Approval of Final Map for Tract 7540, Silvera Ranch Phase 4 (KB Homes), and Acceptance of Parkland Dedication In -Lieu Fees Prepared By. Mark Lander, City Engineer EXECUTIVE SUMMARY: KB Homes, dba KB Home South Bay, Inc., has purchased Tract 7540, Silvera Ranch Phase 4 from Pinn Brothers Fine Homes, dba Pfeiffer Ranch Investors II, Inc., and is filing the Final Map to create 44 individual lots for the construction of homes on these lots. FINANCIAL IMPACT: KB Homes previously provided Performance and Labor & Materials Bonds to guarantee construction of the street, grading, utility improvements and landscaping, and will pay the cost of construction inspection. These improvements are under construction and the bonds remain in place. Therefore, additional security will not be required as part of this map. Once these improvements are accepted, the City will incur maintenance costs for City -maintained improvements within Tract 7540. The Homeowners' Association will be responsible for maintaining the project -related landscape features within the public right-of-way. Community Parkland and Neighborhood Parkland dedication requirements are proposed to be satisfied through payment of in -lieu fees ($414,348 Community Park and $225,544 Neighborhood Park). The Final Map for Tract 7540 has been reviewed and found to be in conformance with the Tentative Map and Conditions of Approval adopted by Planning Commission Resolution No. 03-48 on September 23, 2003. KB Homes had previously executed an Improvement Agreement in December 2010 for the tract improvements and guaranteed the improvements through bonds.. For this City Council action, KB Homes is only securing approval of the Final Map and there is no need to execute an Improvement Agreement or provide bonds with Tract 7540, because the bonds are already in place. The resolution approving the final map is attached (Attachment 2). Parkland Dedication Requirements Pursuant to Dublin Municipal Code Chapter 9.28, a subdivider is required to dedicate park land or pay a fee in lieu of dedicating such land as a condition of final map approval. KB Homes is proposing to use a cash payment to satisfy its Community Parkland and Neighborhood Parkland dedication obligation. The following table shows how KB Homes will satisfy the Parkland requirements for Tract 7540: Dedication Fees In-Lieu of KB Homes Requirement Dedication Compliance Community Parkland 0.4928 $414,348 $414,348 fee payment Neighborhood Parkland 0.2112 $ 225,544 $225,544 fee payment The calculation of the dedication requirements and/or in-lieu fees is determined in accordance with City of Dublin Municipal Code Chapter 9.28. Staff has prepared a Resolution which outlines the requirements and how KB Homes will achieve compliance (Attachment 3). NOTICING REQUIREMENTS/PUBLIC OUTREACH: Public noticing occurred as part of the Tentative Map process. Approval of the. AYES: NOES: ABSENT: ABSTAIN: Mayor ATTEST: City Clerk G:\DEVELOPMENT, PRIVATE\Silvera Ranch\Phase 4, Tract 7540\KB Homes\Reso FM 7540.doc ATTACHMEN r T -1 i~ RESOLUTION NO. - 11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN ACCEPTING PARK LAND DEDICATION IN-LIEU FEES PARK LAND DEDICATION REQUIREMENTS FOR TRACT 7540, SILVERA RANCH, PHASE 4 WHEREAS, pursuant to City of Dublin Municipal Code Chapter 9.28, each subdivider of land for residential uses shall, as a Condition of Approval of a Final Subdivision Map, dedicate or reserve lands, pay fees in lieu thereof, or a combination of both, for park and/or recreational purposes; and WHEREAS, the Developer, KB Home South Bay, Inc., is filing Tract 7540 Final Map for developing 44 residential dwelling units constructed on 44 lots; and WHEREAS, the Park Land requirements for the project based on the requirements of the Municipal Code and the designated land use for Tract 7540 are 1) Dedication .of 0.4928 acres of Community Park Land or payment of $414,348 in Community Park Land In-Lieu Fees, and 2) Dedication of 0.2112 acres Neighborhood Park Land or payment of $225,544 in Neighborhood Parkland In-Lieu Fees; and WHEREAS, Developer has satisfied the Community Parkland Dedication requirement through the payment of in-lieu Park Dedication Fees in the amount of $414,348 to fully satisfy the Community Park Land obligation for Tract 7540; and WHEREAS, Developer has satisfied the Neighborhood Parkland Dedication requirement through the payment of in-lieu Park Dedication Fees in the amount of $225,544 to fully satisfy the Neighborhood Park Land obligation for Tract 7540. NOW, THEREFORE, BE IT RESOLVED that the aforesaid the payment of $414,348 Community Parkland in lieu fees and the payment of $225,544 in Neighborhood Parkland in lieu fees are hereby accepted as performance of said subdivider's obligation under Subdivision Requirements in Chapter 9.28 of the Dublin Municipal Code.
