Authorize an additional appropriation from new revenue to the Signals and Lighting budget in the amount of $1,000. FINANCIAL STATEMENT: The entire cost of the work will be paid by Regional Ambulance. The terms of the agreement provide that Regional Ambulance will hire the electrical contractor, subject to approval by the City. Regional Ambulance will additionally reimburse the City for the cost of the work to be performed by Pacific Gas and Electric Company, and the City's signal maintenance contractor (Alameda County). The estimated cost of this work is $1,000. An additional appropriation from new revenue is required in order to provide funds for the work to be performed by PG&E and the County. DESCRIPTION: When Regional Ambulance moved into its present quarters at 6465-C Clark Avenue, the adjoining residential neighbor experienced some nighttime noise disturbances related to the ambulance business. Although the ambulance crew has attempted to delay turning on the siren until the vehicle has entered Dublin Boulevard, the California Vehicle Code states that the siren should be used as necessary when an emergency vehicle is required to operate contrary to traffic regulations (e.g., when entering an intersection against a red light). The City's traffic signal pre-emption system ("Opticom") was installed at every intersection several years ago but was only installed for the specific directions of travel that would normally be used by the fire department responding to a call. Southbound Clark Avenue at Dublin Boulevard does not have the "Opticom" at this time. Staff investigated several possibilities with regard to installing an emergency vehicle traffic signal pre-emption device that could be used by Regional Ambulance. The least costly is a hardwired system similar to that used by the Fire Department when leaving the Donohue Drive fire station, in which a crew member would push a button that would cause the signal to change to green for a specified amount of time. Pacific Gas and Electric Company has agreed to install overhead wires that will serve as a connection from the building at 6465 Clark Avenue to a service pullbox near the signal controller cabinet. An electrical contractor would make the connection from PG&E's installation to the pushbutton on the building and pull wire ITEM NO. ~ COPIES TO: Regional Ambulance CITY CLERK into the City's controller cabinet. The City's signal maintenance contractor, Alameda County, would then connect the wire to the signal controller itself. Ail work that directly affects the operation of the signal itself is to be performed by Alameda County. The agreement provides that Regional Ambulance will hire the electrical contractor, subject to the City's approval. Staff feels that this option is preferable to the City hiring a contractor to make modifications to a building on private property. The agreement states that Regional's contractor will perform the work according to all applicable codes and under the City's direction. Regional Ambulance will deposit sufficient funds with the City to pay the cost of PG&E's and Alameda County's services, which cannot be charged directly to Regional. Staff recommends that the City Council adopt the resolution, authorize the Mayor to execute the agreement, and authorize an additional appropriation in the amount of $1,000 from new revenue to the Signals and Lighting budget. a:(corres)~dec~agstevp Page 2 RESOLUTION NO. -91 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING AGREEMENT WITH REGIONAL AMBULANGE FOR INSTALLATION OF AN EMERGENCY VEHICLE TRAFFIC SIGNAL PRE-EMPTION DEVICE, SOUTHBOUND GLARK AVENUE AT DUBLIN BOULEVARD WHEREAS, Regional Ambulance occupies a building located on Clark Avenue north of Dublin Boulevard; and WHEREAS, said building is directly adjacent to a residential neighborhood; and WHEREAS, operation of the ambulance siren is disturbing to the residents at night; and WHEREAS, public safety requires that the siren be utilized as necessary during an emergency response; and WHEREAS. emergency vehicle traffic signal pre-emption is not presently available for the southbound direction on Clark Avenue at Dublin Boulevard; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby approves the agreement with Regional Ambulance for installation and use of an emergency vehicle traffic signal pre-emption device for southbound Clark Avenue at Dublin Boulevard. BE IT FURTHER RESOLVED that the Mayor is authorized to execute the agreement. PASSED, APPROVED AND ADOPTED this 23rd day of December, 1991. AYES: NOES: ABSENT: Mayor ATTEST: City Clerk a:(corres)kdeckresoevp AGREEMENT BETWEEN CITY OF DUBLIN, REGIONAL AMBULANCE, AND RICHARD BURGE REGARDING EMERGENCY VEHICLE SIGNAL PRE-EMPTION This Agreement, dated December , 1991, is entered into between the City of Dublin, a municipal corporation ("city"), Regional Ambulance, Inc., a California Corporation ("Regional Ambulance"), and Richard Burge ("Burge"), as follows: RECITALS ao Be Regional Ambulance operates an ambulance business at 6465-C Clark Avenue, Dublin, California. Burge is the owner of the property located at 6465 Clark Avenue, Dublin, California, which is leased to Regional Ambulance. Regional Ambulance's business at 6465-C Clark Avenue is located adjacent to single-family residences and, in order to avoid the necessity of turning on sirens during nighttime hours, Regional Ambulance desires adjustments to the timing of the traffic signal at Clark Avenue and Dublin Boulevard. AGREEMENT The parties agree as follows: 1. Regional Ambulance shall retain the services of a licensed electrical contractor to install wiring and perform related work in order to adjust the timing of the signal at the intersection of Clark Avenue and Dublin Boulevard so that the signal will be capable of being activated by Regional Ambulance as provided herein. The scope of work for the contractor will be provided by the City. 2. The licensed electrical contractor selected by Regional Ambulance shall be subject to approval by the City, the City's traffic signal maintenance contractor (the County of Alameda), and Pacific Gas and Electric Company. 3. Except as provided in Paragraph 4 below, all costs of the work to be performed pursuant to this Agreement shall be paid for and borne by Regional Ambulance. Regional Ambulance will deposit the sum of $1,000 with the City to be used by City to pay for work performed by Alameda County and Pacific Gas and Electric Company in installing wiring and equipment to: Page 1 (a) Provide wiring from an existing Pacific Gas and Electric Company pole to the southwest corner of the building and connect said wiring to an existing electrical service pull box located at the base of the adjacent Pacific Gas and Electric Company pole; and (b) Connect wire to existing traffic signal controller system. If the sum deposited ($1,000) is not sufficient, Regional Ambulance shall increase the deposit immediately, city shall have no obligation to make payments to Alameda County and/or Pacific Gas and Electric Company in excess of the monies deposited by Regional Ambulance. Any funds remaining after such payments shall be returned to Regional Ambulance. 4. City will not charge the electrical contractor for any required permits in connection with the work to be performed hereunder. 5. Ail work shall be performed in accordance with applicable codes at the time the work is performed. 6. Regional Ambulance shall assure that the electrical contractor consults with the Alameda County Signal Maintenance Supervisor (Telephone 510/670-5537) to determine the specifications for wiring the controller cabinet located at the northeast corner of Dublin Boulevard and Clark Avenue. 7. By entering into this Agreement, Regional Ambulance and Burge consent to the necessary modifications to the building located at 6465 Clark Avenue to allow for the work to be performed pursuant to this Agreement and, further, consent to entry by the City's building inspector for purposes of inspecting the work performed hereunder. 8. Regional Ambulance will provide information to the City's Engineer regarding the period of time necessary between the time of activation by the ambulance crew of the emergency vehicle signal pre- emption device located at the building and the time the ambulance will clear the intersection of Clark Avenue and Dublin Boulevard. The final determination regarding timing of the signal shall be made by the City. 9. The adjustments to the timing made pursuant to this Agreement shall affect the southbound direction on Clark Avenue only and will have a lower priority than the emergency vehicle pre-emption for east- or westbound Dublin Boulevard. 10. When Regional Ambulance vacates the property, or when emergency vehicle traffic signal pre-emption for the purposes outlined Page 2 in this Agreement is no longer necessary for any other reason, Regional Ambulance and Burge agree to disconnect the system. 11. Abuse of the system, such as unnecessary activation of the system, will be cause for city to disconnect the system.
