FINANCIAL STATEMENT' None.
DESCRIPTION'
On December 12, 1988, the City Council adopted Resolution 149-88, a
Resolution of Intent to Abandon the Western Terminus of Betlen Drive, which
set a public hearing date of February 13, 1989.
The Government Code provides that the City's Planning Commission
consider any right-of-way abandonments from the standpoint of conformance with
the General Plan. At their meeting of February 6, 1989, the Planning
Commission considered the item but continued the discussion to their meeting
of February 21, as they had some questions regarding the use of the property
by DSRSD. Therefore, the City Council's public hearing was continued to the
February 27 meeting in order to allow the Planning Commission additional time
to make the finding of conformance. The Planning Commission did make the
finding of conformance at their meeting of February 21, 1989.
L~ When the rightIOf-way of Betlen Drive was originally dedicated, the
street ended'at the boundary of Tract 2534 (adjoining Valley Christian
Center),q~as shown on Exhibit 3 attached. When Tract 5777, the Pulte Homes
development (Hacienda Heights), developed, the westerly end of Betlen Drive
was constructed as a knuckle cul-de-sac at its junction with Las Palmas Way.
This configuration leaves the remainder of the end of Betlen Drive as excess
right-of-way. The area to be abandoned is approximat~e~lv 0.16 acres.
If the abandonment is approved,.., this excess right-of-way will revert
the ow~-s of the sdjacsnt properties ~- from the cent~l~ so~ah ~o
~omes and from the centerline north to DSRSD. Pulte has stated that they are
not interested in utilizing the property as part of the Hacienda Heights
Development and plan to quitclaim the property to DSRSD.
At the westerr~nost end of the parcel to be abandoned is a small 320+
square foot 5 foot wide "spite strip" parcel which was deeded in fee to the
County and which became the property of the City upon incorporation., This

parcel is proposed to be quitclaimed to DSRSD by the City. A letter from
DSRSD which states that the District Board of Directors has agreed to accept
the parcels subject to improvement by Pulte Homes is attached as Exhibit 6.
DSRSD is interested in using this area as a parking area to service
their water reservoir. The area would not be used to store vehicles or
equipment and would be screened by a six-foot fence. It is anticipated that
this use would not have a negative visual impact on the neighboring
properties. Pulte Homes is installing the f~nce, as well as landscaping along
the street frontage of this parcel.
Following adoption of the Resolution of Intent, Staff contacted public
utilities and received requests for easements from PG&E, Pacific Bell, and
Viacom Cablevision. Copies of their letters are attached, and these requests
are incorporated into the Resolution. In addition, the City is reserving an
easement for a short run of storm drain.
In compliance with the provisions of the Government Code, the Resolution
of Intent has additionally been published and posted 15 days prior to this
hearing date.
Staff recommends that the City Council conduct a public hearing, adopt
the Resolution Abandoning the Western Terminus of Betlen Drive, subject to the
easements requested by the utilities and by the City, and adopt the Resolution
Approving Quitclaim Deed for Parcel 2.

RESOLUTION NO. -89
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN
A RESOLUTION VACATING A PUBLIC STREET
WESTERN TERMINUS OF BETLEN DRIVE
Recitals
The City Council of the City of Dublin on December 12, 1989, adopted its
Resolution of Intention No. 149-88 to vacate a portion of Betlen Drive
(western terminus, westerl~ of Las Palmas Way), a public street in the City of
Dublin, as hereinafter described.
The City of Dublin Planning Commission considered the proposed vacation
on February 6 and February 21, 1989, and found that the proposed vacation of
this portion of Betlen Drive is in conformance with the City's General Plan.
A public hearing was set for February 13, 1989, and continued to the
meeting of February 27, 1989, at which time any person objecting to such
vacation was given the opportunity to appear and show cause why such vacation
should not be ordered, and notice of such meeting was duly published and
posted.
Such hearing was held by the City Council on February 13, 1989, and
continued on February 27, 1989, and the City Council at the time of such
hearing determined that said portion of Betlen Drive was unnecessary for
present or prospective public use.
NOW, THEREFORE, the City Council of the City of Dublin does
resolve as follows:
Section 1. That a portion of Betlen Drive located within the City of
Dublin, Alameda County, California, is unnecessary for present or prospective
public use and said portion of Betlen Drive, as described in Exhibit A and
depicted in Exhibit B attached hereto, is hereby vacated and abandoned,
reserving and excepting therefrom easements and rights-of-way to construct,
maintain, operate, replace, remove, renew, and enlarge sanitary sewers, storm
drains, And public utility services now existing in said area, including all
necessary and convenient appurtenant structures and incidental purposes
thereto, including access, as described in Exhibit C and depicted in Exhibit D
attached hereto.
Section 2. This Resolution shall be recorded with the Alameda County
Recorder, pursuant to Streets and Highways Code Section 8325, and the vacation
shall be complete upon such recordation.

Pacific Bell
For the benefit of Pacific Bell, the permanent easement and the right at any
time or from time to time to construct, maintain, operate, replace, remove,
renew, and enlarge lines of pipe, conduits, cable, wires, poles, and other
convenient structures, equipment and fixtures for the operation of
telegraphic and telephone lines and other communication facilities, including
access and the right to keep the property free from inflammable materials and
wood growth, and otherwise'protect the same from all hazards, in, upon, over,
and across that portion of Betlen Drive or parts thereof.

Pacific Gas and Electric Co.
For the benefit of Pacific Gas and Electric Co., the permanent easement and
the right at any time or from time to time to construct, maintain, operate,
replace, remove, renew, and enlarge facilities consisting of such underground
conduits, pipes, manholes, service boxes, wires, cables, and electrical
conductors; aboveground marker posts, risers, and service pedestals;
underground and aboveground switches, fuses, terminals, and transformers with
associated concrete pads; and fixtures and appurtenances necessary to any and
all thereof; and one or more underground pipes with suitable service pipes
and connections, as Pacific Gas and Electric Co. deems necessary, for the

APPROVING QUITCLAIM DEED FOR 320~ SQUARE FOOT PARCEL
AT WESTERNMOST END OF BETLEN DRIVE
WHEREAS, the County of Alameda accepted fee title to Parcel 2 as
described on Exhibit A an~ and depicted on Exhibit B of quitclaim deed
attached hereto; and
WHEREAS, the City of Dublin succeeded in interest to said Parcel
upon incorporation; and
WHEREAS, the City Council of the City of Dublin has determined
that said Parcel is no longer needed by the City for right-of-way purposes;
and
WHEREAS, the Dublin San Ramon Services District will accept said
Parcel for use as parking for service of its adjacent water reservoir;
NOW, THEREFORE, BE IT RESOLVED that the City Council approves a
quitclaim deed for said Parcel 2 in favor of the Dublin San Ramon Services
District.
BE IT FURTHER RESOLVED that the Mayor is authorized to execute
said quitclaim deed.

A RESOLUTION OF INTENTION TO VACATE A PUBLIC STREET
WESTERN TERMINUS OF BETLEN DRIVE
Recitals
The City Council of Dublin does RESOLVE as follows:
That the City Council adopts this resolution under the provisions
of Streets and Highways Code Sections 83%0 et. seq. and section 8320 in
particular.
It is the intention of the City Council to vacate a portion of
Betlen Drive. Said Betlen Drive is a public street in the City of Dublin,
Alameda County, California, officially known and designated as such. That
portion of this street so proposed to be vacated and abandoned is described in
Exhibit A and shown in Exhibit B of this resolution.
These proceedings are taken subject to the reservation and exception,
until such time as all utilities are relocated outside the area proposed to be
vacated, of easements and rights-of-way to construct, maintain, operate,
replace, remove, renew and enlarge sanitary sewers, storm drains, and public
utility services now existing in said area, including all necessary and
convenient appurtenant structures and incidental purposes thereto, including
access.
Reference is hereby made to a map of said proposed vacation
entitled "Plat of Street Vacation (A Portion of Betlen Drive)" dated March 9,
1988, on file in the Office of the City Clerk for particulars as to the
proposed vacation.
Notice is hereby given that on February 13, 1989, at 7:30 p.m. at
the Dublin Library, 7606 Amador Valley Boulevard, Dublin, California, any and
all persons having any objections to the proposed vacation may appear before
said Council and show cause why said proposed vacation should not be ordered.
The City Clerk shall cause this Resolution of Intention to be
posted~in at least three (3) public places in the City of Dublin in accordance
with Section 36922 of the Government Code. Said posting shall be not less
than fourteen days prior to the date of hearing.
This resolution shall be posted conspicuously along the line of
said street to be vacated at least fourteen days before the date of hearing.
Such resolution shall be posted not more than 300 feet apart, but at least
three shall be posted, in accordance with Streets and Highways Code Section
8323.
Notice in accordance with Streets and Highways Code Section 8322
shall be published for at least two successive weeks in a newspaper published
in Alameda County.

OF THE CIT~ OF DUBLIN
FINDING THE PROPOSED ABANDONMENT OF THE WESTERN TERMINUS
OF BETLEN DRIVE TO BE IN CONFORMANCE WITH THE DUBLIN GENERAL PLAN
WHEREAS, Betlen Drive was originally constructed as a stub street
to the west in anticipation of additional development requiring public street
access; and
WHEP~EAS, Valley Christian Center was developed at the end of
Betlen Drive but obtained access from Dublin Boulevard rather than from Betlen
Drive; and
WHEREAS, Tract 5777'reconfigured the end of Betlen Drive to
recognize the fact that this street will not be extended to the west;
NOW, THEREFORE, BE IT RESOLVED that the City of Dublin Planning
Commission finds that the abandonment of Betlen Drive westerly of Las Palmas
Way is in conformance with the City of Dublin General Plan.

Pacific Bell does maintain facilities within the area proposed to
be vacated. We, therefore, request the following language be
incorporated in any resolution or ordinance of vacation of the
street named above.
"EXCEPTING AND RESERVING THEREFROM PURSUANT TO THE
PROVISIONS OF SECTION 8340 of the Street and Highways
Code and for the benefit of Pacific Bell, the permanent
easement and the right at any time or from time to time
to construct, maintain, operate, replace, remove, renew
and enlarge lines of pipe, conduits, cable, wires,
poles and other convenient structures, equipment and
fixtures for the operation of telegraphic and telephone

Dear Lee:
This replies to your letter dated January 12, 1989, in which you requested
that the District accept ownership of the parcels to be abandoned at the eno
of Betlen Drive. Your request and a similar one from Pulte Home Corporation
were considered by the District's Board of Directors at its meeting held on
January 17, 1989.
The Board, by motion, conceptually approved acceptance of the parcels
subject to the completion of certain improvements to my satisfaction as
District Engineer. The improvements include an asphalt parking lot,
six-foot-high wooden fence with gates, irrigation systems and landscaping.
Pulte Homes Corporation is having construction drawings prepared, which we
have reviewed and shall approve for construction as soon as the final drawings
are submitted.
It is my understanding that quitclaim deeds will be prepared in favor of
the District to transfer ownership of the subject parcels. The District will
accept the transfer when construction is complete and the necessary documents
have been prepared and submitted for signature.
