A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ADOPTING A MITIGATED NEGATIVE DECLARATION AND
MITIGATION MONITORING PROGRAM FOR PA 99-030,
TRUMARK COMPANIES-SCARLETT PLACE
WHEREAS, Trumark Companies ("Applicant/Developer") have requested approval for a residential
development consisting of 60 duplexes on approximately 4 net acres, located on the east side of Dougherty
Road, immediately southeast of the Park Sierra apartment complex and further identified as APN 941-550-
22-5; and
WHEREAS, the California Environmental Quality Act (CEQA), together with State guidelines and
City environmental regulations require that certain projects he reviewed for potential environmental
impacts and that environmental documents be prepared; and
WHEREAS, an Initial Study was conducted for this project with the finding that with the
incorporation of mitigation measures into the proposed project, there would be no significant effects on the
environment; and
WHEREAS, a Mitigated Negative Declaration has been prepared for this application and is on file in
the Dublin Planning Department; and
WHEREAS, the Planning Commission did hold a properly noticed public hearing on said application
on July 25, 2000 and did adopt a Resolution recommending that the City Council adopt a Mitigated
Negative Declaration and Mitigation Monitoring Program for PA 99-030; and
WHEREAS, a properly noticed public hearing was held by the City Council on August 15, 2000;
and
WHEREAS, a Staff Report was submitted recommending that the City Council adopt a Mitigated
Negative Declaration and Mitigation Monitoring Program for PA 99-030; and
WHEREAS, the City Council did hear and use their independent judgment and considered all said
reports, recommendations and testimony hereinabove set forth.
NOW, THEREFORE, BE IT RESOLVED THAT the Dublin City Council does hereby find that:
A. The Trumark Companies project application will not have a significant effect on the environment
with the application of identified mitigation measures, based on a review of the Initial Study and public
testimony.
B. The Mitigated Negative Declaration has been prepared in accordance with State and local
environmental laws and guideline regulations.
C. The Mitigated Negative Declaration is complete and adequate.
BE IT FURTHER RESOLVED THAT THE Dublin City Council does hereby adopt a
Mitigated Negative Declaration and Mitigation Monitoring Program PA 99-030 for Tmmark
Companies, Scarlett Drive. The Mitigation Monitoring Program (Attachment 5) and the Initial
Study/Mitigated Negative Declaration (Attachment 4) are incorporated herein by reference.
