Acceptance of Phase One Improvements for Tract 6765, Schaefer Ranch (Schaefer Ranch Holdings, LLC) and Approval of Regulatory Traffic Control Devices Prepared By: Frank Navarro, Senior Civil Engineer EXECUTIVE SUMMARY: Discovery Builders, dba Schaefer Ranch Holdings, LLC, has constructed the Phase One street improvements for Tract 6765 in accordance with the Improvement Agreement for Tract 6765. It is now appropriate for the City to accept these improvements and approve the regulatory traffic control devices. FINANCIAL IMPACT: The City will incur annualized maintenance costs for these improvements, estimated to be $60,100 for street sweeping and street lighting (monthly), slurry seal (every five years) and asphalt concrete pavement overlay (every 20 years). RECOMMENDATION: Staff recommends that the City Council adopt the Resolution for the Acceptance of Phase One Improvements for Tract 6765, Schaefer Ranch (Schaefer Ranch Holdings, LLC) and Approval of Regulatory Tr~ffic Control Devices. y ~ ~ Submitted By Public Works Director - Revie ed B Assistant ~ nager Page 1 of 2 ITEM NO. ~ I3 DESCRIPTION: Schaefer Ranch Holdings, LLC has completed the Phase One street improvements for Tract 6765, Schaefer Ranch. The Phase One improvements consisted of extending Dublin Boulevard, constructing Schaefer Ranch Road, and installing a new traffic signal at the intersection of Dublin Boulevard and Schaefer Ranch Road. This work was governed by an Improvement Agreement executed on February 20, 2007, via City Council Resolution No. 17- 07. Since the developer has completed the work governed by the Phase One Improvement Agreement and to the satisfaction of the City Engineer, it is appropriate for the improvements to now be accepted by the City for permanent maintenance. The landscape improvements are not being accepted at this time. At the time the City and the developer, Schaefer Ranch Holdings, LLC, executed the Improvement Agreement for the street improvements, the developer provided performance and labor and materials bonds issued by Travelers Casualty and Surety Company of America each in the amounts of $3,508,900.00 (Bond No. 104757057). At the request of the developer, the bonds for Phase One improvements were reduced to $877,225.00 (25% of $3,508,900.00) on March 18, 2008 via City Council Resolution No. 42-08 for completion of 80% of the improvements. The developer replaced these bonds with rider bonds for these amounts. Now that the work is complete, these rider bonds may be released in accordance with the authority contained in §66499.7 of the Government Code. The landscape improvements perFormance and labor and materials bonds in the amount of $1,365,900.00 (Bond No. 104757060) will be retained until the improvements are complete. The following regulatory traffic control devices will be accepted and approved as part of this project and added to the City of Dublin Traffic Code: •"No Parking Anytime" signs installed on both sides of Dublin Boulevard befinreen Schaefer Ranch Road and Brigadoon Way. •"No Parking Anytime" signs installed on both sides of Schaefer Ranch Road between Dublin Boulevard and the City limit line north of Dublin Canyon Road. • STOP signs and markings installed at the intersection of Marshall Canyon Drive and Dublin Boulevard. • Traffic signal at the intersection of Dublin Boulevard and Schaefer Ranch Road. Resolution for the Acceptance of Phase One Improvements for Tract 6765, Schaefer Ranch (Schaefer Ranch Holdings, LLC) and Approval of Regulatory Traffic Control Devices G:\DEVELOPMENT, PRIVATE\Schaefer Ranch\Improvement Agreements\SR Phase 1 Acceptance Staff Report.doc Page 2 of 2 Schaefer Ranch Ph~se Or~e Improvements Schaefer Dublin Boulevard Extension a ~~~ a _ ' ~°;~' T~ Z~ ~' ~ 1 ,- .~.. ,~ ~.~..~~ , M ...~ ~ ~. ~~~ _ ~ ~ ~ w ~~ ~ ~ ~ ~ , ~ , ;~ ~ , . ~ ~ ~. ~~3 RESOLUTION NO. - 11 A RESOLUTION OF THE CITY COUNClL OF THE CITY OF DUBLIN ***~****~ ACCEPTANCE OF PHASE ONE IMPROVEMENTS FOR TRACT 6765, SCHAEFER RANCH (SCHAEFER RANCH HOLDINGS, LLC) AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES WHEREAS, Schaefer Ranch Hoidings LLC, the developer of Tract 6765, previously entered into an Improvement Agreement with the City of Dublin to complete Phase One street improvements associated with Tract 6765, in accordance with plans and specifications on file with the City Engineer; and WHEREAS, the street improvements are complete in accordance with said plans and specifications, and any approved modifications thereto, to the satisfaction of the City Engineer; and WHEREAS, said Improvement Agreement as secured by faithful performance and payment bonds each in the amounts of $3,508,900.00 (Bond No. 104757057) for the Phase One improvements, issued by Travelers Casualty and Surety Company of America, were previously reduced, to $877,225.00 by the City Council via Resolution No. 42-08 on March 18, 2008; and WHEREAS, the developer secured the Improvement Agreement by providing rider performance and payment bonds each in the amount of $877,225.00 (Bond No. 104757057) for Phase One improvements, both issued by Travelers Casualty and Surety Company ofi America; and WHEREAS, the original reduced rider bonds that guaranteed the improvements can be released, in accordance with the authority contained in §66499.7 of the Government Code of the State of California; NOW, THEREFORE, BE IT RESOLVED that: 1. The street improvements completed within said Tract are hereby accepted; and 2. All deficiency items have been addressed and no new items are anticipated; and 3. The traffic regulatory devices installed by the developer are hereby included in the City of Dublin Traffic Code, said regulatory devices to include the following: a) "No Parking Anytime" signs installed on • both sides of Dublin Boulevard between Schaefer Ranch Road and Brigadoon Way • both sides of Schaefer Ranch Road between Dublin Boulevard and the _ - ------ ---- -- --- - City limit line north of Dublin Canyon Road ' 1 ATTACHMENT 2. 3~3 b) STOP signs and markings installed at the intersection of Marshall Canyon Drive and Dublin Boulevard c) Traffic signal at the intersection of Dublin Boulevard and Schaefer Ranch Road; and 4.
