A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF DUBLIN
APPROVING A MASTER SIGN PROGRAM AMENDMENT AND SCARLETT COURT
OVERLAY ZONING DISTRICT SITE DEVELOPMENT REVIEW FOR DUBLIN HYUNDAI
6015 SCARLETT COURT (APN 941-0550-032-03)
PLPA-2011-00027
WHEREAS, the Applicants, Ed Cornelius and Scott Anderson, on behalf of Dublin
Hyundai, has filed an application for a Master Sign Program Amendment to amend the existing
Master Sign Program for Dublin Hyundai (PLPA-2011-00004) to install a 78-foot tall freeway
oriented sign with a 400 square foot sign area per side;
and
WHEREAS, Dublin Hyundai is located within the Scarlett Court Overlay Zoning District;
WHEREAS, the installation of new signage within the Scarlett Court Overlay Zoning
District is also subject to Site Development Review; and
WHEREAS, the California Environmental Quality Act (CEQA), together with State
Guidelines and City Environmental Regulations require that certain projects be reviewed for
environmental impacts and that environmental documents be prepared; and
WHEREAS, pursuant to the CEQA, Staff is recommending that the Planning Commission
find this project exempt from further environmental review pursuant to Section 15311(a) of the
State CEQA Guidelines which exempts the construction or replacement of minor structures
accessory to existing commercial facilities, including on-premise signs; and
WHEREAS, a Staff Report was submitted to the City of Dublin Planning Commission
recommending approval of the Master Sign Program Amendment and Scarlett Court Overlay
Zoning District Site Development Review; and
WHEREAS, the Planning Commission held a public hearing on said application on
November 8, 2011; and
WHEREAS, proper notice of said hearing was given in all respects as required by law;
and
WHEREAS, the Planning Commission did hear and consider all said reports,
recommendations and testimony herein above set forth and used its independent judgment to
evaluate the project.
NOW, THEREFORE, BE IT RESOLVED that the City of Dublin Planning Commission
does hereby make the following findings and determinations regarding the Master Sign Program
Amendment and Scarlett Court Overlay Zoning District Site Development Review for a new 78-
foot tall freeway oriented sign with a 400 square foot sign area per side:

Master Sign Program Amendment:
A. The proposal is consistent with the purposes of Chapter 8.104, with the General Plan and
with any applicable Specific Plans and design guidelines in that: (1) the Master Sign
Program Amendment contributes to an orderly, attractive and harmonious signage
program that serves to identify the Dublin Hyundai automobile dealership; (2) the Master
Sign Program Amendment is consistent with the Scarlett Court Design Guidelines which
allows for freeway oriented signs; (3) the proposed freeway oriented sign is consistent in
location, design, colors, and materials with the Scarlett Court Design Guidelines as
described in the November 8, 2011 Staff Report; and (4) the proposed freeway oriented
sign serves to identify the automobile dealership to motorists traveling along Interstate
580.
B. The proposal is consistent with the provisions of Title 8, Zoning Ordinance in that: (1)
Chapter 8.34 (Scarlett Court Overlay Zoning District) requires that the installation of new
signage be subject to Site Development Review and a complete application for Site
Development Review has been submitted for the freeway oriented sign; and (2) the
proposed freeway oriented sign is substantially consistent with Chapter 8.84 (Sign
Regulations) in that a Master Sign Program has been applied for to deviate from
established standards for sign height and square footage as described in the November
8, 2011 Staff Report.
C. The design of the project is appropriate to the City, the vicinity, surrounding properties
and the lot in which the project is proposed in that: (1) the design of the proposed
freeway oriented sign will complement the existing buildings on-site as described in the
November 8, 2011 Staff Report and result in an effective means of identifying the
automobile dealership to motorists traveling along Interstate 580; and (2) all light sources
for the proposed freeway oriented sign will be adequately shielded so as not to cause
glare or light spill over onto adjacent roadways or properties as required by Section
8.84.060. B.3.
D. The subject site is physically suitable for the type and intensity of the approved
development in that: (1) the site has been designed for automobile sales and service
uses and the proposed freeway oriented sign supports the use which has been approved
for the site by providing identification of the business to motorists traveling along
Interstate 580; and (2) the proposed freeway oriented sign will be located in a landscape
planter of an appropriate dimension to protect the base of the sign from damage due to
vehicular traffic.
E. Impacts to existing slopes and topographic features are addressed in that: (1) the site is
fully improved and generally flat with no significant slopes or topographic features and the
installation of the proposed freeway oriented sign will not require any grading.
F. Architectural considerations including the character, scale and quality of the design, site
layout, the architectural relationship with the site and other buildings, screening of
unsightly uses, lighting, building materials and colors and similar elemenfs result in a
project that is harmonious with its surroundings and compatible with other development in
the vicinity in that: (1) the Master Sign Program Amendment contributes to an orderly,
attractive and harmonious signage program that serves to identify the Dublin Hyundai

automobile dealership to motorists traveling along Interstate 580; and (2) the design of
the proposed freeway oriented sign will complement the existing buildings on-site as
described in the November 8, 2011 Staff Report and result in an effective means of
identifying the automobile dealership to motorists traveling along Interstate 580.
G. Landscape considerations, including the location, type, size, color, texture and coverage
of plant materials, and similar elements have been incorporated into the project to ensure
visual relief, adequate screening and an attractive environment for the public in that: (1)
the proposed freeway oriented sign will be located in a landscape planter and the project
has been conditioned that the landscape planter be maintained with live plant material in
an attractive manner at all times.
H. The site has been adequately designed to ensure proper circulation for bicyclists,
pedestrians and automobiles in that: (1) the location of the proposed freeway oriented
sign will not obstruct on-site vehicular or pedestrian circulation as it will be located in a
landscape planter of an appropriate dimension to protect the base of the sign from
damage due to vehicular traffic.
I. The Master Sign Program Amendment's contribution to effective and attractive
identification of businesses, services and uses and the design quality of the site and
surrounding area will be superior to the quality that would result under the regulations
and standards of Section 8.84.040 (Sign Development Regulations), Section 8.84.050
(Signs Subject To Permits), Section 8.84.110 (Regulations For Wall Signs And Projecting
Signs), and Section 8.84.120 (Freestanding Sign General Regulations) in that: (1) the
proposed freeway oriented sign will maximize visibility of the automobile dealership to
motorists traveling along Interstate 580 which would not be the case under the standard
provisions because of obstruction by the freeway grade and BART station and existing
trees and freeway signage as further described in the November 8, 2011 Staff Report.
J. All of the proposed signs for the automobile dealership are compatible with the style or
character of existing improvements on the site and are well related to each other in that:
(1) the Master Sign Program Amendment contributes to an orderly, attractive and
harmonious signage program that serves to identify the Dublin Hyundai automobile
dealership to motorists traveling along Interstate 580; and (2) the design of the proposed
freeway oriented sign will complement the existing buildings on-site and result in an
appropriate means of identifying the automobile dealership to motorists traveling along
Interstate 580.
K. All. of the proposed signage generally conforms with the Design Criteria in Section
8.84.060 in that: (1) the proposed freeway oriented sign is of an appropriate height to
maximize visibility of the automobile dealership to motorists traveling along Interstate
580; (2) the sign area on the proposed freeway oriented sign has been designed at an
appropriate scale to maximize visibility of the automobile dealership to motorists traveling
along Interstate 580 and has been designed with contrasting background and sign copy
colors to provide optimal visibility; (3) all light sources for the proposed freeway oriented
sign will be adequately shielded so as not to cause glare or light spill over onto adjacent
roadways or properties; and (4) the proposed freeway oriented sign will be located in a
landscape planter to protect the base of the sign from damage due to vehicular traffic.

Scarlett Court Overlay Zoning District Site Development Review:
A. Approval of the application is consistent with the purpose and intent of Chapter 8.34
(Scarlett Court Overlay Zoning District) in that: (1) Chapter 8.34 (Scarlett Court Overlay
Zoning District) requires that the installation of new signage be subject to Site
Development Review and a complete application for Site Development Review has been
submitted for the proposed freeway oriented sign and (2) the proposed freeway oriented
sign is in substantial compliance with the Scarlett Court Design Guidelines (see E.
below).
B. Any approval complies with the policies of the General Plan, with any applicable Specific
Plans, with the development regulations or performance standards established for the
standard zoning district in which it is located, and with all other requirements of the
Zoning Ordinance in that: (1) the Master Sign Program Amendment contributes to an
orderly, attractive and harmonious signage program that serves to identify the Dublin
Hyundai automobile dealership; (2) the Master Sign Program Amendment is consistent
with the Scarlett Court Design Guidelines which allows for freeway oriented signs; (3) the
proposed freeway oriented sign is consistent in location, design, colors, and materials
with the Scarlett Court Design Guidelines as described in the November 8, 2011 Staff
Report; (4) the proposed freeway oriented sign serves to identify the automobile
dealership to motorists traveling along Interstate 580; (5) Chapter 8.34 (Scarlett Court
Overlay Zoning District) requires that the installation of new signage be subject to Site
Development Review and a complete application for Site Development Review has been
submitted for the proposed freeway oriented sign; and (6) the proposed freeway oriented
sign is substantially consistent with Chapter 8.84 (Sign Regulations) in that a Master Sign
Program has been applied for to deviate from established standards for sign height and
square footage as described in the November 8, 2011 Staff Report while still allowing for
appropriate identification of the automobile dealership.
C. The approval will not adversely affect the health or safety of persons residing or working
in the vicinity, or be detrimental to the public health, safety and general welfare in that: (1)
all project construction is subject to the issuance of building permits and compliance with
all Building Codes and Ordinances in effect at the time of permit issuance; and (2) all light
sources for the proposed freeway oriented sign will be adequately shielded so as not to
cause glare or light spill over onto adjacent roadways or properties.
D. The design of the project will provide a desirable environment for the development and
an attractive environment for the public in that: (1) the design of the proposed freeway
oriented sign will complement the existing buildings on-site and result in an attractive and
effective means of identifying the automobile dealership to motorists traveling along
Interstate 580; and (2) all light sources for the proposed freeway oriented sign will be
adequately shielded so as not to cause glare or light spill over onto adjacent roadways or
properties.
E. The project is in substantial compliance with the applicable chapters of the Scarlett Court
Design Guidelines in that: (1) the Scarlett Court Design Guidelines allow for freeway
oriented signs that are oriented towards vehicles traveling along Interstate 580 and one
freeway oriented sign is allowed per property. Dublin Hyundai has proposed a freeway
oriented sign on a legal parcel that currently does not have a freeway oriented sign. (2)

The Scarlett Court Design Guidelines state that freeway oriented signs should be limited
to a height of 35-feet. Section 8.84.120.H of the Dublin Zoning Ordinance allows
freestanding signs to exceed 35-feet in height pursuant to a Master Sign Program and
Dublin Hyundai has submitted a complete application for a Master Sign Program
Amendment to add the proposed freeway oriented sign to the existing Master Sign
Program for the automobile dealership. (3) The Scarlett Court Design Guidelines
encourage freeway oriented signs to be mounted on a solid structure or a minimum of
two structural columns. Dublin Hyundai has proposed a freeway oriented sign with two
structural columns. (4) The Scarlett Court Design Guidelines refer back to Chapter 8.84
(Sign Regulations) of the Dublin Zoning Ordinance for maximum sign area and Section
8.84.120.1 of the Dublin Zoning Ordinance limits the maximum sign area to 150 square
feet per side unless pursuant to a Master Sign Program. Dublin Hyundai has submitted a
complete application for a Master Sign Program Amendment to add a 400 square foot
sign area per side freeway oriented sign to the existing Master Sign Program for the
automobile dealership. (5) The Scarlett Court Design Guidelines encourage the use of
sign materials that complement the architectural character of the buildings on the
property and are constructed out of high quality materials such as acrylic, aluminum, and
weather resistant wood and composite materials. Dublin Hyundai proposes an aluminum
sign cabinet. The design, colors and materials of the sign cabinet are consistent with the
architectural elements and colors on the showroom building. (6) The Scarlett Court
Design Guidelines encourage contrast between the background of the sign and the sign's
letters to maximize legibility of the sign. Color schemes are encouraged to be limited to
five colors to maintain visual balance. Dublin Hyundai proposes a dark blue background
with a chrome finish logo and letters which provides contrast to maximize the legibility of
the sign. The color scheme consists of two colors, blue and chrome and the sign
incorporates the Hyundai logo. (7) The Scarlett Court Design Guidelines encourage
logos along Interstate 580 for easy identification. Fonts that are simple and easily
readable are also encouraged for clear legibility. Letters are encouraged to be no more
than 75% of the background to maximize readability. Dublin Hyundai proposes a font
style that is all capital letters in a block face font which is simple and easily readable. The
area of the sign letters is less than 75% of the total background area of the sign.
BE IT FURTHER RESOLVED that the City of Dublin Planning Commission does hereby
find the project exempt from further environmental review pursuant to Section 15311(a) of the
State CEQA Guidelines and approves a Master Sign Program Amendment and Scarlett Court
Overlay Zoning District Site Development Review for a freeway oriented sign at Dublin Hyundai
as indicated in the Written Statements dated received by Dublin Planning on June 23, 2011 and
September 20, 2011 signed by Guy S. Houston, the sign detail prepared by AGI dated received
by Dublin Planning on September 20, 2011, the site plan prepared by RJA and preliminary
landscape plan labeled Planting Plan dated received by Dublin Planning on October 24, 2011
subject to the following conditions:
CONDITIONS OF APPROVAL
Unless stated otherwise, all Conditions of Approval shall be complied with prior to the issuance
of building permits and shall be subject to Planning Division review and approval. The following
codes represent those departments/agencies responsible for monitoring compliance of the

GENERAL
1. Approval. This Master Sign Program Amendment PL On-going Planning
and Scarlet Court Overlay Zoning District Site
Development Review approval for PLPA-2011-
00027 is fora 78-foot tall freeway oriented sign for
Dublin Hyundai located at 6015 Scarlett Court.
This approval amends the Master Sign Program
approved by Planning Commission Resolution 11-
12 for wall signs and directional signs at Dublin
Hyundai to add the 78-foot tall freeway oriented
sign. All Conditions of Approval contained in
Resolution 11-12 shall remain in full force and
effect.
The installation of the 78-foot tall freeway oriented
sign shall conform to the Written Statements dated
received by Dublin Planning on June 23, 2011 and
September 20, 2011 signed by Guy S. Houston,
the sign detail prepared by AGI dated received by
Dublin Planning on September 20, 2011, the site
plan prepared by RJA and preliminary landscape
plan labeled Planting Plan dated received by
Dublin Planning on October 24, 2011, stamped
approved and on file in the Community
Development Department, except as modified by
the conditions of a royal contained herein.
2. Permit Expiration. Construction or use shall PL 1 year from DMC
commence within one (1) year of Permit approval approval 8.96.020.D
or the Permit shall lapse and become null and void.
Commencement of construction or use means the
actual construction or use pursuant to the Permit
approval, or demonstrating substantial progress
toward commencing such construction or use. If
there is a dispute as to whether the Permit has
expired, the City may hold a noticed public hearing
to determine the matter. Such a determination may
be processed concurrently with revocation
proceedings in appropriate circumstances. If a
Permit expires, a new application must be made
and processed according to the requirements of
the Ordinance codified in this subsection.

3. Time Extension. The original approving decision- PL 1 year from DMC
maker may, upon the Applicant's written request approval 8.96.020.E
for an extension of approval prior to expiration, and
upon the determination that any Conditions of
Approval remain adequate to assure that
applicable findings of approval will continue to be
met, grant a time extension of approval for a period
not to exceed 6 months. All time extension
requests shall be noticed and a public hearing or
public meeting shall be held as required by the
articular Permit.
4. Clarifications to the Conditions of Approval. In PL On-going Planning
the event that there needs to be clarification to the
Conditions of Approval, the Community
Development Director has the authority to clarify
the intent of these Conditions of Approval to the
Applicant without going to a public hearing. The
Community Development Director also has the
authority to make minor modifications to these
Conditions of Approval without going to a public
hearing in order for the Applicant to fulfill needed
improvements or mitigations resulting from impacts
to this ro'ect.
5. Modifications. All signage shall be subject to PL On-going Planning
review by the Community Development
Department for conformance with this Master Sign
Program Amendment approval. Modifications to
this Master Sign Program Amendment approval
and/or to the specific conditions stated herein may
be considered by the Community Development
Director pursuant to Chapter 8.104 (Site
Development Review) of the Dublin Zoning
Ordinance.
6. Approval Subject to Review. This approval shall PL On-going Planning
be subject to periodic review by the Community
Development Director to determine compliance
with the conditions of approval. Any violation of
the terms or conditions of this approval may be
subject to the issuance of a citation.
7. Revocable for Cause. This approval shall be PL On-going Planning
revocable for cause in accordance with Chapter
8.84 (Sign Regulations) of the Dublin Zoning
Ordinance.
PLANNING
8. Zoning Clearance for Permanent Signs. Prior to PL Issuance Planning
the issuance of a building permit for the 78-foot of Building
freeway oriented sign, a Zoning Clearance for Permits
Permanent Si ns shall be a lied for and

approved by the Community Development
De artment.
9. Final Landscape Plan. A final landscape plan PL Issuance Planning
shall be submitted to the Community Development of Building
Department for review and approval concurrently Permits
with an application for a Zoning Clearance for
Permanent Signs. The 78-foot tall freeway
oriented sign shall be located in a planter of
appropriate dimension. The design of the
landscape planter should be of sufficient width,
length and height to protect the base of the sign
from dama a due to vehicular traffic.
10. Minor Modifications to the Preliminary PL On-going Planning
Landscape Plan. Minor modifications to the
preliminary landscape plan dated received by
Dublin Planning on October 24, 2011 may be
approved by the Community Development Director
if the modifications substantially comply with the
preliminary landscape plan and meets the intent of
Section 8.84.120.A.
11. Sign Maintenance. The 78-foot tall freeway PL On-going Planning
oriented sign shall be well-maintained in an
attractive manner and in accordance with the
approved plans. Lighting mechanisms which burn
out shall be replaced in a timely manner. Any
chipping, cracking or weathering of any sign
component shall also be repaired in a timely
manner.
BUILD #NG
12. Building Codes and Ordinances. All project B Through Building
construction shall conform to all building codes and Completion
ordinances in effect at the time of building permit
issuance.
13. Building Permits. To apply for building permits, B Issuance Building
Applicant/Developer shall submit five (5) sets of of Building
construction plans to the Building Division for plan Permits
check. Each set of plans shall have attached an
annotated copy of these Conditions of Approval.
The notations shall clearly indicate how all
Conditions of Approval will or have been complied
with. Construction plans will not be accepted
without the annotated resolutions attached to each
set of plans. Applicant/Developer will be
responsible for obtaining the approvals of all
participation non-City agencies prior to the
issuance of buildin ermits.
14. Construction Drawings. Construction plans shall B Issuance Building
be full dimensioned includin buildin elevations of Buildin

accurately drawn (depicting all existing and Permits
proposed conditions on site), and prepared and
signed by a California licensed Architect or
En ineer.
