Agreement for Services, outlining scope of work and payment schedule for 12-month.program RECOMMENDATION: _ /~pprove the use of the City's mitigation grant funds to subsidize the /~ A,~r commercial recycling program and authorize the Mayor to execute r ~ ~' the Agreement FINANCIAL STATEMENT: The program will be partially funded by the City of Dublin, through mitigation funding received from the Alameda County Waste Management Authority ($30,295 for a 12 month period). The remaining cost of the program will be covered by rates charged to participants. Sufficient funds are included in the Fiscal Year 2000- 2001 Budget to fund this program. DESCRIPTION: On March 1, 1999, the City entered into an Agreement with Livermore Dublin Disposal (LDD) to develop and implement an Expanded Commercial Recycling Program. The Agreement is for a term of 16 months and is due to expire on June 30, 2000. Staff recommends that the term of the Agreement be extended through June 30, 2001. When the Commercial Recycling Program was expanded in March 1999, there were only 60 businesses participating in the original program that was initiated in August 1996. The original program limited businesses to recycling only specified office paper, in addition to food and beverage bottles, aluminum and metal cans, plastic bottles, corrugated cardboard and newspaper. Office paper, newspaper, and cardboard had to be separated, and placed in three separate bins. The expanded program was designed to increase participation by allowing businesses to recycle a wider variety of paper products and eliminate the need to separate most of the materials. The program currently consists of two components: COPIES TO: Annette Borges,iTEMWasteNOM~ement 1. "Anything That Tears," Which includes envelopes, sticky notes, file folders, junk mail, glossy paper, catalogs, cardboard, newspaper, and paperboard; and 2. "Mixed Container," which includes glass bottles, plastic bottles, and aluminum and tin cans Businesses can choose to participate in either of the components individually, or both. LDD has aggressively marketed the new program. The company has hired an inside sales person to make contacts with all commercial accounts in the City. This individual has sent direct mailings to 399 of the City's 622 commercial accounts, and made 577 phone contacts. The Company also arranges one-on-one appointments with LDD's recycling coordinator, who assesses their waste stream and shows them how their business can save money by participating in the Commercial Recycling Program. When the Agreement was originally signed, Livermore Dublin Disposal projected that 40% of Dublin businesses could be participating by the end of 1999. Based on this participation rate, it was estimated that the program would divert approximately 780 tons of waste from the landfill annually, and bring the City closer to the 50% diversion rate required by the end of the year 2000. As of June 12, 2000, there were 139 businesses participating in the program (22%). While the 40% goal has not been reached, the Company continues to work to add accounts, signing up approximately 1-2 new accounts per week. A recent progress report submitted by LDD (Attachment 1) shows that between March 1999 and March 2000, the program diverted 541 tons from the landfill. Each month the recycling tonnage increases. When the program was initiated in March 1999, the recycling tonnage generated by the program was approximately 17 tons per month. The program now recycles approximately 55-65 tons per month with a steady monthly increase. SCHOOL DISTRICT RECYCLING PROGRAM: As a commercial account, the schools are included in the Expanded Commercial Recycling Program. City Staff and LDD Staff have been working with district representatives to design a program geared more specifically for the schools within the parameters of the Expanded Commercial Recycling Program. Prior to the start of the 1999-2000 school year, the City received a $9,850 grant from the Alameda County Waste Management Authority, which was used to purchase recycling containers for the schools. LDD staff has met with all of the school custodial and administrative staffs to design programs that will work for each individual school. In addition, meetings have been held with many teachers to promote the new program. While there are still improvements to be made, LDD reports that all of the schools are participating in the program. CITY SUBSIDY REQUESTED: An important part of a successful Commercial Recycling Program is to provide financial incentives for businesses to recycle. LDD has developed a rate structure that allows businesses to save money if they recycle enough to reduce their garbage service level. Please note that commercial recycling programs are not part of the current franchise agreement, and the City does not establish the commercial recycling rates. In order to provide an economic incentive for businesses to participate in the program with a lower rate structure, LDD has requested a subsidy from the City (Attachment 2). The Company is estimating that the program will generate $123,420 in revenue in Fiscal Year 2000-2001, based on a rate structure designed to encourage recycling. The cost of the program is estimated to be $153,715 for Fiscal Year 2000-2001. The subsidy requested is for the difference between the projected revenue and expenses, or $30,295. Staff is recommending that the City use mitigation grant funds to provide the subsidy. The City used mitigation grant funds to provide a similar subsidy ($34,511) to the Company for the initial 16-month term of the agreement. In Fiscal Year 1996-1997, the Alameda County Waste Management Authority (ACWMA) began awarding annual mitigation grants to Alameda County Cities. Mitigation funds are those fees collected on imported garbage placed in Alameda County landfills from other counties, such as Contra Costa County and San Francisco County. While there is no guarantee that these grants will be awarded indefinitely, the Waste Management Authority.has committed to awarding the grants annually to all cities in the County through at least Fiscal Year 2000-2001. The following chart outlines grants that the City of Dublin has received in past years: 1997/98 1998/99 1999/00 $33,329 $32,606 $34,784 It is anticipated that the 2000-2001 grant will be similar to the past figures. The mitigation monies received from the ACWMA are considered restricted funds, and must be used for non-residential recycling programs. Staff is only requesting a program extension and commitment of mitigation funds for Fiscal Year 2000- 2001 due to the uncertainty of future mitigation grant funding and potential program improvement recommendations that may come out of the proposed diversion study. In order to extend the term of the Agreement and modify the City's subsidy, an Agreement amendment is required (Attachment 3). This Agreement covers the 12-month period from July 1, 2000 to June 30, 2001. Prior to the end of the Agreement, City staff will evaluate the effectiveness of the program and make a recommendation for future participation and funding. Staff will also know at that time whether the ACWMA intends to continue the mitigation grant program. Our commercial recycling program started with 60 commercial accounts generating 17 tons a month of recyclables. Starting March 1999 through March 2000, LiWrmore Dublin Disposal has sent 399 brochures, made 577 telephone calls and signed agreements with 70 new businesses in Dublin. Presently tho diversion each month is approximately 55 -65 tons. The City of Dublin diverted 541 tons of cardboard and mixed fiber from the landfill. We are signing up at least one to two businesses per week. For the past 1% years Livermore Dublin Disposal has promoted commercial recycling throughout the City of Dublin. The "Anything that Tears" program has been very successful and with a continued sales effort we can improve the diversion numbers for the City of Dublin. With the anticipated increase in commercial and roll-off rates effective July 1'*, 2000, many businesses will be encouraged to start a recycling program. Livermore Dublin Disposal would like to continue to promote the "Anything that Tears" program. We will continue to use an inside sales person to mail the brochures and follow up with telephone calls to new and existing businesses that need recycling services. As of April 30~, 2000 we have recycling accounts with 139 businesses. The City of Dublin has diverted 593 tons of recyc[able materials in the past 14 months with this commercial recYcling program. Livermore Dublin Disposal has estimated the cost of this program for twelve months to be $153,715.00. This cost includes labor, track cost, processing of materials, an inside sales person, brochures and postage. In this cost is a 10% profit margin. The anticipated revenue for recyclable and service fee Is $123,420.00. The difference is $30,295,00. Livermore Dublin Disposal believes this is a program that needs to continue to keep awareness up and commercial customers benefiting by recycling to lower their solid waste costs, Livermore Dublin Disposal is asking for a subsidy of $30,295.00 to continue this program and assist the City of Dublin to meet its recycling goals. if you have any questions or concerns, please do not hesitate to call. SERVICES. Subject to the terms and conditions set forth in this Agreement, CONTRACTOR shall provide to CITY the services described in Exhibit A. CONTRACTOR shall provide said services at the time, place and in the manner specified in Exhibit A. 2. PAYMENT. CITY shall pay CONTRACTOR for services rendered pursuant to this Agreement at the time and in the manner set forth in Exhibit B. The payments specified in Exhibit B shall be the only payments to be made to CONTRACTOR for services rendered pursuant to this Agreement. CONTRACTOR shall submit all billings for said services to CITY in the manner specified in Exhibit B; or, if no manner be specified in Exhibit B, then according to the usual and customary procedures and practices which CONTRACTOR uses for billing clients similar to CITY. 7. NOTICES. The program consists of two components: 1. "Anything That Tears," which includes envelopes, sticky notes, file folders, junk mail, glossy paper, catalogs, cardboard, newspaper, and paperboard 2. "Mixed Container,." which includes glass bottles, plastic bottles, and cans CONTRACTOR may establish collection rates for commercial recycling under the expanded program, with the intent to increase participation by commercial businesses in the City of Dublin. CONTRACTOR will continue to aggressively market the program. CONTRACTOR will retain an inside sales person to make contacts with all commercial accounts in the City of Dublin. This person will send direct mailings to all of the commercial accounts, and will follow up with telephone calls. Businesses can then meet with Waste Management's recycling coordinator, who will assess their waste stream and show them how they can save money by participating in the recycling program. CONTRACTOR will also continue to work with Dublin School District staff regarding the program, and will work with District liaisons to improve participation in the school program within the parameters of the commercial recycling program. CONTRACTOR will provide CITY with monthly Tonnage Reports and two Progress Reports on marketing activity and business participation rates. The Progress' Repons will be submitted to the City by the following dates: 1. October, 31, 2000 2. April 30, 2001 EXHIBIT A PAYMENTSCHEDULE CITY shall pay CONTRACTOR an amount not to exceed the total sum of thirty thousand, two hundred ninety five dollars ($30,295) for services to be performed pursuant to this Agreement. CONTRACTOR shall submit invoices during the term of this Agreement based on the cost for services performed in accordance with the following schedule: $15,148 on November 30, 2000, after CITY receives first Progress Report from CONTRACTOR _$15,147 on May 31, 2001, after CITY receives second Progress Report from CONTRACTOR Invoices will be paid by the CITY within 30 days of receipt from the CONTRACTOR. The total sum stated above Shall be the total which CITY shall pay for the services to be rendered by CONTRACTOR pursuant to this Agreement. CITY shall not pay any additional sum for any expense or cost whatsoever incurred by CONTRACTOR in rendering services pursuant to this Agreement. The services to be provided under this Agreement may be terminated without cause at any point in time in the sole and exclusive discretion of CITY. In this event, CITY shall compensate the CONTRACTOR for all outstanding costs incurred as of the date of written notice thereof and shall terminate this Agreement. CONTRACTOR shall maintain adequate logs, records and timesheets in order to verify costs incurred to date. EXHIBIT B
