HomeMy WebLinkAboutPC Reso 85-024 PA85-027 OwensIRESOLUTION NO. 85-024 b J-024 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF DUBLIN APPROVING PA 85-027, OWENS-ILLINOIS, INC., CONDITIONAL USE PERMIT REQUEST TO ALLOW A GLASS RECYCLING BIN LOCATED WITHIN THE PARKING AREA OF THE FOUR-BUILDING OFFICE COMPLEX AT THE SOUTHERN TERMINUS OF AMADOR PLAZA ROAD WHEREAS, Owens-Illinois, Inc. requests approval of a Conditional Use Permit to allow location and use of a glass recycling bin within the parking area serving 6665 Amador Plaza Road, one of four two-story office buildings located on a 6.9~ acre parcel situated at the southern terminus of Amador Plaza Road, more specifically identified as APN 941-1500-41; and WHEREAS, the subject property was rezoned to a PD; Planned Development District in 1981, which allowed among other uses, C-l; Retail Business District uses that are compatible with C-O; Administrative Office District uses; and WHEREAS, the adopted City of Dublin Zoning Ordinance restricts the operation of a glass recycling bin in a C-l; Retail Business District until a Conditional Use Permit is secured; and WHEREAS, the Planning Commission did hold a public hearing on said application on May 20, 1985; and WHEREAS, proper notice of said public hearing was given in all respects as required by law; and WHEREAS, this application has been reviewed in accordance with the provisions of the California Environmental Quality Act and has been found to be categorically exempt; and WHEREAS, the Planning Commission finds that the Conditional Use Permit will not have a significant environmental impact; and WHEREAS, the Staff Report was submitted recommending that the Conditional Use Permit application be approved; and WHEREAS, the Planning Commission did hear and consider all said reports, recommendations and testimony herein above setforth; and WIREREAS, the proposed land use, if conditionally approved, is appropriate for the subject property in terms of being compatible to existing land uses in the area and will not overburden public services; NOW, THEREFORE, BE IT RESOLVED THAT THE Planning Commission finds: a) Location and use of the glass recycling bin are required, and serve, the public'need in that its use will aid to reduce landfill problems, conserve raw materials, save on fuel and energy, facilitate the public's education that all glass recycles, and that proceeds generated from this center will aid a locally based non-profit group; b) The uses will be properly related to other land uses, and transportation and service facilities in the vicinity; DP 83-20 c) The uses will not materially adversely affect the health or safety of persons residing or working in the vicinity, or be materially detrimental to the public welfare or injurious to property or improvements in the neighborhood, as all applicable regulations will be met; d) The uses will not be contrary to the specific intent clauses or performance standards established for the District in which it is to be located, as the proposed uses will be compatible and adjoining office uses; e) The approval of the Conditional Use Permit will be consistent with the Dublin General Plan; BE IT FURTHER RESOLVED that the Planning Commission does hereby conditionally approve said application as shown by materials labelled Exhibit A and Attachement 3, on file with the Dublin Planning Department, subject to the following conditions: 1. Development shall be generally as shown on the site plan prepared by the Planning Department in conjunction with this application and as described by the applicant's written statements dated received by the Dublin Planning Department on March 28, 1985 and April 10, 1985. Use and operation of the glass recycling bin shall be subject to the conditions listed below. 2. The permit is issued to the applicant, Owens-Illinois, Inc. only, and shall not be transferable. 3. The permit shall be valid for a period of two (2) years, at which time it shall be necessary to apply for renewal. Failure tc establish the use as conditioned by this permit within six months of the effective date of the permit will cause the permit to become null and void. At any time during the effective period of this approval, the approval shall be revocable for cause in accordance with Section 8-90.3 of the Dublin Zoning Ordinance. 4. Ail signage, beyond the signage currently on the recyclying bin, shall be subject to review and approval by the Planning Director as regards size, location, copy, construction materials and design. No off-site signs shall be permitted in conjunction with this permit. 5. Use and location of the g!as~ recycling bin shall be controlled so as not to create a nuisance to the existing and/or future tenants in the adjoining office complex or the general public utilizing the parking area or recycling bin. 6. The parking space immediately adjoining the recycling bin shall be striped as a "No Parking" zone to allow ease of access to and use of the recycling bin. 7. The use established under this permit shall be subject to review after the one-year anniversary of intitial occupancy to determine compliance with the above-conditions or what additional requirements may be needed. The Planning Director may refer the matter back to the Planning Commission for disposition. PASSED, APPROVED AND ADOPTED this 20th day of May, 1985. AYES: 4 NOES: ABSENT: 0 Cm.
