Adopt the attached Resolution and authorize the City Manager to
execute an Agreement with the Dublin Unified School District for
funding computer technical support under the "Computers For Our
Schools Project."
FINANCIAL STATEMENT:
The Adopted Fiscal Year 2000-2001 Budget includes $150,000 for
capital support and another $100,000 in operational support for the
"Computers For Our Schools Project."
DESCRIPTION: As part of the Fiscal Year 2000-2001 Budget process, the City Council
approved a proposal to allocate $150,000 in "matching" money for the Fiscal Year 2000-2001
"Computers For Our Schools Project," in accordance with the original Agreement dated September 30,
1999. To approve this continued level of funding the City Council must approve the attached Resolution.
In addition, the City Council authorized up to $100,000 for computer technical support under the
"Computers For Our Schools Project." The $100,000 funding was proposed, based on the anticipated
number of computers that the Dublin Unified School District will receive this Fiscal Year under the
Project. Because the funding of computer technical support is an operational expense a separate
Agreement between the City and the Dublin Unified School District is required. On August 16, 2000, the
School Board approved the attached agreement.
RECOMMENDATION: Consistent with the adopted Budget, Staff recommends that the City Council
adopt the attached Resolution and authorize the City Manager to execute the Agreement with the Dublin
Unified School District for funding computer technical support under the "Computers For Our Schools
Project."

AGREEMENT BETWEEN CITY OF DUBLIN AND
DUBLIN UNIFIED SCHOOL DISTRICT
REGARDING FUNDING FOR COMPUTER TECHNICAL SUPPORT
THIS AGREEMENT is entered into this 5th day of September, 2000 by and between the
City of Dublin ("City"), a municipal corporation, and the Dublin Unified School District
("District") .
RECITALS
A. The education of the City's children benefits all residents of the City.
B. Although the District is responsible for the education of the children living within
the City, the City is authorized to take actions which promote the general health, welfare, and
safety of the community at large.
C. Knowledge of, and ability to use, computers and related technology are fast
becoming necessary to function effectively in the workforce and in society in general.
D. It is in the best interest of the community that children residing within the City
receive education and training in the many uses of computers and related technology, in that
well-trained and educated young people will become productive members of the community.
E. To provide the best possible education in the many uses of computers and related
technology, District needs to acquire computers and related technological devices and equipment
and to maintain that equipment to keep it in working order and extend its useful life.
F. To encourage the participation of the community at large to help the District
provide the best possible computer/technology education to its students, City authorized the
expenditure of up to One Hundred and Fifty Thousand Dollars ($150,000) in Fiscal Year 2000-
2001 to match any donations from individuals, community groups/organizations, and businesses
to the District of computers or monetary contributions to be used for the purchase of computers.
G. City has further authorized up to One Hundred Thousand Dollars ($100,000) for
District to hire or contract with individuals to proviqe technical support and maintenance of its
computers and related equipment for Fiscal Year 2000-2001.
H. The purpose of this agreement is to assUre that District students will be able to
obtain the computer/technological education intended by the acquisition of the computers
discussed herein and by the careful maintenance of those computers and related equipment.
Now, therefore, the parties agree as follows:

AGREEMENT
Section 1.
Funding for Technical Support by City
On September 1,2000, City will contribute Thirty Thousand Dollars ($30,000) to District
for technical support of the District's computers that have been acquired through the "Computers
For Our Schools Project."
Section 2.
Additional Funding
If during Fiscal Year 2000-2001 District determines additional funding for technical support is
required to maintain computers acquired during Fiscal Year 2000-2001 for the "Computers For
Our School Project" City will contribute up to an additional Seventy Thousand Dollars
($70,000). To obtain additional funding, District must make a written request to City and
provide an accounting of the initial technical support funding from City, as required by Section
5.
Section 3.
Use of Technical Support Funding by District
District will use the funds described in Sections 1 and 2 to hire staff or independent
contractors who will provide technical support for computers and equipment acquired through
the "Computers For Our Schools Project."
District agrees to hire or contract with only competent individuals capable of providing
high-quality technical support services. District further agrees to manage the work of such
individuals to assure the quality of their services.
Section 4.
Status of Technical Support Staff
Individuals receiving payment from District for technical support services shall be
employees or independent contractors of District. Such individuals shall not be employees or
independent contractors of City. City shall have no responsibility for any direct payment to such
technical support staff, including wages, benefits, workers' compensation, and any other
compensation.
Section 5.
Miscellaneous
At the end of Fiscal Year 2000-2001 and upon application by District for the additional
funding described in Section 2, District shall provide City with an accounting of all funding
received from City under this Agreement.
District shall make available to City all records related to the receipt and expenditure of

funds provided by City pursuant to the Agreement.
A. Recitals.
The foregoing recitals are true and correct and are made a part hereof.
B. Additional Documents and Agreements
The parties agree to cooperate in the execution of any additional documents,
which may be required to carry out the terms of this agreement.
C. Effective Date of Agreement.
This Agreement shall become effective on August 15,2000.
D. Term.
This Agreement shall be effective on the effective date and shall continue in effect
until through Fiscal Year 2000-2001.
E. Law Governing.
This Agreement is made under the Constitution and laws of the State of
California.
F. Amendments.
All amendments to this Agreement must be in writing, and must be approved by
the parties prior to becoming effective.
G. Severability.
In the event any provision of this Agreement is determined to be illegal or invalid
for any reason, all other provisions and articles of this Agreement shall remain in full
force and effect unless and until otherwise determined. The illegality of any provision of
this Agreement shall in no way affect the legality and enforceability of any other
provisions of this Agreement.
H. Successors.
This Agreement shall be binding upon and all inure to the benefit of the
successors of the City and District. Neither City nor District may assign any right or
obligation hereunder without written consent ofthe other.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN

AUTHORIZING FISCAL YEAR 2000-2001 FUNDING
FOR THE "COMPUTERS FOR OUR SCHOOLS PROJECT"
MATCHING MONEY AGREEMENT
WHEREAS, the City of Dublin, the Dublin Unified School District, and Dublin Partnerships in
Education entered into an Agreement on September 30, 1999 for the "Computers For Our Schools
Project;" and
WHEREAS, the City wishes to provide additional funding for the "matching" money as defined in
the original Agreement for Fiscal Year 2000-2001.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby
authorizes $150,000 in "matching" money for the Fiscal Year 2000-2001 "Computers For Our Schools
Project," in accordance with the Agreement dated September 30, 1999.
