Senate Bill 343 mandates supplemental materials that have been
received by the Planning Department that relate to an agenda item
after the agenda packets have been distributed to the Planning
Commission be available to the public. This document is also
available in the Planning Department and on the City's Website.
The attached document was received in the Planning Department
after distribution of the August 23, 2011 Planning Commission
meeting agenda packet.

Subject: Proposed Zoning Ordinance Amendments to .Chapters 8.40 and 8.76 -Planning Commission
Dear Linda & Jeff,
I do not see how the proposed Zoning Ordinance Amendments to Chapters 8.40 and 8.76 are beneficial to my
center, tenants or any other business in Dublin. How does it help my situation? Additionally, especially
the definition, "food preparation area and seating areas" is overly restrictive, ambiguous and not customarily
used. How are you going to determine food preparation area within a market? This will only lead to less clarity
and consistency.
The proposed changes go to the heart ofthe appeal, currently on continuance, filed by Jay Fink on June 20,
2011. Specifically, the appeal challenges the official interpretation issued by the Community Development
Director on June 10, 2011. Consequently, the proposed amendments to the Planning Commission should have
been deferred pending the settlement of the issues .and/or the exhaustion of the appeals.
Again, I am requesting that the proposed changes to the Zoning Ordinance as it relates to the appeal filed on
June 20, 2011 be deferred and not be considered by the Planning Commission tonight.
