SUBJECT: Acceptance of Improvements, Tract 7181, "Scarlett Place"

FINANCIAE'ST~TEMENT: Scarlett Homes, LLC, has provided Maintenance Bonds in the
amounts of $453,156 for onsite improvements and $329,969 for
Dougherty Road, Scarlett Drive and Houston Place improvements,
for a total amount of $783,125 to guarantee against defects for one
year. Once these improvements have been accepted, the City will
incur maintenance and street sweeping costs for the City street
improvements on Dougherty Road, Scar!ett Drive and Houston
Place. All internal streets are private, with maintenance to be
performed by a Homeowner's Association.
Street light maintenance costs for the public streets will be paid
by the City-wide Street Lighting Maintenance Assessment District
83-1. Maintenance of landscaping within the site, the common
areas, and along the street frontages in the public right-of-way of
Dougherty Road, Scarlett Drive and Houston Place will also be
performed by a Homeowner's Association.
DESCRIPTION: The Scarlett Place project (Tract 7181) is generally bounded by
Dougherty Road, Scarlett Drive and Houston Place, and consists of 60 duet residential unit lots, as well
as 10 common area parcels. As part of this project, the developer widened Dougherty Road along the tract
frontage, and constructed a new segment of Scarlett Drive from Dougherty Road to Houston Place. This
work also required modifications to add a westbound leg to the existing traffic signal on Dougherty Road
where it intersects ;vith the Park Sierra Apartments, and a new split-rail fence along the Iron Horse Trail
to separate vehicle traffic from trail users.

The internal streets and landscaping are private, and will be maintained by the Homeowner's Association.
The subdivision improvements have been constructed pursuant to the Tract Developer Agreement and to
the satisfaction of the City Engineer, and should now be accepted by the City for permanent maintenance.
The following regulatory traffic devices will be accepted and approved as part of this project and added to
the City of Dublin Traffic Code:
a) Scarlett Drive and Houston Place are designated as "Through Streets" (Traffic Code Chapter 6.08)
b) Bray Court, Gatwick Court, Kerry Court, Kilkenny Drive, Moore Place, Sussex Court and Sussex
Drive are designated as "Private Streets".
c) A Stop control device has been installed on the northerly approach of Houston Place at Scarlett
Drive (Traffic Code Section 6.16.020).
d) No Parking Restriction on the north side of Scarlett Drive between Dougherty Road and Houston
Place, and on the east side of Dougherty Road between Scarlett Drive and southerly tract boundary
(Traffic Code Section 6.28.010).
At the time the City and Scarlett Homes, LLC, executed the Tract Developer Agreement, Scarlett Homes,
LLC, provided a Performance Bond and a Labor and Materials Bond, each in the amount of $1,812,625,
to guarantee the onsite improvements, and a Performance Bond and a Labor and Materials Bond, each in
the amount of $1,319,875, to guarantee Dougherty Road, Scarlett Drive and Houston Place improvements.
Now that the work is complete, these bonds may be released in accordance with authority contained in
§66499.7 of the Government Code, and replaced with Maintenance Bonds in the amount necessary to
guarantee against defects for a one-year period following acceptance of the work. The developer has
provided Maintenance Bonds in the amount of $453,155 for on-site improvements and $329,969 for
Dougherty Road, Scarlett Drive and Houston Place improvements, for a total of $783,125, which is 25%
of the original Performance Bond amounts, and which is sufficient to guarantee the improvements for one
year from the date of acceptance.
Staff recommends that the City Council adopt the Resolution accepting the improvements and approving
the regulatory traffic control devices installed for Tract 7181, Scarlett Place.
RESOLUTION NO. - 03
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTANCE OF IMPROVEMENTS, TRACT 7181, "SCARLETT PLACE"
(SCARLETT HOMES LLC, A CALIFORNIA LIMITED LIABILITY COMPANY) AND
APPROVING REGULATORY TRAFFIC CONTROL DEVICES
WHEREAS, the subdivider of Tract 7181, filed on November 13, 2001 in Book 261 of Maps at
Pages 79 - 87, previously entered into an agreement with the City of Dublin to improve said Tract in
accordance with plans and specifications on file with the City Engineer, said Tract identified as follows:
a) Subdivider: Scarlett Homes, LLC, a California Limited Liability
Company
b) Tract Location: Dougherty Road and Scarlett Drive
c) Tract Size: 60 Duet Residential Lots
d) Resolution Approving Final Map: No. 14-01, City Council of Dublin
e) City Streets Affected: Dougherty Road, Houston Place and Scarlett Drive
WHEREAS, improvements associated with Tract 7181 are complete in accordance with said plans
and specifications, and any approved modifications thereof, to the satisfaction of the City Engineer; and
WHEREAS, the developer has installed certain regulatory traffic control devices as a part of the
Tract improvements; and
WHEREAS, the original Performance Bonds and Labor and Materials Bonds can be released, in
accordance with the authority contained in §66499.7 of the Government Code of the State of California,
and replaced with Maintenance Bonds to guarantee the completed work for a one-year period following
acceptance;
NOW, THEREFORE, BE IT RESOLVED that:
1. Theimprovements completed on Dougherty Road, Houston Place and Scarlett Drive and
within said Tract are hereby approved and accepted subject to a one-year guarantee period;
and
2. The traffic regulatory devices installed by the developer are hereby included in the City of
Dublin Traffic Code; said regulatory devices to include the following:
a) Scarlett Drive and Houston Place are designated as "Through Streets".
b) Bray Court, Gatwick Court, Kerry Court, Kilkenny Drive, Moore Place, Sussex
Court and Sussex Drive are designated as "Private Streets".
c) Stop control device installed on the northbound approach of Houston Place at
Scarlett Drive.
d) "No Parking Anytime" restriction on the north side of Scarlett Drive between
Dougherty Road and Houston Place.
e) "No Parking Anytime" restriction on the east side of Dougherty Road between
Scarlett Drive and southerly tract boundary; and
3. The original Performance Bonds issued by Travelers Casualty and Surety Company of
America in the amount of $1,319,875.00 (Bond No. 103323861) and in the amount of
$1,812,625.00 (Bond No. 103323863) be released; and
4. The original Labor and Materials Bonds issued by Travelers Casualty and Surety Company
of America in the amount of $1,319,875.00 (Bond No.103323861) and in the amount of
$1,812,625.00 (Bond No. 103323863) be released; and
5. The submitted Maintenance Bonds issued by Travelers Casualty and Surety Company of
America in the amount of $453,156.00 (Bond No. 103323863M) for on-site improvements
and in the amount of $329,969.00 (Bond No. 103323861M) for off-site improvements
in the total amount of $783,125.00 be accepted as security for the aforesaid one-year
guarantee period, said period to commence on this date and terminate on the 4th day
of March, 2004.
PASSED, APPROVED AND ADOPTED this 4th day of March, 2003.
