HomeMy WebLinkAbout6.5 PublicHearAbandnBetlenCITY OF DUBLIN AGENDA STATEMENT City Council Meeting Date' February 13, 1989 SUBJECT' Public Hearing' Abandonment of Westerly Terminus of Betlen Drive (Report by Public Works Director Lee Thompson) EXHIBITS ATTACHED: Location Map RECO~{E,~DATIO~,. ,4 ~jt 2) 3) 4) Open public hearing Receive Staff presentation and public testimony Question Staff and the public Leave public hearing open and continue the matter to the regular meeting of February 27, 1989 FINANCIAL STATEME~";T: None DESCRIPTION: At the meeting of December 12, 1988, the City Council adopted a resolution of intention to abandon the stub end of Betlen Drive at its westernmost end. l~en the right-of-way of Betlen Drive was originally dedicated, the street ended at the boundary of Tract 2534 (adjoining Valley Christian Center), as shown on Exhibit 3 attached. ~Cnen Tract 5777, the Pulte Homes development (Hacienda Heights), developed, the westerly end of Betlen Drive was constructed as a knuckle cul-de-sac at its junction with Las Palmas Way. This configuration leaves the remainder of the end of Betlen Drive as excess right-of-way. The area to be abandoned is approximately 0.16 acres. If the abandonment is approved, this excess right-of-way will revert to the owners of the adjacent properties from the cen~erline south to Pulte Homes and from the centerline north to DSRSD. Pulte has stated that they are not interested in utilizing the property as part of the Hacienda Heights Development and plan to quitclaim the property to DSRSD. DSRSD is interested in using this area as a parking area to service their water reservoir. The area would not be used to store vehicles or equipment and would be screened by a six-foot fence and landscaping along the street frontage. It is anticipated that this use would not have a negative visual impact on the neighboring properties. Since this stub end of Betlen Drive cannot physically be constructed through the Vailev Christian Center and has been closed off by providing a knuckle cul-de-sac into the Hacienda Heights deYe!opment (Pulte Homes, Trac~ 5777). In addition, Betlen Drive is not indicated as a through s~reet on the City's General Plan. Section 65402 of the Government Code states that if a General Plan has been adopted, no real property shall be vacated or abandoned until the location, purpose, and extent of the street vacation or abandonment have been submitted to and reported upon by the Planning Agency as to conformity with the General Plan. Failure of the Planning Agency to submit its report to the City Council ~ithin 40 days shall be conclusively deemed a finding of conformity. If the Planning Agency disappro~'es the abandonment, its decision may be oYerruled bv the City Council. The Planning Commission considered this ite~u at their meeting of February 6. 1989, and c~.tip~ed the matter until tl~{,-~eeting of F~braarv 21st, as they had questions regarding the use of the property by DSRSD. The City Council may not, therefore, make a decision at the February 13th meeting. Staff recommends that the City Council conduct a public hearing and continue the ~atter to the regular City Council meeting of February 27, 1950.
