Request to Rename Streets in Neighborhoods C3 and D1, Positano at Fallon
Village

EXECUTIVE SUMMARY:
The City Council will consider a request to rename two streets within the Positano at Fallon
Village Development. The renaming includes: Haggerty Court to Atella Court in Neighborhood
C3, and Atella Drive to Haggerty Drive in Neighborhood D1.
FINANCIAL IMPACT:
There will be no financial impact to the City and minor costs to change out some signage. New
street name signs will be purchased and installed by the developer of Neighborhoods C3 and
D1.
RECOMMENDATION:
Staff recommends that the City Council adopt the Resolution approving the renaming of
Haggerty Court to Atella Court in Neighborhood C3, and from Atella Drive to Haggerty Drive in
Neighborhood D1, Positano at Fallon Village.

DESCRIPTION:
On April 5, 2011, the Dublin City Council approved the Final Map for Tract 8050 (Attachment 1),
Neighborhood C3 (Braddock and Logan) in the Positano at Fallon Villages development.
Included on this Final Map was a street designated as "Haggerty Court," so named in honor of
Alameda County Supervisor Scott Haggerty as the result of a recent Dublin Partners in
Education (DPIE) auction to raise funds for various activities that would benefit Dublin students.
As of this date, addresses have not been assigned to the lots on this street.
Staff has realized that the three streets used for the auction were not commensurate with each
othe. It is, therefore, being proposed to substitute a planned street name in Neighborhood D1.
Neighborhood D1 in the Positano at Fallon Village development is currently in the process of
obtaining Final Map approval. Street names have been designated for Neighborhood D1, but
the Final Map has not been approved by the City Council nor recorded.
Street naming is governed by Chapter 7.08 of the Municipal Code. Section 7.08.070 of the
Municipal Code (Attachment 2) states that if there are no addresses in use on a street, the
name of which is to be changed, the City Council may make such a change without referral to
the Planning Commission and without a Public Hearing.
Staff is proposing to rename a street in Neighborhood D1, "Atella Drive," as "Haggerty Drive."
It is further proposed to rename the street known as "Haggerty Court" in Neighborhood C3
as "Atella Court." Braddock and Logan, the developer for Neighborhoods C3 and D1, is in
agreement with the name changes.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
Public noticing occurred as part of the Tentative Map process. Approval of the Final Map for
Tract 8050 was affirmation of the Final Map's concurrence with the approved Tentative Map. A
copy of this Staff Report has been provided to Braddock~ and Logan, and to the Office of
Alameda County Supervisor Scott Haggerty.

7.08.070 Street name changes.
The following procedure shall apply to
the changing of street names:
A. Authority. The City Council may, by
resol.ution, change the name of any street
within the city if the street name is identical
or similar to another street name in Alacne-
da County, if one continuous street is
known by- more than one name, if a street
different from the official name is in com-
mon use, or for other just cause.
B. Initiation. Except as otherwise provi-
ded in this section, a street name change
may be initiated by any of the following
methods:
1. By action of the City Council;
2. By action of the Planning Commis-
sion;
3. By request of, any adjoining local
government;
4. By petition representing not less than
twenty percent (20°10) of the households or
addresses on the street to be renamed, ex-
cept that the petition need not represent
more than ten (10) addresses.
C. Procedure. When a street name

change has been initiated pursuant to sub-
section B of this section, a public heari~g -
shall be scheduled before the Planning
Commission. At least ten (10) days prior to
the public hearing, the city Community
Development Director shall cause notice of
said hearing to be posted in conspicuous
places along said street, said notice to con-
tain letters a minimum of_ one-eighth (~/s)
inch `in height reading "NOTICE OF PRO-
POSED STREET NAME CHANGE" along
with a general description of the proposal.
The city Community Development Director
shall also cause notice of said hearing to be
mailed to each owner, as shown on the
latest equalized assessment roll, of property
along said street at Ieast ten (10) days prior ~
to the public hearing. ,
After the closing of the public hearing,
~the Planning Commission shall make a rec-
ommendarion to the City Council. If the
Planning ~ Commission recommends a
change, the City Council may adopt a reso-
lution putting the recommended change into
effect without a hearing, or the City Council
may hold a public hearing at its option. The
City Council shall not change any street
name contrary to the Planning Commission
recornmendarion without first holdi.ng a
public hearing thereon. If the Planning
Commission recommendation is for no
change, the matter may be summazily dis-
missed by the City Council or. a public
hearing on the proposal may be scheduled.
If the City Council is to conduct a public
hearing, the notice requirement for said
hearing shall be the same as confained in
the first paragraph of this subsection.
D. Exceptions. In the event there are no
addresses in use on a street the name of
which is to be changed, or if all householris
or occupants on such street consent in writ-

ing to the change, the Council may malce
such change without referral to the Planning
Commission and without a public hearing.
E. New Stree# Names. Names for new
streets shall be established by the adoprion
of a resolution by the City. Council or by
approval of a fmal subdivision map or final
parcel map containing staff-reviewed and ~
approved names. No public hearing need be
held. .
F. Referral. No .new street shall be
named nor shall any street name be changed
without first referring all proposed names to.

Regional Fire Authority, United States Post
Office, county of Alameda, each adjoining
city, the city Police Department, and any ~ -
other agency as approved by tbe City Coun-
cil. Upon receipt of replies from these agen- ~
cies, or upon the expiration of fifteen (15)
days after notice was sent; the city Commu-
nity Development Director shall forward his ~
findings and recommendations to the Plan-
ning Commission or City Council, whichev-
er has primary jurisdiction. ~
G. City Clerk Duties. Whenever the name
of any street is adopted, , established or
changeri, the City. Clerk shall promptly for-
ward a copy of the resolution p~viding for
such new name, change of name, or house ~
number to the Dougherty Regional Fire ~
Authority, United Sfates Post Office, county
of Alazneda, each adjoining city, the city ,
Police Department, and any other agency as
approved by the City Council, and those
property owners affected by the name

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

APPROVING THE RENAMING OF HAGGERTY COURT TO ATELLA COURT
IN' NEIGHBORHOOD C3, TRACT 8050, AND ATELLA DRIVE 70 HAGGERTY DRIVE
IN NEIGHBORHOOD D1, POSITANO AT FALLON VILLAGE
WHEREAS, the City of Dublin did, on April 5, 2011, approve Final Tract Map 8050,
Neighborhood C3 in the Positano at Fallon Village development; and
WHEREAS, Haggerty Court, as shown on Final Tract Map 8050, was so named in honor
of an elected official, and it has been determined that this street is not commensurate with such
honor; and
WHEREAS, Neighborhood D1 in the Positano at Fallon Village development contains a
planned street that would be more fitting for this action; and
WHEREAS, the developer of Neighborhoods C3 and D1, Braddock and Logan, is
agreeable to the renaming of these two streets; and
WHEREAS, the street renaming has been reviewed in accordance with the provisions of
the Dublin Municipal Code, Section 7.0$0.070; and
WHEREAS, no street addresses have been assigned to either street by the City's
Building Department; and
WHEREAS, the City Council did hear, consider and support this recommended street
name change;
NOW, THEREFORE, BE IT RESOLVED THAT the City Council of the City of Dublin
hereby approves the renaming of Haggerty Court to Atella Court in Neighborhood C3, Tract
8050, and from Atella Drive to Haggerty Drive in Neighborhood D1, Positano at Fallon Village.
PASSED, APPROVED AND ADOPTED this 21 st day of June, 2011, by the following
