RE: AvalonBay Site C Unit Count

As requested by AvalonBay, this letter is provided as confirmation that the ACSPA
has agreed to transfer an additional 1 9 units fi•om its current entitlement o f t 50 units
on Site A- l to Site C. This is in addition to the 81 units previously transferred from
Site A-1 to Site C, per the attached letter from Pat Cashman to you, dated June 22,
2010.
ACSPA is entitled, per the Dublin Transit Center General PlaniSpecific Plan
Amendment and Stage I PD Rezoning, to transfer units fi-om one site to another. as
long as the total unit count of 1,800 units is not exceeded.
With this transfer of an additional 19 units to Site C, the unit allocations are: 1 3 I units
to Site A-I (ACSPA), 1 12 units to Site A-2 (EAH), 190 units to Site A-3 (Hanover),
257 units to Site B-1 (DR Horton), 305 units to Site B-2 (AvalonBay), 505 units to
Site C (AvalonBay), and 300 units to Site E-1 (DR Horton), for a total of 1,800 units.

10 6-13:;3>.: As a follow up to our June 8, 2010 meeting regarding the basis for AvalonBay
increasing its application for Site C from 405 to 486, this letter is provided as
confirmation that the ACSPA has agreed to transfer the additional 81 units
from its current entitlement of 231 units on Site A-1. The remaining
entitlement of 231 units on Site A-1 was the balance of the 1800 units
designated for the Dublin transit Center. ACSPA is entitled, per the 2001
General Plan/Specific Plan Amendment and Stage I PD Rezoning, to transfer
units from one site to another, as long as the total unit count is not exceeded.
Given the transfer of an additional 81 units to Site C The unit allocations are;
150 units to Site A-1 (ACSPA), 112 units to Site A-2 (FAH), 190 units to Site
A-3 (Hanover), 257 units to Site B-l (DR Horton), 305 units to Site B-2
(AvalonBay), 486 units to Site C (AvalonBay), and 300 units to Site E-1 (DR
Horton), for a total count of 1800 units.
