FINANCIAL STATEMENT: No direct cost to City beyond administrative costs of processing application. DESCRIPTION : The City of Dublin has received requests from Burton Street residents for the past several years regarding the closure of the street for a 4th of July Block Party. The City Council has approved this event in the past, provided that certain conditions were met. Mr. Raymond Riordan, on behalf of the residents of Burton Street, has again requested the closure of the street on the 4th of July for the purpose of a block party. Staff has prepared a set of conditions which have been reviewed by Mr. Riordan and City Departments including Police and Fire. ~ir. Riodan's letter of June 16, 1988 indicates that the sponsors of the event are requesting two modifications to the requirements proposed by Staff. First, they would like the City to accept a certificate of insurance for $500,000 in coverage as was done in 1987. Second, they request authorization to barricade the street without using flashing safety lights. The remainder of the Staff report provides background and cost information on these two issues. Insurance Background Prior to March, 1986, the City of Dublin obtained commercial liability insurance which covered actions taken by the Citv Council. In June, 1986, the City became a charter member of ABAG PLAN Corporation. This entity was formed by public agencies who had been left without commercial insurance when several companies stopped providing insurance to municipalities. ABAG PLAN was formed to allow the cities to pool resources and share the risk. Included in ABAG PLAN coverage agreement is a stipulation thac coverage will not be extended to special events which are not solely sponsored by the City. To address this change, Staff has a~te~pCed to assure that any uncovered activities are capable of providing insurance. For example, groups or individuals renting Shannon Center are required to provide proof of insurance. ABAG has provided several training seminars to assure that Staff members are familiar with insurance forms and the proper methods of reviewing their content. The cost of these education progra~ns are paid by members through the administrative premium. Based on information provided at these programs, Staff has been modifying various procedures and recommendations where potential for City liability exists. The overall intent is to reduce exposures to the City and thereby reduce City liability insurance expenditures. ITEM NO. .._.~ ~ COPIES TO: Ray Riordan Jeanne Landreth The City has been able to obtain a Master Policy for Shannon Center, which 6sers can purchase. The City has paid the brokers fee, taxes, and any inspection fee required by the underwriter. The remaining cost is paid by the individual or group conducting the event. The premium varies depending on the event and the number in attendance and has been paid by the facility user. Typically this type of insurance is referred to as "Tenants and Permittee insurance." The City's experience with this type of policy has varied as the insurance market has changed. The program which was available until December, 1987, only had a $500,000 limit and the high cost discouraged many from using the program or conducting events. Staff looked into a one day policy for the Burton Street Party in 1987 and received a quotation of $670.15. The City was quite pleased with the new program offered by K & K Insurance. Please see Specimen and Policy Highlights which are attached. This program offers $1 million in coverage at very competitive rates. In addition, they were willing to extend the policy to permittees and locations other than Shannon Center. In 1987, when the City Council considered the Burton Street item, two members of the audience offered to pay the cost of the special one day insurance. The event was approved provided the City received the appropriate insurance verification. The City imposed the same insurance limit as was currently available for users of Shannon Center, which was $500,000. For unknown reasons, the residents pursued attempting to obtain riders to their homeowners' policies, instead of purchasing the special event coverage. Unfortunately, three of the certificates submitted in 1987 could not be accepted due to the lack of proper language. One did not name the City as Additional Insured and contained a statement that it covered "Liability extending to City Street in front of 7254 Burton Street." The second stated "coverage under policy limits extends to the curb and includes any acts of negligence by our insureds." The third stated, "Additional insured from hours of 10 am and 10 pm at property address 7236 Burton Street." In July of 1987, the City did not receive the documents until the last business day before the holiday. Staff verbally discussed the language on the Certificates with the City Attorney's Office. The City Attorney's Office advised that the certificates provided were too restrictive and would not cover the street closure activity. Late in the day, the City was presented with a certificate for Mr. Raymond Riordan, which named the City as Additional Insured, "...with respect to Burton Street 4th of July celebration for 12:01 am July 4, 1987 to 12:01am July 5, 1987 only." The policy limits were $500,000 and the permit was issued by Staff. As stated in Mr. Riordan's letter, he has once again received a Certificate of Insurance. The document is dated June 16, 1988 and a copy is attached. Upon the advice of the Assistant City Attorney, Staff requested additional ~vritten confirmation from Mr. Riordan's Insurance Broker. (Please see ~emorandum from Assistant City Attorney dated June 22, 1988.) Specifically, a "Certificate" as noted in the top right corner does not amend the policy. Therefore, the Staff requested written verification from an authorized representative of the Company that the coverage was as stated, b~r. Riordan's homeo~ner's policy has a limit of $500,000. A copy of the letter confirrning the coverage dated June 21, 1988 is attached. Availability of $1 blillion Coverase On June 10, 1985, City Staff was first advised that the event would take place. The City' s Insurance Broker was contacted to determine the availability of the Shannon Center policy for this type of event. Staff also completed an application based on our past knowledge of the event. The underwriter for this program is located in Indiana and we recognized the need to apply as soon as possible. On Oune 17, 1988, the Insurance Broker received confirmation that a policy could be issued. Based on attendance estimates provided by ['lt. Riordan, the cost of the $1 million policy is $~4.38. It is important to note that although the policy carries General Liability coverage, there is an exclusion for any claims which arise as a result of firewo~-ks. Staff discussed the possibility of obtaining a rider for this activity, however, the insurer is geared more towards large public displays and this would not be appropriate. -2- Barricade - Safety Lights The requirement for flashing safety lights on the barricades is based upon prudent risk management practices. A motorist who is unaware that the event is scheduled may not be anticipating a street closure. This requirement is intended to provide additional safety for vehicles as well as those attending the event. The activity is also happening after the hours of darkness, therefore, Staff believes this requirement is appropriate. The standard specifications for public works jobs require safety lights. This is especially important when barricades are located in the travel portion of the roadway and not in the parking lane. The Maintenance Superintendent from MCE has evaluated the situation and believes that a total of 10 barricades would be required. He has located a supplier who would rent them for a total of $31.95. This includes 10 barricades and their pick-up, delivery, and tax. The renter would be responsible for any which were lost or damaged. Given the small size of the order and the fact that they would need to be delivered on Friday and picked up on Tuesday, MCE could only obtain two quotations. Total Cost of Recommended Requirements The total cost of the recommended requirements is $96.33. Mr. Riordan has indicated that 12 households participate. Therefore, the cost per household is approximately $8.03 each. Recommendation Staff believes that it is prudent to adopt the required $1 million policy limit. It is recommended that the City Council authorize the closure of Burton Street in accordance with the proposed conditions. -3- 10. 11. City of Dublin Conditions of Encroachment Permit Issued for July 4, 1988 Closure of Burton Street Between Amador Valley Boulevard & Tamarack Drive The date of the street closure shall be July 4, 1988. The hours of the street closure shall be 10:00 a.m. to 10:00 p.m. Sufficient barricades shall be provided by the homeowners. Due to the use of barricades after dark, barricades shall be equipped with flashing safety lights. Barricades shall be supervised by responsible person(s) in the event traffic or emergency vehicles need to enter or exit Burton Street. Noise shall be maintained at an acceptable level. Responsible person(s) shall insure that any consumption of alcoholic beverages is limited to adult attendees. No sales of Alcoholic Beverages are permitted by this permit. Barricades shall be removed from public street at the conclusion of the event. In no case shall barricades remain in the street after 10:00 p.m. Permittee shall be responsible for removing all litter and .debris from the public street. Any use of fireworks shall be limited to authorized "safe and sane" fireworks. The use of such fireworks shall be supervised by adults and in accordance with all manufacturers' instructions. Applicant shall provide a Certificate of Insurance which names the City of Dublin as an additional insured for the event. The minimum acceptable limits of insurance is $1 million per occurrence. Applicant shall complete Encroachment Permit Application and submit an acceptable Certificate of Insurance or obtain required insurance no later than June 30, 1988. I appreciated your our community program, now an eight year tradition. on June 10 interest in As per our conversation this morning, please accept this note as a formal request to close Burton Street on July 4. Current residents and a few previous residents of Burton Street congregate for an annual celebration of the community spirit our ancestors created by establishing the United States' independence. In past celebrations, game booths, a decorated bike parade, foot races, assorted ball games, and a fireworks display highlighted the celebration for the children. Residents of the street provided different refreshments and other activities for the adults. Closing the street provided a safe environment for the children's activities and free movement between the homes. Because most families in our block have few children and the adolescent/young adult age has grown, we, as a block, have decided to dispense with the booth games, races and bike parade. Instead we have scheduled less risk activities inside and/or in front of various homes. Closure of the street is requested so we may move between and/or congregate in front of our homes without the hazards of moving vehicles. We, as a group, have adopted the provisions listed in the letter you sent me (Draft Conditions of Encroachment Permit); however, we have two reservations. First, at no additional cost, my insurance agent, Insurance By Hawkins, underwritten by Fireman's Fund, has agreed to list the city of Dublin as an additional insured, as done last year for the amount of $500,000. (See enclosed document for additional insured statement.) With our reduced use of the street, limited to typical movement between homes, less risk is involved than in years past. As evident in our unblemished safety record, we provide exceptional supervision at our celebration. To require additional insurance coverage at any cost hinders our community program, funded solely from our pockets. Second, we have barricaded our street with the appropriate signs and mechanisms required in the past. Unlike years past, your list of conditions includes lighted barricades for night use. We do not have access to lighted signs. You did inform me that Rental World may rent the appropriate lights to us, but again we incur more costs. We understand that the City of Dublin must be fair to all groups requesting permits of this nature and that established procedures and conditions must be met to identify responsibilities for such functions and reduce the city's liability in the event of an accident. We also understand the spirit and. definition of community. We know the city Council supports community functions and spirit. We ask that their support continue. We request our permit application and this note be presented to the city Council for acceptance at the June 27 Council Meeting. We also request a review of maintaining our insurance requirement at the $500,000 figure set last year, and already covered by my insurance. Silver Assistant City Attorney Closure of Burton Street -- 4th of July June 22, 1988 You have asked whether the attached "Certificate of Insurance" would provide the City adequate protection for closure of Burton Street for a Fourth of July block party. The Certificate is in proper form but in and of itself technically does not provide insurance coverage. The Certificate should be followed up with written verification from the broker that insurance is in place in the amounts, and as stated, on the Certificate with the City of Dublin as "additional insured" and that the broker can bind the insurance company. With respect to the amount of insurance, $1 million coverage would obviously provide the City better protection than $500,000 and is therefore preferable since, as you know, damage awards often exceed $500,000.
