SUBJECT: Acceptance of Improvements Associated with Tract 7524 "The Terraces",
Neighborhood H-2 (Phase 2) Dublin Ranch Area G (Toll-Dublin, LLC)

EXECUTIVE SUMMARY:
Toll-Dublin, LLC recently completed improvements associated with Tract 7524, "The Terraces',
Neighborhood H-2 (Phase 2), Dublin Ranch Area G. Tract 7524 is located east of Tassajara
Road, north of Dublin Boulevard, west of Keegan Street, and south of Maguire Way within the
southeast corner of Area G of the Dublin Ranch Development. The project includes four 4-story
multi-family buildings constructed over two levels of subterranean parking, along with
associated grading, driveways, and landscaping. Since the improvements have now been
completed, it is appropriate to accept the improvements and release the bonds that guaranteed
the work.
FINANCIAL IMPACT: -
Toll-Dublin, LLC has provided a Maintenance Bond in. the amount of $43,597.50 (Bond No.
6596274) to replace the Performance and Labor and Materials Bonds that guaranteed the
improvements. The Maintenance Bond wilt guarantee ,against defects for one year. The garage
and private on-site .common areas will be maintained by the Dublin Ranch Terraces Owners
Association.
RECOMMENDATION:
Staff recommends that the City Council adopt the Resolution Accepting the Improvements for
Tract 7524 (Neighborhood H-2, Phase 2, Dublin Ranch Area G)

DESCRIPTION:
Toll-Dublin, LLC, recently completed improvements associated with Tract 7524, Neighborhood
H-2 (Phase 2), Dublin Ranch Area G. Tract 7524 is located east of Tassajara Road, north of
Dublin Boulevard, west of Keegan Street, and south of Maguire Way within the southeast
corner of Area G of the Dublin Ranch Development. The work consisted of two levels of
subterranean parking underlying 4-story condominium buildings. The work was governed by an
Improvement Agreement executed on October 5, 2004 via City Council Resolution No. 198-04.
Since the improvements have been constructed .pursuant to the Improvement Agreement and
to the satisfaction of the Public Works Director, it is appropriate for the improvements to now be
accepted by the City for permanent maintenance by the Dublin Ranch Terraces Owners
Association.
At the time the City and Toll-Dublin, LLC executed the Improvement Agreement, the developer
provided Performance 'and Labor and Materials Bonds each in the amount of $174,390.00 for
site improvements to guarantee performance of the work, and Performance and Labor and
Materials Bonds each in the amount of $75,000.00 as security to guarantee repair of the
adjoining public streets as needed due to the ongoing building construction. Now that the work
is complete, these bonds may be released in accordance with the authority contained in
§66499.7 of the Government Code. The site improvement bonds need to be replaced with a
Maintenance Bond in an amount necessary to guarantee the work for aone-year period
following acceptance; the street repair bonds may be released without a warranty bond since no
damage has occurred and the building construction has ended. The developer has provided a
Maintenance Bond in the amount of $43,597.50, which is 25% of the original Performance Bond
for the site improvements, and which is sufficient to guarantee the improvements for aone-year
period after acceptance.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
A copy of the staff report will be provided to Toll-Dublin LLC.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING THE IMPROVEMENTS FOR
TRACT 7524 (NEIGHBORHOOD H-2, PHASE 2, DUBLIN RANCH AREA G,)
WHEREAS, the subdivider of Tract 7524, filed on November 5, 2004, in Book 277 of
Maps at Pages 95 - 97, previously entered into two Improvement Agreements with the City of
Dublin to improve said Tract in accordance with plans and specifications on file.with the Public
Works Director, said Tract
identified as follows:
a) Subdivider: Toll-Dublin, LLC, a California Limited Partnership
b) Tract Location: West of Keegan Street, south of Maguire Way
and
north of Dublin Boulevard
c) Tract Size: 2 Lots, 626 Multi-Family Units
d) Resolution Approving Agreement: No. 198-04, City of Dublin City Council
e) City Streets Affected: None
WHEREAS., the onsite Grading Improvements associated with Tract 7524 governed by
one of the two agreements was previously accepted by the City Council via Resolution No. 144-
07 on August 7, 2007; and
WHEREAS, the onsite Improvements associated with Tract 7524 governed by the
second of the two agreements are complete in accordance with said plans and specifications,
and any approved modifications thereto, to the satisfaction of the Public Works Director; and
WHEREAS, the original improvement Performance Bonds and Labor and Materials
Bonds that guaranteed the Improvements can be released, in accordance with the authority
contained in §66499.7 of the Government Code of the State of California, and replaced with a
Maintenance Bond to guarantee the completed work for a one-year period following
acceptance;
NOW, THEREFORE,~BE IT RESOLVED that:
1. The improvements completed within said Tract are hereby approved and
accepted subject to a one-year guarantee period; and
2. The original Performance Bond issued by Safeco Insurance Company of America
in the amount of $75,000.00 (Bond No. 6294111) for street repairs be released;
and
3. The original Labor and Materials Bond issued by Safeco Insurance Company of
America in the amount of $75,000.00 (Bond No. 6294111) for street repairs be
released; and ~

released; and
5. The original Labor and Materials Bond issued by Safeco Insurance Company of

improvements be released; and
6. The submitted Maintenance Bond issued by Safeco Insurance Company of
America in the amount of $43,597.50 (Bond No. 6294095M) be accepted as
security for the aforesaid one-year maintenance period, said period to commence
on this date and terminate on the 5th day of April, 2012.
