 proposed ' to be bid. Administrative Services Director Assistant City Mar-ager The Annual Sidewalk Safety Repair Program (remove and replace) repairs sidewalk offsets of 3/4-inch or more that may pose a tripping hazard. The remove and replace process is used in locations where the offset is more significant or where tree roots are causing the offset. This procedure requires the removal of the existing sidewalk and., in the case of root problems, removaf of the tree roots, and then replacement of the concrete sidewalk. While maintenance of sidewalks and other frontage improvements is legally the responsibility of the adjacent private property owner, the City Council has adopted a City-funded sidewalk repair program on a year-by-year basis since 1983: The City Council extended funding for the City- paid repair program for an additional year in the Fiscal Year 2010-11 budget. The City Council, in adopting the policy for the repair of public improvements deemed to be potential pedestrian hazards, accommodates property owners who find it difficult to hire their own contractors to make necessary sidewalk repairs or replacements. This policy will be in effect for Fiscal Year 2010-2011 and thereafter be reviewed for extension, modification, or replacement. This policy is adopted every year as part of the annual Sidewalk Safety Repair Program. Staff recommends that the City Council adopt the proposed resolution (Attachment 1) establishing the policy. On October 5, 2010, the City Council approved the cooperative agreement between the City of Dublin and the Dublin Unified School District for the design and replacement of a sidewalk and associated improvements on Village Parkway at Dublin High School. As part of the agreement, the Dublin Unified School District has contributed $35,000 toward the cost of design and construction of improvements. This year's Sidewalk Safety Repair Program will also include the construction of approximately eleven (11) pedestrian curb ramps, replacement of sidewalks and associated improvements on Village Parkway fronting Dublin High School and; Frederiksen School pedestrian access improvements. This work at the two schools is being included with the Annual Sidewalk Safety Repair Program since the work is similar type work and combining the projects will be a cost- savings due to economy of scale. PASSED, APPROVED AND ADOPTED this 15th day of March, 2011, by the following vote: AYES: NOES: ABSENT: ABSTAIN: ATTEST: City Clerk G: ICIPISIDEWALK12010-20111RES0 policy.DOC Mayor ~r,~ / " I ~~ I ' ATTACHMENT 1 ~ ~~~ EXHIBIT "A" OF RESOLUTION -ll POLICY FOR THE CITY OF DUBLIN ANNUAL SIDEWALK SAFETY REPAIR PROGRAM Fiscal Year 2010-2011 It is the policy of the City of Dublin to cause repairs to be made to certain public improvements for the safety of the general public under the following guidelines. Improvements Included: Public improvements included under this program shall be limited to those improvements which may constitute a potential tripping hazard to pedestrian traffic such as curbs, gutters, driveways, and sidewalks. Need: Where these improvements have settled, heaved and/or cracked and offset such as to represent tripping hazards as identified by the Public Works Director, or a representative, these improvements shall be replaced. Responsibility: Where it is apparent that the damage to improvements has been caused by natural causes, such as tree roots, utility trench settlement, or soil heaving, the City of Dublin will pay for the cost of repair. Where it is apparent that the property owner fronting the damaged improvement has caused the damage, such as driving vehicles into a side yard, the property owner shall be responsible for the repair. The Public Works Director shall establish a procedure whereby the property owner will be notified of the needed repair, and if not done in a specified reasonable time, the Public Works Director shall cause the repair to be made and the cost of the repair, together with reasonable administrative costs, shall become a lien against the property. Time Limit of Policv: This policy shall be in effect for Fiscal Year 2010-2011 and thereafter be reviewed for extension, modification, or replacement. Legal Responsibilitv: The City of Dublin, in adopting this policy, does so as an accommodation to property owners who find it difficult to hire their own contractors to make these necessary sidewalk repairs. The City will let one contract for the 2010-2011 Fiscal Year and repair those defective sidewalks which have been brought to the attention of the City by the property owners (or others), and that have an offset of over three-quarters of an inch (3/4") measured vertically, within the budget available to do so. The existence of this program does not abrogate the responsibility of the property owners to maintain their frontage improvements in a safe manner under Section 5610 of the California Streets and Highways Code. Property owners and persons in possession of property are required to maintain adjacent public sidewalks in a safe condition per Dublin Municipal Code Section 7.04.420 of Article 4, Chapter 7.04 of Title 7.
