Acceptance of Work Fallon Sports Park -Fencing Contract #11-08

EXECUTIVE SUMMARY:
Construction Contract #11-08 was a Fallon Sports Park fencing project performed under a
contract awarded to Golden Bay Fence Plus Ironworks. The work is now complete and ready
for City Council acceptance.
FINANCIAL IMPACT:
The work associated with this contract was completed as part of the 2011/2012 Park
Maintenance Operating Budget at a cost of $19,919. This amount is the same as the contract
award by the City Council on August 16, 2011, with no change orders.
RECOMMENDATION:
Staff recommends that the City Council: 1) Adopt the resolution accepting improvements to
Fallon Sports Park (Contract No. 11-08); and 2) Authorize Staff to accept a maintenance bond in
the amount of $1,991.90 and release the final retention upon receipt of the bond.

DESCRIPTION:
At its meeting of August 16, 2011 the Dublin City Council awarded Contract Number 11-08,
Fallon Sports Park -Fencing, to Golden Bay Fence Plus Ironworks.
Work under the Contract included the installation of fencing on the south side of the parking lot
and wood bollards on the north side to manage vehicular and pedestrian access. Staff, along
with representatives from Golden Bay Fence Plus Ironworks, completed a walkthrough of the
project on December 7, 2011 and all elements of the project were complete.
The City presently holds a performance bond in the amount of $19,919 to provide the necessary
security for the performance of the work involved. As the work is now complete, the
performance security requirement can be reduced, in accordance with authority contained in
Section 66499.7 of the Government Code, to an amount necessary to guarantee warranty of the
work for cone-year period following acceptance of the work. The Contractor will provide a new
maintenance bond in the amount of $1,991.90, which is 10% of the final contract amount, and is
sufficient to cover the one-year guarantee period.
Upon City Council acceptance of the project, Staff will file a notice of completion with the
Alameda County Clerk.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
A notice of completion will be filed with Alameda County.

ACCEPTING IMPROVEMENTS TO FALCON SPORTS PARK -FENCING
CONSTRUCTION CONTRACT 11-08
WHEREAS, Golden Bay Fence Plus Ironworks entered into a contract with the City of Dublin
to install fencing and bollards in accordance with plans and specifications on file with the City
Engineer; and
WHEREAS, said improvements have been completed in accordance with said plans and
specifications, and any approved modifications thereof, to the satisfaction of said City Engineer of
the City of Dublin; and
WHEREAS, as a condition of said contract, Golden Bay Fence Plus Ironworks is required to
warranty the improvements for a period of one year following acceptance of the work by the City of
Dublin; and
WHEREAS, the improvements are now completed, and the original performance bond
security requirement can be reduced, in accordance with the authority contained in Section 66499.7
of the Government Code of the State of California, to an amount found necessary to guarantee
maintenance of the completed work for the aforesaid one-year period.
NOW, THEREFORE, the City Council of the City of Dublin does RESOLVE
1. To approve and accept the improvements completed within the said Park, subject to the
aforesaid one-year warranty; and
2. The aforesaid performance bond security requirement be reduced from the amount of
$19,919.00 to the amount of $1,919.90 upon acceptance by Staff of the replacement
maintenance bond as security for the aforesaid one-year maintenance period; and
3. The said original performance bond posted in connection with the work involved in the
construction of said Facility be hereby released upon acceptance of said warranty.
