SUBJECT . Dublin Sports Grounds Restroom Sewer and Water
Connection Fees

RECOMMENDATION 'Authorize Staff to request that the Dublin San Ramon
r~~°J~ Services District debit the Gity's current sewer and
~ water account on the Civic Center site for $3,000 in
sewer connection fees and $1,800 in water connection
fees.
FINANCIAL STATEMENT: This request,.if accepted by the District, would
reduce the cost to the City b`y $4,800, by allowing it
to use those connecti.on permits which have already
been paid for on the Civic Center site.
DESCRIPTION . As part of the land excha'nge agreement with the Dublin
San Ramon Services District, the City of Dub'lin agreed to build a new park
restroom on the Dublin Sports Grounds. At the time that this restroom was
built in 1986, the District requested that the City'~pay a sewer and water
connection fee for this restroom, even though the restroom was currently
owned by the Dublin San Ramon Services Distri.ct.
Relying on the Califor.nia Court Case "San Marcos", the City indicated to the
District that there was no lega'1 basis on which to eharge the City for a
sewer or water connection fee that would.be used for future utility capacity
and indicated that it would not be paying the connection fees.
Since that time, the San Marcos Case was reversed by legislation passed by
the California State Legislature and si.gned into la.w by the Governor in
1988. This legislation had°a retroactive d`ate of July 26, 1986.. Therefore,
the City is now responsible to pay the $4,800 in sewer and water connection
fees requested by the Dublin San Ramon Services District.
As an alternative to paying the fees, the City has discussed with District
Staff the possibility of the District debiting the City's current sewer and
water connection fee account on the Civic Center property. The sewer and
water connection fees originally.purchased by Galcor, Inc., and subsequently
purchased by the City when it pu.rchased the Civic Center property from
Galcor, Inc., are in excess of what is necessary to ac.commodate the current
Civic Center project. There is also sufficient excess sewer capacity to
accommodate any future development on the balance of the Civic Center
property.
In that this excess capacity is available on the Civic Center property, it
is Staff's recommendation that the Council authorize Staff to request that
the District debit the City's Civic Center property sewer and water
connection fee account in the amount of $4,800 in lieu of having the City
pay an additional $4,800 for the Sports Grounds sewer and water permits.
