D. "No parking vehicles over 20 feet in length" restriction has been installed along the north side
of Houston Place between Dougherty Road and the easterly parcel map boundary.
At the time the City and Archstone Communities Trust executed the Tract Developer Agreement, the
developer provided a Performance Bond and a Labor and Materials Bond in the amount of $2,297,625
to guarantee performance of the work. Now that the work is complete, these bonds may be released in
accordance with the authority contained in §66499.7 of the Government Code, and replaced with a
Maintenance Bond in the amount necessary to guarantee the work for a one-year period following
acceptance. The developer has provided a Maintenance Bond in the amount of $574,406.25, which is
25% of the original Performance Bond amount, and is sufficient to guarantee the improvements for a
one-year period after acceptance.
Staff recommends that the City Council adopt the Resolution accepting the improvements and approving
the regulatory traffic control devices installed for Parcel Map 7537, "Iron Horse Trail Apartments".

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF IMPROVEMENTS FOR PARCEL MAP 7537
(IRON HORSE TRAIL APARTMENTS BY ARCHSTONE COMMUNITIES TRUST)
AND APPROVING REGULATORY TRAFFIC CONTROL DEVICES
WHEREAS, the subdivider of Parcel Map 7537, filed on October 12, 2001 in Book 260 of Maps
at Pages 78 - 81, previously entered into an agreement with the City of Dublin to construct improvements
in accordance with plans and specifications on file with the Director of Public Works, said Parcel Map
identified as follows:
a) Subdivider: Archstone Communities Trust, A Maryland Real Estate
Investment Trust
b) Project Location: Northeast coruer of Dougherty Road and Houston Place
c) Project Size: 177 Apartment Units
d) Resolution Approving Agreement: 138-01, City of Dublin City Council
e) City Streets Affected: Dougherty Road and Houston Place
WHEREAS, the improvements associated with Parcel Map 7537 are complete in accordance with
said plans and specifications, and any approved modifications thereto, to the satisfaction of the Director of
Public Works; and
WHEREAS, the developer has installed certain regulatory traff~c control devices as a part of the
project improvements; and
WHEREAS, the original Performance Bond and Labor and Materials Bond can be released, in
accordance with the authority contained in §66499.7 of the Government Code of the State of Califoruia,
and replaced with a Maintenance Bond to guarantee the completed work for a one-year period following
acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
1. The improvements completed with said project are hereby approved and accepted subject
to a one-year guarantee period; and
2. The traffic regulatory devices installed by the developer are hereby included in the City of
Dublin Traffic Code, said regulatory devices to include the following:
a) Houston Place is designated as a "Through Street."
b) Stop control device installed at the westbound approach of Houston Place at
Dougherty Road.
c) "No parking" restriction along the east side of Dougherty Road between
Houston Place and to the northerly parcel map boundary.
· d) "No parking vehicles over 20 feet in length" restriction along the north side of
Houston Place between Dougherty Road and to the easterly parcel map
boundary.
3. The original Performance Bond issued by Travelers Casualty and Surety Company of
America (Bond No. 103601298) in the amount of $2,297,625.00 be released; and
4. The original Labor and Materials Bond issued by Travelers Casualty and Surety Company
of America (Bond No. 103601298) in the amount of $2,297,625.00 be released; and
5. The submitted Maintenance Bond issued by Travelers Casualty and Surety Company of
America (Bond No. 103601298) in the amount of $574,406.25 be accepted as security for
the aforesaid one-year maintenance period, said period to commence on this date and
terminate on the 18th day of February, 2004.
PASSED, APPROVED AND ADOPTED this 18th day of February, 2003.
